Terry Townsend Re: re -zoning MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION March 9, 1977 The meeting was called to order at 8:00 P.M. by Chairman Larry Ehret. PRESENT: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister. Larry Irsfeld, Hugo City Council, and Bill Schwab, Washington County Planning, were also in attendance. ABSENT: Rosenquist Motion made by Peltier, seconded by Greger, to approve the minutes of February 9, 1977, after the following changes have been made: page 2, paragraph 1 (line should read, then we could require 30' from land owner on the south). Page 2 - should read motion failed, not died. All aye. Motion carried. Motion made by Peloquin, seconded by Peltier, to approve the minutes of February 16, 1977, as submitted. All aye. Motion carried. STEPHEN GUTTING - EASEMENT Mr. Ehret read a letter sent by Mr. Richard Johnson and Mr. Flynn, stating they would like a 30' easement along the south section line. Mr. Ehret questioned whether easement was to become a city street. He did not feel they needed a 7 ton city street for two or three houses. He suggested that there be a covenant of 30' on property so that no one could build on it. Gillen said that the easement still belongs to Stephen Gutting so that property owners are using private easement for their street. Mr. Schwab said that after a road is built to the back 20 acres, only then would a building permit be issued. By grant' his variance, the Commission will be setting a precedent. Mr. Gillen felt a permanent 301,easement should be granted with a 30' buffer or protector for the city, ,if they divide the long way. If they want to square the property off, they would have to build a 700' road. Mr. Gillen felt the City Council will not approve a 30' cartway. Motion made by Peloquin, seconded by Peltier, that we recommend the granting of the variance, allowing them to split into two long 10's, and the seller retain the 30' easement on the south side so that the back 20 acres will not be landlocked. Credit will be given to two 10's for road easement. VOTING FOR: Ehret, Peltier, Peloquin, Greger, McAllister VOTING NO: Gillen Motion carried. Hugo Planning Commission March 9, 1977 Page 2 MRS. JOHN DISTLER - SELLING 5 ACRES IN AG ZONING The Distler's own a home sitting on 5 acres of land. They have since outgrown the house, and would like to sell. However, they want to change the property lines of the deeded property. The land in question is between County Road 4 and Keystone Avenue. Chairman Ehret advised the Distler's that the Planning Commission would not consider, because they have to uphold the zoning laws of the city. TERRY TOWNSEND - REZONING Mr. Townsend purchased the 1.4 acres in July, 1974, with the under- standing they were going to get another 3.6 acres, because they wanted a guaranteed price on the land. Mr. Schwab stated that the deed should be made so that both deeds are one piece of land, and the application should be changed from rezoning to subdivision. Motion made by Gillen, seconded by Peloquin,that we allow the addition of 3.6 acres to the existing 1.4 acres subject to the restriction that the resulting 5 acres be incorporated into one parcel of land covered by one deed. VOTING FOR: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister Motion Carried. Motion made by Gillen, seconded by Greger, that the submitted appli- cation be changed from rezoning to minor subdivision, and make a recommendation to the City Council to reimburse Mr. Townsend for the difference in the fee. VOTING FOR: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister Motion Carried. Recessed 9:35 Reconvened 9:45 Mr. Jerry Dabe, 17080 Henna Avenue North, appeared requesting advisement on how much right-of-way he will need for a driveway. Mr. Dabe would like to purchase 40 acres from Perrault. Mr. Ehret suggested that Mr. Dabe would be well advised to get 601. The matter of the proposed solid waste landfill in Hugo was discussed. Hickok: & Associates will be holding a public hearing some time in the next month or so. Mr. Dan Spitzer is attempting to set up an informational meeting prior to the hearing. Schwab said that a site had been selected a couple of years ago in Afton. The Metro Council did not approve, and suggested that another site be found. Soils and sites were ana- lyzed by a computer, and eventually narrowed to three sites - one in Oakdale, one in May Township, and one in Hugo. Ehret asked that if the site in Hugo is picked, what options are available to the city to fight it. Schwab stated that the matter would probably wind up going to court. Hugo Planning Commission March 9, 1977 Page 3 ROAD EASEMENTS It was the general concensus of the Planning Commission that roads should be considered as part of the minimum lot size. Mr. Ehret asked should consider a substandard lot or do we consider a variance.&` McAllister stated that he was against percentages (road easement taking more than 10% of the acreage). Peloquin felt each one should be handled on an individual basis. A vote was taken as to whether each member would like to consider variance or percentage: Ehret - treated as variance Peltier - variance Peloquin - variance Greger - percentage Gillen - percentage McAllister - individual basis Mr. Schwab stated that the variance was the only appropriate route to go, but would have to be more critical in the case of smaller lots. Mr. Ehret stated that in the matters of power, drainage and other easements, each case would have to be handled individually. The length and width of driveways was also discussed. Mr. Schwab stated any time you give someone a 30' easement, you are asking for problems. Gillen endorsed a 60' easement and privately owned. Motion made by McAllister, seconded by Peltier, that any roads existing or required for land division shall be included in minimum lot size requirements, measuring from the survey lines. VOTING FOR: Ehret, Peltier, Greger, Gillen, and McAllister ABSTAINED: Peloquin Motion Carried. Motion made by Gillen, seconded by Greger, that easements, in general, may be included in the tract area, subject to their impact on the proposed use of the property. VOTING FOR: Ehret, Peltier, Greger, Gillen, and McAllister ABSTAINED: Peloquin Motion Carried. Motion made by Peloquin, seconded by Greger, that the size of road easements, and apartments in SFU zoning be discussed at the next regular Planning Commission meeting, March 23, 1977. All aye.
