Joe Massa AGENDA HUGO PLANNING COMMISSION July 27, 1977 RE: 1.1 acre RE: Amended Special Use Permit RE: Minor Subdivision RE: Minor Subdivision RE: Special Use Permit RE: Rezoning RE: Subdivision MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION July 27, 1977 The meeting was called to order at 8:05 PM by Chairman Ehret. PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Larry Irsfeld, Hugo City Council, and Bill Schwab, Washington County Planner, were also present. ABSENT: Rosenquist Motion made by Peltier, seconded by Peloquin, to approve the minutes of July 13, 1977, after the following changes are made: Page 3 Grace Development, line 4) — were in fact Page 3 Grace Development, last paragraph)— eliminate "Gillen was satisfied with the present soil tests". Should read, "Gillen dis— agreed with the tabling of the motion". All aye. Motion carried. Mike Pederson — 1.1 acre Peltier made motion, seconded by Greger, to table until Mr. Pederson arrives. All aye. Motion carried. North Oaks Kennel — Amended Special Use Permit Wayne Gruis, part owner in North Kennels, was present at the meeting and stated that the Afton Animal Adoption Center is interested in leasing from them. Ehret inquired as to the present capacity, and Gruis responded 100 dogs at times. They would like to construct a 30' x 150' concrete building to house the additional animals from the Adoption Center. Mr. Gruis thought they had approximately 140 animals at the center to be relocated. The center is financed through membership contribution and Washington County. The new building would be constructed to the west of the present building. Mr. Ehret stated that the Commission would like to talk with the potential new people in regard to their plans and what they are going to do. Their lease will run for five years, if approved. Motion made by Peloquin, seconded by Peltier, to schedule a Public Hearing for August 24, 1977, at 7:00 P.M. to amend the Special Use Permit for North Oaks Kennel, and that all proper information be provided for reviewal by the Planning Commission. Information to be provided for meeting of August 10, 1977. VOTING FOR: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Motion carried. Hugo Planning Commission July 27, 1977 Page 2 of 5 Wayne Bjorum - Minor Subdivision Previous city records were checked out, and it was determined that the City Council had approved the subdivision on October 1, 1973. Therefore, Parcel D is acceptable to sell. Motion made by Peltier, seconded by Peloquin, that the records show the subdivision plat of Wayne and Pamela Bjorum dated September 17, 1973, was approved by the City Council on October 1, 1973, therefore, it is the opinion of the Planning Commission that Parcel D can be sold as is. VOTING FOR: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Motion Carried. Grace Development - Minor Subdivision Washington County Planner, Bill Schwab, presented a written report regarding borings done on Lot 1 of the subdivision. Roger Johnson, Soil Scientist, and Thomas Anderson, Building Inspector II, found that a mottled soil condition was first observed varied from approxi- mately 27" to 4' below the existing ground surface. Mr. Tschida was present when borings were being done, and he indicated he had done some additional work and said he had found mottling at 5' on Lots 2 and 3. It was Mr. Schwab's determination that Lot 1 is not a buildable site, and that Lots 1, 2, and 3 should be combined into one lot. Mr. Peloquin stated that he has always been opposed to these three lots for private septic system. Gillen was opposed to terminology of high water table. Mottling could be caused from many years ago. He described his findings, and would not acknowledge a seasonal high water table in that area. Gillen made motion to recommend approval of Grace Development's re- quest for Minor Subdivision on Lot 1 only, and hold on Lots 2 and 3 until final perc tests are provided by Grace Development, and it we do not have all the information required, should have some regulation that matter can be brought back just so many times in one year. Motion failed for lack of second. Gillen made motion, seconded by Peltier, to recommend approval of Grace Development's request for Minor Subdivision on Lot 1 only and hold on Lots 2 and 3 until perc test and soil borings are provided by Grace Development. VOTING FOR: Ehret, Peltier, and Gillen VOTING AGAINST: Peloquin, Greger, and McAllister Motion failed for lack of majority Hugo Planning Commission July 27, 1977 Page 3 of 5 Grace Development - cont. Gillen made motion, seconded by Peltier, that we recommend to the City Council that in the future, should information be requested by the Planning Commission of an applicant, and it is not provided, after two presentations subsequent to the first to the Planning Commission, the applicant be denied further action for a minumum of one year. VOTING FOR: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Motion carried. Gillen made motion to recommend approval of Grace Development's re- quest for Minor Subdivision as presented. Gillen withdrew motion. Gillen made motion, seconded by Greger, that Mr. Gillen meet with City Engineer, Howard Kuusisto, at the site for additional input for presentation at the meeting of August 10, 1977. VOTING FOR: Ehret, Peltier, Greger, Gillen, and McAllister VOTING AGAINST: Peloquin Motion carried. Secretary was instructed to write letter to Mr. Kuusisto asking that he be present at the meeting of August 10, 1977, to discuss the re- quest as made by Grace Development. Recessed 9:35 PM Reconvened 9:46 PM Thomas Frampton -_Special Use Permit Mr. Frampton would like to purchase 30 acres of property for the purpose of selling nursery stock. band is presently owned by Rey- nold Arcand. Access to the proposed greenhouses would be via County Road 10, and would constructed of aluminum. At this point, the green- house is a long range roject. Would build a machine shed as soon as possible (16' x 601�. Mr. Frampton stated that they would hope to be building a home within three years. Motion made by Peloquin, seconded by Greger, to schedule a Public Hearing for September 14, 1977, at 7:30 P.M., to consider the re- quest of Thomas Frampton for a Special Use Permit to sell nursery stock. Mr. Frampton must provide (1) proof of ownership, (2) site plan with locations of the house, machine shed, and greenhouse, and (3) provide names of property owners within 300' of the property in question. All aye. Motion carried. Hugo Planning Commission July 27, 1977 Page 4of5 Motion made by Peloquin, seconded by Gillen, to consider the Joe Massa matter prior to Fred Fulbright. All aye. Motion carried. Joe Massa — Subdivision Mr. Massa was unable to provide a legal description for his property because, as yet, he has not had it surveyed. Ehret stated that Mr. Johnson, City Attorney, felt that because the property of Mr. Massa was not connected to any other property owned by him, that the re— quest be allowed, provided a legal description is provided by Mr. Massa. Mr. Massa said that Mr. Johnson advised him to go before the Planning Commission to get their OK before he got the land surveyed. Schwab stated that if Mr. Massa provided a certificate of survey, the Commission could recommend approval. Motion made by Peloquin to recommend approval of the site plan for Joe Massa subject to a proper and adequate legal description sub— mitted with application for the City Council's consideration, and that the City Council set the fee involved for said request. Proof of buildable lot to be provided by Mr. Massa. Motion died for lack of second. Peloquin made motion, seconded by Gillen, to recommend approval of transfer of ownership provided a certificate of survey is submitted, and fee to be set by City Council. McAllister felt the request was not ready to be passed to the City Council until a certificate of survey is, in fact, on file at City Hall. Peloquin withdrew his motion. Ehret suggested that Mr. Massa provide the city with a copy of his perc test, and when he has a certificate of survey, place his name of the agenda. Fred Fulbright — Rezonin The Fulbright rezoning request was sent back to the Planning Commission so that a legal description of the property to be rezoned could be obtained. Copies of deeds were providedby Bruce Charpentier, but they did not indicate a clear legal description of Mr. Fulbright's property. Mr. Fulbright has stated that he would like his entire piece of property rezoned from RB to SFE. Motion made by Peltier, seconded by Peloquin, to table the Fred Fulbright rezoning request from RB to SFE pending accurate legal description for the property to be rezoned. All aye. Motion carried. Hugo Planning Commission July 27, 1977 Page 5 of 5 Motion made by Greger, seconded by McAllister, to add the Cyril LaCasse variance request to the agenda. All aye. Motion carried. Noel Schearer represented LaCasse. Mr. LaCasse would like to divide a 37 acre tract of land, zoned Conservancy, into two 18 acre parcels. The perc tests, as requested by the Commission, were provided. Tom Crever has already reviewed the perc test, and Bill Schwab stated that they looked alright. Motion made by Peloquin, seconded by Peltier, to recommend approval of the Cyril LaCasse variance request for division of 37 acres into two 18 acre (approximate) parcels zoned Conservancy, as he has shown proof of two buildable sites as requested by the Planning Commission on February 9, 1977. VOTING FOR: Ehret, Peloquin, Peltier, and McAllister ABSTAINED: Greger and Gillen Motion carried. Motion made by McAllister, seconded by Peloquin, to adjourn the meeting at 11:35 P.M. All aye.
