assistance from the planners that there is a need for this type of
zoning. Should it be so determined, matter to be p:rsued through

request the City Council for their origirlal intent on the request to
create a commercial -recreational zone and whether or not their intent
still stands today, and further if they would like this body to in-
vestir;ate the creation of such a zone.

JIT" 3REVIG - REZCYING
P,Ir. 3revig has not been able to have arty pert tests done because of;
the weather. Mr. Gillen discussed the possibility of deleting the
request of Navin`; to take a pert test for the driveway. Gillen stated
it was not a normal request, and could incur additional costs.
',:r. 3revig has not been able to resolve the problem of the dike on his
property. Has turned matter over to an attorne�r. Peloqui.- stated
that the City Council would take care of the matter this sprii".
Chairman hret stated that 3revig's rezoning request does not meet
with current requirer^e.^ts of the zoning ordinance. Ehret told
Brevig that it might be a good idea to withdraw the applicatio>> until
the dike problem is settled. 3revig stated he was having trouble
locating a�,Iy information at City Ilall in- re:;;ands to _,vergreer_ ;rl.

PLANNING COMMISSION
BY-LAWS
ARTICLL I NAND OF COMMISSION
The name of this organization shall be the
Hugo City Planning Commission.
ARTICLE II AUTHCRIZATION
The authorization for t he establishment of this
Planning Commission is set forth under Minnesota
Statutes 462.354, amendments and supplements
thereto. Powers =nd duties are delegated to the
F1?nning Commission by the City Council of the
City of Hugo, Minnesota, by Crdinnnce 101 of
March 1?, 1972, in accordance with the above
mentioned enabling law.
ARTICLE III MEMSLRSHIP ( Amended July 28, 1976 )
Section 1. Regular members shall consist of seven
persons appointed by the City Council. Each member
shall be entitled to one vote. A non-voting, ex -
officio member will be appointed by the City Council
from among its members.
Section 2. In the event that any regular member of
the commission is absent from six consecutive regul-
arly scheduled meetings of the commission, the chair-
man shall request the City Council to declare the
said member's seat vacant and to appoint a replace-
mdnt .
ARTICLE IV OFFICQS
Section 1. The officers of the Planning Commission
shall consist of a Chairman who is aprointed by the
City Council, a Vice Ch=airman who is elected by the
Commission members, a Secretary who is appointed by
the City Council, and a Treasurer who is elected
by the Commission members.
Section 2. The Chairman shall preside at all meet-
ings and hearings of the Planning Commission and
shall h?ve the duties normally conferred by parlia-
mentary usage on such Officers.
Section 3. The Vice Chairman shall act for the
Chairman in his -absence.
Section 4. The secretary shall keep the minutes
and recor- s of the Commission; and, with the
assistance of such staff as is available, shall
prepare the anenda of regular and special meetings
under the direction of the Chairman, provide notice
of all meetings to Commission members, ?rrange proper
and legal notice of hearings, attend to correspondence
of t!^e Commission and such other duties as are normally
carried out by a secretary. The Secretary shell not
be a member of the Commission.
Section 5. The Treasurer shall maintain and keep
records of all receipts and disbursements, which
records shall be audited annually by an Auditing
Committee of three appointed by the Chairman. A
copy of the annual audit shall be furnished to each
member of the Commission, each member of the City
Council, and others as directed by the Chairman.
ARTICLE V ELECTION OF OFFICERS
Section 1. An annual organization meeting shall be
held on the first regular meeting of each year.
Section 2. Nominations shall be made from the floor
at the annual organization meeting, and election of
the officers specified in Article IV, Section 1,
shall follow immediately thereafter.
Section 3. q candidbte receiving a majority vote of
the entire membership of the Planning Commission shall
be declared effected and shall serve for one year or
until his successor shall take office.
Section 4. Vacancies in office shall be filled Imm-
ediately by regular election procedure.
ARTICLE VI MEETINGS (Amended Jarnaary 10, 1975)
Section 1. Meetings spall be held on the second
Wednesday and, at the cQll of the chairman, the fourth
Wednesday of each month. The meetings shall begin no
later than 8:30 P.M. In the event of a conflict with
holidays or other events, a majority at the meeting
previous to the one in conflict may change the date
to resolve the conflict.
Section 2. A quorum shall consist of four members.
The number of votes necessary to transact business
shall be three. Voting shall be by roll call. A
record of the roll call vote shall be kept as a part
of the minutes.
Section 3 . Special meetings may be called by the
Chairman. It shall be the duty of the Chairman to
call a special meeting when requested to do so by a
majority of members of the Commission. The Secretary
shall notify all members of the Commission not less
than five days in advance of such special meeting.
Section 4. All meetings or portions of meetings at
which official action is taken shall be open to the
general public.

proceedings at meetings of this Commission.
ARTICLE VII ORDER CF 9USL ESS
Section 1. The items of business at regular meetings
shall include:
a. Roll call.
b. Consideration of minutes of previous meeting.
c. Communications and bills.
d. Reports of Officers and Committees.
e. Old business.
f. New business.
g. Adjournment.
Section 2. A motion from the floor must be made and
passed in order to dispense with any item on the agenda.
ARTICLE VIII HEA RINGS
Section 1. In addition to those required by law, the
Commission may hold public hearings when it decided
that such hearings will be in the public interest.
Section 2. Notice of the time and place of such
hearing, when on matters of widespread interest, shall
be published once in the City's official newspaper not
earlier than two weeks and not 1 -ter than ten days
prior to the hearing. For matters of limited territ-
orial interest, notice shall be given in such manner
as is deemed approprip to by the Commission.
Section 3. The Tatter before the Commission shall be
presented in summ^ry by a member of the Commission de-
signted by the Chairman and p-rties in interest shall
have the privilege of the floor.
Section 4. No record of st-tement shall be recorded
or sworn to as evidence for any Court of Law without
notice to the n?rties.
Section 5. A record shall be kept of those sreaking
before the Commission at such hearings.
ARTICLE IX AMENDMENTS
These by-laws may be amended by a majority vote of the
entire membership of the Planning Commission.
