Richard Schuh RE: Rezoning RE: Temporary Special Use Permit RE: Amended Mining Permit and amended Special Use Permit AGENDA HUGO PLANNING COMMISSION August 24, 1977 The meeting was called to order by Chairman Ehret at 8:10 PM. PRESENT: Ehret, Peloquin, Peltier, Rosenquist, and McAllister. Greger arrived at 8:22 PM. ABSENT: Gillen James Br6vig - Rezoning McAllister stated that he has been discussing the matter with Brevig and there is still some litigation regarding the dike problem. Mr. Brevig would like the rezoning tabled until the legal problems are re- solved, because he had been advised that the property would not be sellable until then. Ehret stated that the Commission would have to take some action or Brevig would have to withdraw his application for action at some later date. He was not sure if legal litigation would take precedence over the 60 day time limit. Brevig stated that after a ruling was made, he would be in a better position to have a professional soil test taken, if required. Motion made by McAllister, seconded by Peltier, to table the Brevig rezoning application until January, 1978, at his request, pending out- come of litigation on said property, and that City Attorney give his opinion to the Planning Commission as to whether this tabling is acceptable. VOTING FOR: Ehret, Peloquin, Peliter, Rosenquist, and McAllister ABSTAINED: Greger Motion Carried. White Bear Rod and Gun Club - Temporary amended Special Use Permit The gun club, represented by Jerry Perron, is requesting to use.the clubhouse for rental, such as weddings, p ties, etc. Peltier stated that if the Special Use Permit granted to the gun club is still active, Item 5 would not include group gatherings Perron stated that the building is just molding away, and is asking to consider using just as a temporary thing. Ehret asked Perron what he considered temporary, and Perron stated that that in one year the club would know one way or another where they stand as far as the gun club is concerned. Perron considered the Supreme Court ruling as opened ended. Peltier stated that the definition of a lodgeAincluded members and guests, and did not i nclude commercial/recreation. osenquist stated that at this point we are not sure if it is a gun club or not, and do not know what ground we are on. Ehret suggested that a letter be sent to the City Attorney and the County Planner, asking them for their written opinion as to: 1. Can we consider a temporary amended Special Use Permit? 2. Can we consider it for the use in question? 3. Point out that what the club is seeking is a temporary amend- ment to the Special Use Permit. 4. Ask if there is in fact a Special Use Permit in existence. Their responses should be received prior to the meeting of Sept. 14, 1977. Hugo Planning Commission August 24, 1977 Page 2 of 4 The letter should also state that the best the Commission can under- stand, the zoning law does not permit the request in question, but consider that the request is made as a result of the current condition of the gun club. Item 5 of the existing Special Use Permit should be reviewed. Motion made by Ehret, seconded by Peltier, to have the secretary send letters to City Attorney and County Planner to ask their opinion re- garding the request of the White Bear Rod and Gun Club. VOTING FOR: Ehret, Peloquin, Peltier, Rosenquist, and McAllister VOTING AGAINST: Greger Motion Carried. Richard Schuh - Amended Mining Permit Motion made by Peltier, seconded by Peloquin, to add Richard Schuh to the agenda. All aye. Motion carried. Mr. Hiniker represented Mr. Schuh, stating their request to add a bituminous mixing plant to their mining permit. Mr. Schuh was a successful bidder, and awarded a contract for 32 miles of asphalt resurfacing. Mr. Hiniker stated that work was to commence on September 6, 1977, so they did have a time problem. Peloquin stated the mining permit included hot mix plants, and a public hearing would not be needed. Hiniker stated that they were asking for the following: 1. location of asphalt plant, 2. Haul permit to haul in crushed rock, 3. Additional haul route (152nd street, 7/10 of a mile) and, 4. The mining permit for additional materials on site. Mr. Hiniker suggested that the City Engineer inspect the plans prior the City Council meeting of September 6, 1977. Rosenquist stated he did not feel a recommendation could be made without the engineer's report. Hiniker stated that Brainerd Blacktopping Company is res- ponsible for obtaining the PCA number. There will be 300 loads coming in, and 600 loads going out to do County Road 4. Ehret stated that the engineering report on the new haul routes was a major concern. Hiniker stated that they have always complied with what the engineer requested. Motion made by McAllister, seconded by Peloquin, that the Planning Commission recommend approval of (A) adding 152nd Street, from Irish to Jeffrey, as a haul road subject to the following: 1A. That the additional haul road be reviewed by the City Engineer and that his recommendation be followed, 2A. All current requirements for Irish Avenue be included on 152nd Street Hugo Planning Commission August 24, 1977 Pg 3 of 4 Schuh - cont. 3A. Recommend additional $15,000.00 irrevocable letter of credit from Richard Schuh to cover 152nd Street. Irrevocable letter of credit to expire upon completion of Washington County Project 77-0-418. B. Recommend approval of hauling of crushed rock for bituminous mix in sufficient quantity to cover Project 77-0-418. C. Approval of the bituminous mix plant subject to the following conditions: 1C. That the proposed bituminous mix plant conform to PCA requirements. 2C. That bituminous plant operator provide valid PCA number prior to City Council meeting of September 6, 1977. VOTING FOR: Ehret, Peloquin, Peltier, Greger, Rosenquist, and McAllister Motion Carried. Rosenquist made motion, seconded by Peloquin, that the Planning Commis- sion request the City Council and City Attorney to review Item 2 of the Mining Permit to see if it does or does not permit blacktop plant, or if the city ordinances will allow it. Request the City Council to approve the blacktop plant and negotiate conditions. The operator of the blacktop plant is not the applicant, but in fact, will be Brainerd Blacktopping Company. VOTING FOR: Ehret, Peloquin, Peltier, Greger, Rosenquist, and McAllister Motion Carried. Motion made by Ehret, seconded by Peloquin, to schedule a public hearing for September 28, 1977, at 7:30 PM, to amend the Mining Permit for Richard Schuh to allow additional mining. All aye. Minutes of August 10. 197 Motion made by Peloquin, seconded by Peltier, to approve the minutes of August 10, 1977, after the following changes are made: Page 1 line 4 - determine where they will be screening Page 1 line 5 - screening will be compatible with Horton's yard Page 1 line 13) - he will plant two rows of 5' pines Page 1 last paragraph) - Schwab stated that there should be no change in fencing Page 2 line 2 - Mr. Noack to allow to expand Page 2 line - No double decking Page 2 Fulbright) - Fulbright was the owner of the land Page 2 Granger) - Mr. Granger submitted an application of minor sub- division in Lena Granger's name.
