Joe Massa RE: Rezoning RE: Extension of time RE: 1.1 acre RE: Mining Permit RE: Land Division MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION June 22, 1977 The meeting was called to order by Chairman Ehret at 8:01 P.M. PRESENT: Ehret, Peltier, Peloquin, Gillen, and McAllister City Council representative, Larry Irsfeld, was also present. ABSENT: Greger and Rosenquist Motion made by Peloquin, seconded by Peliter, to approve the minutes of June 8, 1977, after the following change is made: Page 4 (Richard Schuh) to recommend to renew the Mining Permit All aye. Motion carried. Bruce Charpentier - Rezoning The Charpentiers, Ed Waugh, and Fred Fulbright were present to try and resolve the problem of the 60' easement needed to enable the Charpentiers to build a home. Mr. Waugh's main concern was who was going to be responsible to pay for the assessments to blacktop -the road and install city water. Whoever developed that land first, it was thought, would be responsible for the blacktopping, unless a mutual agreement between the land owners could be met. Mr. Waugh felt that he could not be reimbursed substantially enough when he sold the lots to cover the cost of the assessments. Mr. Ehret suggested that the matter of rezoning be handled at this time, and try and get some answers from Bill Schwab regarding the problem with the road. Motion made by Peloquin, seconded by Peltier, to schedule a public hearing for July 13, 1977, at 7:00 P.M., to consider the request of Mr. Fred Fulbright to rezone appoximately 15 acres from RB to SFE. Mr. Fulbright to supply names of property owners within 300' of the property in question. All aye. Motion carried. Jim Brevis - Extension of time for rezoning Mr. Brevig stated that the matter of the earthen dam located on his property is now scheduled for trial in Washington County. It was Brevig's understanding that this problem had to be resolved before his application for rezoning could be acted on. Mr. Ehret stated that the dike problem was between Mr. Brevig and Mr. Vail and should have no bearing on his rezoning request. Mr. Brevig is*resent a copy of his perc test and soil borings before the public hearing is held•. At the time the perc test is taken, they should be flagged so they can be inspected by the Washington County. Hugo Planning Commission June 22, 1977 • Page 2 of 3 Brevis - cont. Motion made by Peltier, seconded by Peloquin, to table the rezoning request of Mr. Brevig for 60 days, commencing June 22, 1977. VOTING FOR: Ehret, Peltier, Peloquin, Gillen, and McAllister Motion carried. Mike Pederson - 1.1 acre Mr. Schwab contacted Larry Ehret said as it stands, there were two or three lots that were subdivided and deeded creatingthis 1.1 acres of isolated land from the rest of the 40 acres. These additional .lots have been recorded which allows this 1.1 acres to appear. It is,&n a separate deed, but it is isolated. It is the opinion of Mr�. Schwab that if Mr. Pederson will provide the city with a detailed site plan, location of the house, set back from the road, and the required 75' set back from the lake for a house and dual sewer system, along with a perc test and soil borings, he should be able to get a building permit. Mr. Ehret stated that the 75' should be consi- dered from the high water mark. It was also noted that the Clark McDermaid road matter would have to be resolved before any action could be taken on the Pederson request. Mr. Ehret suggested that Mr. Pederson fill in the additional information of the request (build- ing on a substandard lot) so all information can be considered. Motion made by Peltier, seconded by Peloquin, to table the Mike Pederson variance request until July 13, 1977. All aye. Motion carried. Fischer Construction - Mining Permit Mr. Fischer presented a letter to the Commission stating his intent to set up a portable hot mix plant at their gravel pit, and to blacktop Irish Avenue with 2" wearing course from Washington County 8A into their pit. The plant will be a new drum type mixer meeting all standards of the PCA. Mr. Fischer stated the hours of operation would be 7:00 A.M. to 5:00 P.M. week days, and no working on Saturday and Sunday. Motion made by McAllister, seconded by Gillen, that the Planning Commission recommend that the Fischer Mining Permit be extended until June 30, 1978. It is the opinion of the Planning Commission that the operation of a hot inix plant is covered by the mining ordi- nance, and subject to PCA regulations. The haul roads are to be negotiated with the city engineer. VOTING FOR: Ehret, Peltier, Peloquin, Gillen, and McAllister Motion carried. , Hugo Planning Commission • June 220 1977 Page 3 of 3 Joe Massa - Land Division MrMassa would like to sell property located on the NE side of Bat Eagle Lake. He presented a perc test done by White Bear Soil Testing Laboratozy for the land in question. Mr. Ehret asked if the property was on a separate deed or part of the entire piece of property, and Mr. Massa replied it did not have a separate deed. Mr. Ehret suggested that the land be surveyed, and a request be made for land division. Svlvester Nistler - Variance Motion made Peloquin, seconded by Peltier, to add Sylvester Nistler to the agenda. All aye. Motion carried. The Nistlers would like a variance to build their home within 8' of the lot line. The city code calls for 101. They have written approval from their adjoining neighbor (Tom Raiter) to build closer to the lot line. Motion made by Peloquin, seconded by Gillen, that the Planning Commission recommend approval of the variance of Sylvester Nistler, reason being it allows them to build at an angle to conform with the rest of the homes in the area, and that we have no objection from the adjacent property owner. VOTING FOR: Ehret, Peltier, Peloquin, Gillen, and McAllister Motion carried. Motion made by Gillen, seconded by Peltier, to adjourn at 10:40 P.M. All aye.
