Grace Development RE: Public Hearing - Rezoning RE: Public Hearing - Special Use Permit RE: Jameson Cabins RE: Road Easement RE: Minor Subdivision RE: Minor Subdivision MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION July 139 1977 The public hearing to consider the rezoning request of Fred Fulbright was opened at 7:04 P.M. PRESENT: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister ABSENT: Rosenquist Mr. Fulbright requested the rezoning of approximately 14 acres from RB to SFE. Greg Carlson, 13753 Forest Blvd, was present inquiring as to whether his property might also be considered in the rezoning request. It was determined that Mr. Carlson's property is already zoned SFE. There were no other comments from adjoining property owners. The public hearing was closed at 7:15 P.M. Charles Mussehl - Special Use Permit The public hearing was opened at 7:31 PM. Mr. Mussehl presented a copy of his lease with Mr. Anthony Golat. Mr. T.J. Marier, 5566 - 145th Street, was present stating his opposition for the request of a Special Use Permit made by Mr. Mussehl. Mr. Marier felt that the operation would be a nuisance, and would be located between two residences. He also stated that he was concerned with the rubbish associated with the business, and the traffic that would result. Phil Kamman, 5490 145th Street, was present and stated that he was concerned with the traffic, and felt that the location was bad, because it was mainly a residential area. Mr. Mussehl thought that the guidelines he had set down were reasonable (closing at 10:00 PM). He would make sure there were containers available to take care of the refuse. Mr. Mussehl did not feel that Hugo had problems with their teenagers. A letter of opposition was received from Mrs. Morrisette, McAllister asked if Mr. Musshel had ever been arrested. Mr. Mussehl stated that he has been arrested five times, but has never been convicted of a felony. Mr. Mussehl is lanning to do some remodeling (plumbing, painting, and carpeting, at an estimated cost of $1200.00. He said he would also replace the brick on the outside, if needed. The public hearing was closed at 7:55 P.M. The regular Planning Commission meeting was called to order at 8:04 PM, by Chairman Ehret. PRESENT: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister Bill Schwab arrived at 8:20 P.M. ABSENT: Rosenquint Motion made by Peltier, seconded by Peloquin, to approve the minutes of June 22, 1977, after the following changes have been made: Page 1 last paragraph) - Mr. Brevig is t_present a perc test Page 3 line one) - Mr. Massa would like to sell property Page 3 line three)=Laboratory Laboratory Page 2 Mike Pederson, line 5) - It is not on a separate deed All aye. Motion carried. Hugo Planning Commission July 139 1977 Page 2 of 3 Fred Fulbright - Rezoning Peloquin asked Fulbright if he would mind just rezoning the land in the back, and leave the front section zoned RB. Mr. Fulbright said he would not have problem with that. Motion made by McAllister, seconded by Peltier, that the Planning Commission recommend that the request of Mr. Fred Fulbright for rezoning from RB to SFE be granted, and to include the property owned by Mr. Pugh. Mr. Pugh was present at the meeting and agreed with the re- commendation. The property owned by Mr. Pugh is surrounded by the property of Mr. Fulbright, and, therefore, it would be a practical matter to rezone it all. VOTING FOR: Ehret, Peltier, Greger, and McAllister VOTING AGAINST: Peloquin and Gillen Motion Carried. Charles Mussehl - Special Use Permit Motion made by McAllister, seconded by Gillen, that the Planning Commission recommend denial of the request of Mr. Charles Mussehl for a Special Use Permit, to install a recreation room in the old bank building, for the following: 1. Lack of suitable parking, either owned or public, 2. Condition of the building, 3. Opposition of local residents, and 4. Traffic problems. VOTING FOR: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister Motion Carried. George Crockett - Jameson Cabins Mr. Crockett was present with remodeling plans for his presnet resi- dence. He had discussed the plan with Mr. Schwab, and he laid out a proper, new sewer system. Mr. Crockett plans on extending his home approximately 15' to the west, along the same foundation. This line is less than 101 from the property line, and he will need a variance for side yard setback. Greger felt that the adjoining property owners should be notified of variance request. Motion made by McAllister, seconded by Peloquin, that the Planning Commission recommend that the request for variance by George Crockett be granted, due to insufficient side yard setback for an addition to the existing building as per plans submitted with request. Let it be noted that this action was taken without prior notification to neighboring land owners, and that they be allowed to voice an opinion, if any. Mr. Greger will personally notify affected land owners. VOTING FOR: Ehret, Peliter, Peloquin, Gillen, and McAllister ABSTAINED: Greger Motion Carried. Hugo Planning Commission July 13, 1977 Page 3 of 3 Bruce Charpentier - Road Easement Cancelled. Wayne Biorum - Minor Subdivision Mr. Bjorum would like to sell Parcel D of subdivision, on which their present home is standing. The subdivision is dated 1973, land is zoned Conservancy, and there is not a separate deed on Parcel D. Mr. Schwab stated that if in fact the City did take action on this subdivi- sion to sell A - D, it would be suitable to grant a minor subdivision. If it was not approved, they will have to go through a rezoning. The City Council minutes of 1973 are to be searched, and the matter placed on the next agenda of July 27, 1977. Grace Development - Minor Subdivision Grace Development is requesting the division of 3 lots, 1 acre each, fronting on 8A with the easterly lot cornering on Goodview. Mr. Schwab had his representative check the soil tests, and he found soil mottling at 221 feet. If the findings he came up with, were in facit correct, Mr. Schwab stated that these lots should not be built on with onsite sewer systems. Tom Crever stated that the copy of soil tests he had, indicated no problem. Mr. Schwab stated that because of the diversity of opinion, the matter should be tabled until Mr. Zeibell analyzes these three lots. Braun Engineering had done testing, and they stated that the lot in question should be filled over the drainage field. Motion made by McAllister, seconded by Peltier, to table the matter until the next meeting, July 27, 1977, and that soil borings be checked by Washington County and Soil Conservancy people. the tabling of the motion. disagreed with VOTING FOR: Ehret, Peltier, Peloquin, Greger, and McAllister VOTING AGAINST: Gillen Motion Carried.
