Marvin Babcock RE: Public Hearing - Special Use Permit RE: Temporary Amended Special Use Permit RE: Special Use Permit RE: Amended Special Use Permit RE: Special Use Permit RE: Land Division MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION September 14, 1977 The public hearing regarding the request for a Special Use Permit by Thomas Frampton was called to order by acting Chairperson Peltier at 7:36 PM. Ehret arrived a few minutes later. PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Washington County Planner, Bill Schwab, was also present. ABSENT: Rosenquist Published notice of public hearing was read. Mr. Frampton was present and stated that he would like to build a greenhouse 80' x 40' and a storage shed 80' x 161. He presented a plan for what he proposes to do on the property. He stated that his private driveway would be on Ingersoll Avenue, and the business road would be off of County Road 10. Mr. Richard Wlaschin, 12140 Illies Avenue North, a neighboring resi- dent, was present stating that he approved of the nursery. He would rather see a nursery there than alot of houses. Mr. Frampton stated that he intends to install a 6" well for irrigation purposes, just to start the plants out. Ehret stated that he would need a permit from DNR for this well. Peloquin asked when he intended to build a house, and Frampton replied that he would like to build in three years. McAllister inquired as to whether Frampton had investigated the cost factor in constructing the greenhouses of fiberglass. Frampton replied that fiberglass would cost approximately five times more than poly. He stated that he would probably have to install poly over the fiber- glass for insulating purposes. The public hearing was closed at 8:03 PM. The regular meeting was called to order at 8:04 PM by Ehret. PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Bill Schwab and Larry Irsfeld, City Council, were also present. ABSENT: Rosenquist Motion made by Peloquin, seconded by Peltier, to approve the minutes of August 24, 1977 after the following changes have been made: Page 1 (line 3) - Item 5 would not include group gatherings not associated with the club. Page 1 (line 10) - definition of a lodge or club included members & guests All aye. Motion carried. Thomas Frampton - Special Use Permit Mr. Frampton will eventually be constructing six buildings. Mr. Schwab stated that he was concerned with the poly covering. Seeing that the greenhouses would be visible from County Road 10, a more permanent covering should be used rather than poly. McAllister made motion, seconded by Gillen, that the Planning Commission recommend that the request of Thomas Frampton for a Special Use Permit to build four greenhouse type structures, be approved subject to the following: 1. The 1st greenhouse structure be built of an aluminum frame material, concrete footings, and that the building be covered entirely with rigid type material. 2. The 2nd greenhouse may be of a poly type material. 3. At no time subsequent to the construction of the lst green- house, will there be more than one greenhouse constructed of poly type material. 4. This does not prohibit using poly type material over rigid material for an insulation value. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret Motion carried. Gillen made motion, seconded by McAllister, that we allow construction of a lath house, 50' x 501. bath house to be of a wood construction and the lumber should be of a quality grade and not be saw log lumber that has not been dried. VOTING FOR: Gillen, McAllister, and Ehret ABSTAINED: Peloquin, Peltier, and Greger Motion carried. Peloquin made motion, seconded by Greger, that Mr. Frampton be allowed to build a machine shed 80' x 161. VOTING FOR: Peloquin, Peliter, Greger, Gillen, McAllister, and Ehret Motion Carried. Peloquin made motion, seconded by McAllister, that the Planning Commission recommend approval of the Special Use Permit as requested by Thomas Frampton, according to his request, and subject to the following: 1. 6" well will be subject to a DNR permit. 2. No commercial traffic on Ingersoll Avenue. 3. Restrict business to the sale of growing products. 4. Proof of ownership. Hugo Planning Commission September 14, 1977 Page 3 of 5 Frampton - cont. 5. Site plan to be furnished. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret Motion carried. White Bear Rod & Gun Club - Amended Special Use Permit A short recess was taken to allow the member to brief themselves on the report as submitted by City Attorney Johnson. The gun club was represented by Ray Asmus. The attorney determined that the Supreme Court ruling did not cover the use of the clubhouse, as requested. Ehret stated that our zoning ordinance does not include commercial - recreation in the Agriculture district. Ehret suggested that the request be tabled until the Commission has acted on the directive given them by the City Coucil to research a commercial/recreation area in the Agriculture district. Mr. Asmus agreed with the request. Mr. Schwab stated that a member of the club could use the facility, butncould not be rented to someone other than a member. j Greger made motion, seconded by Gillen, to table the request of the White Bear Rod & Gun Club for an amended Special Use Permit until action has been taken by the Planning Commission to research commer- cial/recreation activities in the Agricultural district, as directed by the City Council on February 7, 1977. VOTING FOR: Peloquin, Greger, Gillen, McAllister, and Ehret VOTING NO: Peltier Motion carried. Shepherd of the Fields Church - Special Use Permit Mr. Lester Winters represented the church, and stated that they would like to construct a sign to identify the church. The sign would be 3' wide, 4�' high, with a total height of 81. The sign would be constructed on the west side of Highway 61, approximately 42' from the center line (between highway and railroad. Schwab stated that the ordinance reads that the sign should be 40' from the right-of-way. Motion made by Peloquin, seconded by Peltier, that the Planning Commission recommend approval of a Special Use Permit, with a variance, under Section 266-109 to Shepherd of the Fields Church to erect a sign on the requested location, provided they eliminate the bottom two lines of proposed sign. Sign to include name of church, hours of services, Little Lamb's Preschool, and location. The reason for the variance is that there is no room between the highway right-of-way and the railroad to allow for the required set back as per the ordinance. The variance to allow the sign to be positioned less than 40' from the highway right-of-way. Part of the reason for the variance is that the sign is of a non-commercial venture. Mrs. Eugenia Culp - Amended Special Use Permit Ehret determined that there was no need for an application, and Mrs. Culp's money should be reimbursed to her. Permit goes with the property. Motion made by Ehret, seconded by Greger, that the fee of $25.00 be refunded to Mrs. Eugenia Culp because the Special Use Permit goes with the property. All aye. Motion carried. Lavin Duraine - Special Use Permit The Spe'ial Use Permit for Mrs. Duraine had expired on June 1, 19779 but had been renewed because of over sight. Bond of $5,000 has been filed with permit. Peloquin made motion, seconded by Peltier, that the Planning Commission recommend to extend the Special Use Permit for Lavina Duraine until June 1, 1978. The bituminous hot mix plant should be allowed for the duration of Project 77-04-018. Condition #1 should also state that permit allow for additional excavation. The rest of conditions stand as is. VOTING FOR: �eloquin, Peltier, Greger, , McAllister, and Ehret Motion carried. Motion made by Peloquin, seconded by Pel ter, to include Robert Brunfelt and John Olinger on the agenda. All aye. Motion carried. Robert Brunfelt Mr. Brunfelt was present asking for information regarding some property he is interested in purchasing. He wants to purchase a total of 85 acres. He would like to have the house and 10 acres on one deed, and the balance of land on contract for deed. 80 acres of land lies in the Conservancy district and 5 acres in Agriculture. Gillen felt that the Commission should not consider the request because of the zoning. Greger suggested that he should take pert tests and prove there is more than one buildable site and ask for rezoning. Ehret summarized stating that the only way he could do it would be with a 20 acre parcel on a separate deed. The majority of the property in question is in the Conservancy district. Hugo Planning Commission September 14, 1977 Page 5 of 5 John Olinger Mr. Olinger is considering dividing a piece of property in order to build a home for his sister. The land is in the SFU zoning district. Ehret stated that there would adeqaate frontage for both lots, and Schwab interjected that there really is not 80' to build on because of the angle. Lot is only 62' wide. Ehret suggested that Mr. Olinger apply for a minor subdivision, and provide proof of ownership and a certificate of survey. Schwab added that a sketch of what he is going to do would be appropriate. Mr. Gillen would like to go on record as being the design engineer for the screening on both junkyards in Hugo. Mr. Schwab presented Mr. Dan Koehler to the Commission. Mr. Koehler has been hired to act as a consultant for the Commission. He has worked with Mr. Schwab in Washington County for two years, and is a registered landscape architect. He will work at City Hall two days a month, three hours per day.
