Cyril LaCasse RE: Subdivision Variance U MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION FEBRUARY 99 1977 The meeting was called to order at 8:02 P.M. by Chairman Larry Ehret. Attending were Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister. Bob Rosenquist was absent. Motion made by Peloquin, seconded by Peltier, to approve the minutes of January 23, 1977, as presented. All aye. Motion carried. GRACE DEVELOPMENT - REZONING REQUEST Grace Jackson was present and stated that the information requested from Grace Development needed for the public hearing on February 23, was not complete. She discussed the matter of the pert test, and stated that, at present, it is not a good time to have a perc test run. The site plan would be contingent on the perc test. Peloquin felt the public hearing should go on as scheduled, and table the action. Peloquin also stated that site plan should include the whole 3 acres and exactly what is taken off. Ehret interjected he would like to see wh Grace Development would like to do with the rest of the land. The public hearing will go on as scheduled. CYRIL LACASSE - SUBDIVISION VARIANCE Mr. LaCasse owns land on Elmcrest Avenue, and would like a reduction of lot size in the Conservancy District to approximately 18 acres. One building site is high, and the other site might need fill which the future buyer would have to take of. Gillen asked LaCasse how urgently he needed the variance, and LaCasse stated it was not too serious at this time. Gillen stated that we could not come up with a ruling until the recommendations were in order for the City Council. Motion made by Greger, seconded by Peltier, to postpone the Cyril LaCasse subdivision variance request until the Planning Commission gets the guidelines as suggested by the City Council. VOTING FOR: Ehret, Peltier, Peloquin, Greger, Gillen, and McAllister Motion carried. SHOULD EASEMENTSBE CONSIDERED IN DETERMINING MINIMUM LOT SIZE? The Planning Commission asked the above question of the City Council, and they in turn requested some kinO of recommendation. Peltier - an easement is not suppose to be wide enough for a road. Should be just a cartway., Ehret felt that the Commission should get some kind of recommendation from the Washington County Planner. Gillen thought all types of easements should be looked at in detail. Motion made by Peloquin, seconded by Peltier, that we reopen the agenda to the discussion with people in audience. All aye. Motion carried. �I Hugo Planning Commission February 9, 1977 Page 2 Mr. Steve Gutting is the owner of some land off of Jeffrey Avenue, and is in the process of selling the front 20 acres to the Johnsons. Mr. Gutting owns a total of 40 acres, the front 20 acres purchased from Mr. Vietor, and the back 20 purchased from Mr. Hopkins. The Johnson's have agreed to having the easement go on the south side of their property. The land has been surveyed, and perc tests have been taken. Mr. Johnson inquired that since it was just going to be an easement, why does it have to be 6019 Ehret replied that because we are planning for development. The easement might only have to be 30', then we could -require30' from land owner on the south. Easement would be on the section line. McAllister felt it would be a good idea to have a special meeting that would deal solely with the matter of easements and minimum lot size Grace Jackson, Grace Development, questioned the Planning Commission regarding their request that she have perc test done professionally. She stated that Twin City Testing gave her an estimate of $750.00, and she felt that was a little steep. Motion made by Peloquin, seconded by Greger, that Grace Jackson appeared before the Planning Commission and asked if we would approve someone other than Twin City Testing to do the perc test, and we agreed that White Bear Soil Testing would be adequate or other qualified testors. All aye. Motion carried. Recessed 9:30 Reconvened 9:47 Motion made by McAllister that we convene a special meeting of the Planning Commission and request City Engineer, Howard Kuusisto, and City Attorney, Charles Johnson, be present at the meeting, and the City Council be notified that they are invited to the meeting for the purpose of deciding whether easements of any kind should be considered when calculating minimum lot sizes in the City of Hugo. No second. Motion Failpd. Ehret stated that it appears that what we want to do is lay down as recommendation to the City Council - (1) Consider every request, of and by its own merits, and that among the criteria to be used, is that consideration and written into the variance requirements, are circumstances over and beyond the control of the property owner, and that to include public roads now in effect or to be required any and all public, and or, private easements, and, (2) address ourselves to short lots on an individual basis using as a criteria, excluding factors uncontrolled by the land owner. We would consider as a maximum short lot a 15% under the existing requirements. Peltier asked if this is to apply to all zoning districts. Ehret said yes, amending the variance allowing short lots. Peltier said there was no definition of easement in the zoning ordinance, and felt it should be included. Hugo Planning Commission February 9, 1977 Page 3 Mrs. Peltier is to contact City Planner, Carl Dale, Peloquin_to con- tact Charles Johnson, and Gillen to contact Howard Kuusisto, regarding their opinion and recommendation regarding this matter. Peltier made motion, seconded by Greger, that a special Planning Commission meeting be scheduled for February 16, 1977,.at 8:00, to work on recommendation for the City Council concerning how to handle short lots and easement of all types. All aye. Motion carried. Motion made by Greger, seconded by Gillen, to postpone the matter of amending the SFU zoning district to include apartments until the next regular meeting, February 23, 1977. All aye. Motion carried. There is money available to screen auto dismantling yards along any state highway. The state is interested in the Norm Horton junkyard as a possible recipient. Mike Gillen was provided with information needed by the state to proceed. Motion made by Peltier, seconded by Gillen to adjourn at 10:53 P.M. All aye. Motion carried.
