RE: Minor Subdivision .,► MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION August 10, 1977 The public hearing regarding the amended Special Use Permit re- quest of Len Noack was called to order at 7:31 PM by acting Chair- person Theodora Peltier. PRESENT: Peltier, Peloquin and McAllister. Gillen arrived at 7:35 PM, Rosenquist at 7:40 PM, and Greger at 7:50 PM. ABSENT: Ehret Mrs. Peltier read the notice as published in the Forest Lake Times. Mr. Noack presented the plans for his requested enlargement. Noack stated that the State Department of Transportation will be out in a couple of weeks to determine where they will`��screening. Gillen stated that screening willo-compatible with Horton's yard. Ivan Hodges, 6169 165th Street, wanted to know if the fence would keep intruders out. Noack stated the fence met with Council approval and should eliminate that problem. Mr. Hodges felt that yard would devalue his property. Mrs. Darrell Jacobson, 6364 165th Street, was told her property was east of proposed yard. She felt the yard would not improve the area. Mr. Fakler, 799 11th Avenue, Forest Lake, was present stating that he was in favor of the request. Mr. Noack stated that he will planting 2 - 5 foot pines. A letter was pre- sented from Richard Dempich stating that they were opposed. The public hearing was closed at 7:55 PM. The regular meeting was called to order at 8:05 PM., by Peltier. PRESENT: Peltier, Peloquin, Greger, Rosenquist, Gillen, and McAllister Bill Schwab arrived at 8:10 PM. ABSENT: Ehret Motion made by Peloquin, seconded by Greger, to approve the minutes of July 27, 1977 as presented. VOTING FOR: Peltier, Peloqui, Greger, Rosenquist, and McAllister VOTING NO: Gillen Len Noack - Amended Special Use Permit Mr. Noack has a request to enlarge his auto dismantling yard, asking for extra ground. Bill Schwab stated that there should be a change in any fencing, and a change in the description of the yard. Mrs. Noack presented a legal of the land they are adding to the yard. Schwab stated that there has never been any problem with the Noack operation. Hugo Planning Commission August 10, 1977 Page 2 of 4 Len Noack - cont. Motion made by Peloquin, seconded by Gillen, that Planning Commission recommend approval of the request of Mr. Noack to allow -% expand his auto dismantling yard by the distance of 200 feet south. The entire southern boundary of the proposed expanded lot east of the pro- posed highway screen shall be fenced. The fence to be chain linked equal to the one he already has, and that two rows of trees be planted for screening, at least 3 feet tall. No dow--4- , decking be allowed whatsoever in the new addition. VOTING FOR: Peltier, Peloquin, Gillen, and Mcallister ABSTAINED: Greger and Rosenquist MOTION CARRIED Fred Fulbriaht - Rezoning The City Council had directed that the Pugh property was added to the rezoning request erroneously, a more accurate legal of the property to be rezoned was needed,and proof of ownership provided before any action could be taken. Mr. Simonet provided McAllister with the necessary legal description of the land to be rezoned, and a letter stating that Mr. Fulbright was the of the land to be rezoned. Only the property in the back is to be rezoned - none in the front. Motion made by McAllister, seconded by Gillen, that the Planning Commission recommend approval of Fred Fulbright's rezoning request and let the record show that the information requested by the City Council and city attorney has been obtained. The exact legal des- cription of the property to be rezoned is included, and the statement requested by the city attorney relative to proof of ownership is also included. The portion to be rezoned is outlined in red in "Exhibit 3". VOTING FOR: Pelter, Peloquin, Greger, Rosenquist, Gillen, and McAllister Motion carried. North Oaks Kenned - Amended Special Use Permit There was no representative at the meeting. Ronald Granger - Minor Subdivision c� ryM� Mr..Granger.bubmitted An application for minor subdivision, One of the parcels will be 77J feet wide which is below city code. Mr. Granger presented a copy of the survey of the property to be divided. Bill Schwab stated when the Planning Commission approves the subdi- vision, they will also be approving the variance. They are making it a lot of record. Hugo Planning Commission August 10, 1977 Page 3 of 4 Ronald Granger - cont, Motion made by Peloquin, seconded by Gillen, that the Planning Commission recommend approval of Lena Granger's request for minor subdivision, and be placed on record as a legal document. Mr. Granger was instructed to present proof of ownership at the City Council meeting. VOTING FOR: Peltier, Peloquin, Greger, Rosenquist, Gillen, and McAllister Motion carried. Grace Development - Minor Subdivision Mr. Harry Weaver presented the Commission with records of log borings and perc tests on Lots 1, 2, and 3. Mr. Kuusisto, City Engineer, also inspected the site on August 13, 1977, and submitted a written report. Mr. Kuusisto had suggested possible alternatives to a standard sewer system, but Mr. Schwab stated they would all involve a certain risk. A lengthy discussion ensued regarding the numerous engineering reports for the proposed subdivision. Gillen stated that he can find nothing to indicate that a system cannot work under the items dis- cussed by himself and Mr. Kuusisto. If you went back to Mr. Kuusisto's report, they are well within the limits. He stated that Kuusisto has given 99% of the same answers he had given to the Commission. McAllister stated that in all three engineering reports, he could not find a positive statement that a system could work. He went on record as stating the city does not accept that portion of the Braun Engineering Report stating that they city should accept responsibility of the system. Mr. Schwab could see only one solution and that would be'to split the three lofts into two, and fill the Lot 2 area. %2 t. -�� Cti � /b � � Motion made y i eltler, se oided by Greger;torecommend approval of the minor subdivision for Grace Development, subject to the following: 1. Install two monitoring wells for Lot 1. Let fill stand for one year. 2. Build sewer on Lot 2 for Lot 1 on a permanent easement. 3. Permanent easement to be released only when a standard system could be installed on Lot 1, after the fill has set for one year, or if municipal sanitary sewer is available. 4. Easement to be drawn up by the buyer and seller, subject to City Attorney's approval. 5. Monitor wells for at least one year. The City Engineer should specify the time for the monitoring, location of the well, and the amount of fill. 6. The Building Inspector will monitor the wells. 7. Fill should also be placed on Lots 2 and 3 at this time. Peloquin recommended obtaining a letter of credit, but Commission felt it was unnecessary. VOTING FOR: Peltier, Peloquin, Greger, Rosenquist, and McAllister VOTING AGAINST: Gillen (standing on his judgment of the situation) Motion carried. North Oaks Kennel' Peloquin made motion, seconded by Gillen, to cancel the public hearing for North Oaks Kennel for an amended Special Use Permit, as requested information not provided. All aye. Motion carried. Rosenquist made motion, seconded by McAllister, that the Planning Commission request from the City Council, to hire a Washington County Planner to come two days a month, for approximately 3 hours a day, at $10.00/hour on a trial basis until end of year, 1977.
