MINUTES OF THE PROCEEDINGS
OF THE
HUGO PLANNING COMMISSION
September 28, 1977
The public hearing to consider the request of Mr. Schuh was called
to order by acting Chairperson Theodora Peltier at 7:36 PM
PRESENT: Peltier, Peloquing, Gillen, and McAllister
ABSENT: Ehret, Greger, and Rosenquist
Ehret arrived at 7:55 PM and Larry Irsfeld arrived at 7:45 PM.
Mr. Schuh was present stating that he would like to mine more gravel
as the need arises. Pelter read that letter received from Mr.
Schuh's attorney. Peloquin stated that he had no problem with
any of the request. Mr. Schuh would like to get some kind of per-
mission to go ahead with projects without coming to City Hall
with every request. Marlowe Peuse, neighboring resident, agreed
saying that a man cannot operate that way. McAllister stated that
we are not going to give Mr. Schuh an open permit for a blacktop
plant. Mr. Schuh asked about Fischer's permit. Peloquin thought
blacktop plants were part of the permit. If they are included, he
could see why Mr. Schuh questioned why he was restricted to one
particular project. A resident stated that if the blacktop plant
is sitting there, you would think he could use the plant for all
jobs. (Ehret arrived at 7:55 PM). Mr. Schuh stated that there
was no mention of a blacktop plant in Fischer's permit. Ehret
stated that if it is the opinion of the City Council that blacktop
plants are part of the Mining Permit, then he does not see where
there is a problem. (Schwab arrived at 8:00 PM). The public
hearing was closed at 8:07 PM.
The regular Planning Commission meeting was called to order by
Chairman Ehret at 8:08 PM.
PRESENT: Ehret, Peloquin, Peltier, Gillen, and McAllister
Bill Schwab and Larry Irsfeld were also present.
ABSENT: Greger and Rosenquist
Motion made by Peltier, seconded by Peloquin, to approve the minutes
of September 14, 1977, after the following changes are made:

Mr. Gillen abstained from voting.

Richard Schuh — Amended Mining Permit
Mr. Schuh presented a revised map of the area to be mined. Ehret
stated that the map indicated the contour lines showed were right
from the property line. The set back should be 501. He stated
that a corrected copy of the map showing 50' set back should be on
file. Schwab said that if a written consent from the property owners
to the south and west is filed with the clerk stating that there
was no objection, that this would be acceptable also. He also
stated that the mining has to be 50' from the street. Mr. Schwab
did not feel that a Mining Permit automatically allowed for a
blacktop plant.
McAllister made motion, -to table the Mr. Schuh request until the
next regular meeting, October 12, 1977, and that the secretary be
directed to contact the City Attorney, asking him to give his inter—
pretation as to whether a blacktop plant is automatically covered
in a Mining Permit as defined in Chapter 170 of the Hugo Code.
There was no second to this motion. Motion failed.
Motion made by Peloquin, seconded by Peltier, that the Planning
Commission recommend approval of the request by Mr. Schuh to
allow additional mining, subjectto the following:

VOTING NO: McAllister
ABSTAINED: Gillen
Motion carried.
Motion made by Peloquin, seconded by Peltier, to recommend to amend
the Special Use Permit for Lavina Duraine, to coincide with the
amended Mining Permit for Richard Schuh, subject to the following:
1. Extend Special Use Permit until June 1, 1978.
2. Post bond in the amount of $5,000.00
3. The bituminous hot mix plant should be allowed.
4. All existing trees and natural vegetation bordering the pit
area shall be left undisturbed.
5. All top soil in the pit area shall be stockpiled, and at
the time the operation is completed, the top soil shall be
replaced and seeded to grass cover.
6. Sewer facilities shall be of the portable, chemical holding
tank type.

7. It is the responsibility of the Special Use Permit holder to
furnish a correct updated contour map to the City Engineer
by October 3, 1977.

Motion carried.

Robert Ricci - Variance and Special Use Permit
Mr. Ricci was present stating that he would like to purchase Paul's
Pizza ( property and building). His plan is to add on to the present
structure to the north (24' x 401). The variance is going to be
needed for the eastern property line. Mr. Ricci presented a letter
signed by the adjoining property owners (Edward Waugh, Roy Shoberg,
and Richard Seifert) stating they had no objection to Mr. Ricci
adding on the present building within ten feet (101) of the rear
property line. Mr. Ricci presented a plan for the exterior changes
and the interior plan. Ehret asked if it would be possible to
delete 2 feet from the rear yard extension making the addition
24' x 38' keeping him 5P from the property line. Ricci stated that
there might be a problem with the rear door.
McAllister made motion, seconded by Gillen, that the Planning Commission
recommend approval of the variance request made by Robert Ricci, to
build no closer than 5' from the eastern property line.
VOTING FOR: Peloquin, Peltier, Gillen, McAllister, and Ehret
Motion Carried.
Mr. Ricci stated that he will remove the northernmost driveway on
Highway 61, making one entrance on Highway 61, and one on 141st Street.
Ehret stated that a rough draft of what the front of the building is
going to look like should be on file. (Gillen left meeting at 9:50 PM).
McAllister said he felt Mr. Ricci would do a nice job, because of
other things he has done in the community.
Motion made by McAllister, seconded by Peloquin, that the Planning
Commission recommend approval of the Special Use Permit for Robert
Ricci to expand the existing restaurant, subject to the following:
1. The building be constructed according to site plan as presented
to the Planning Commission.
2. Mr. Ricci is to blacktop the area to be used as driveway and
parking lot no later than September 30, 1978.

3. The exterior design of the building be subject to city approval.
4. Show proof of ownership to City Council according to the esta—
blished precedence.
VOTING FOR: Peloquin, Peltier, McAllister, and Ehret
Motion carried.
Richard Busse — Continuation of Ingersoll Avenue thru his property
Mr. Busse prebented the Planning Commission an appraisal that he
had done on his property regarding the extension of Ingersoll.
Ehret suggested that the file be turned over to the City Council
for their review. The record is to show that Mr. Busse appeared
before the Planning Commission with an appraisal of his property
with the proposal that the City of Hugo purchase approximately
five acres, and we hereby refer the matter to the City Council
for any action they wish to take.
Shepherd of the Fields Church — cancelled
Motion made by Peloquin, seconded by Peltier, to table the matter
until October 12, 1977. Commission members to review and study.
Washington County Planning to submit a report relating to the
above for that meeting.

McAllister made motion, seconded by Peltier, to table the review
of multiple family uses until October 12, 1977.
All aye. Motion carried.
Peloquin stated that he had spoken to George Indykiewicz, and he
would like an inspection of his pit by October 15, 1977 so the
Planning Commission can act on his permit October 26, 1977. City
Engineer Kuusisto is to go out and inspect and submit a report for
our files.
McAllister went on record stating that he feels the agendas have
been too full to address the problems that have come before the
Planning Commission, and recommends that the Chair give serious
consideration to call special meetings to address those problems.

McAllister made motion, seconded by Ehret, to adjourn the meeting
at 10:45 PM.
