Dabe is requesting to split a 40 acre parcel into 2 - 10 acre parcels and one 20 acre parcel. The land is zoned Conservancy, and the 2 - 10 acre parcels would have to be rezoned to the A Ticultune zone. The neighbors *W adjoining the property were notified, but no one was present to make comments. (E: "'T ARRIVED AT 8:05 PI1). HowardK_uusisto had submitted a plan as to how the road is tolaid out. Kuusisto suggested a T turn around, and Gillen felt that a cul-de-sac would be more appropriate to enable emergency vehicles to more easily turn around, if need be. Dabe stated that the road would have a 24' top with 2' shoulders. Motion Carried. G ---',BALD DABS - R Z0's1IITG e: M11 -TOR SUBDIVISION Gillen stated that the land to the north and west?zoned A;riculture, so rezonin; would not be considered spot rezoning. Gillen suggested that the Planning Commission consider why land is zoned Conservan.cy (wetland, vegetation surrounding wetlands, and wildlife) in determining; rezoning. _;hret's opinion was that each parcel of land should be looked at individually. It was his understanding that in terms of large arcdccca, requirements, there was considerable difficulty in finding a buildinJ site. I.1r. Dabe O provided pert tests for both 10 acre porcels of land, which proved to have buildable sites. T,otion made by Gillen, seconded by Peltier, to recommend approval of -the request of Gerald Dabe 'to rezone two 10 acre parcels to the A riculture zone, leaving Lot C in the Conservancy zone. Hugo Planning Commission November 8, 1978 Page 2of3 MINOR SUBDIVISIOIT Gillen again restated that fact that he would rather see a cul—de—sac than a T turn around. Motion made by Peloquin, seconded by Peltier, to recommend approvOAof the request for Gerald Dabe to divide a 20 acre parcel into two 10 acre parcels subject to the road situation as suggested by the City Engineer, Howard Kuusisto. Gillen requested that the City Council lookin; into the feasibility of a cul—de—sac for safety for emergency vehicles. VOTING FOR: Peloquin, Peltier, Greger, and --.:hret BSTAII"D: Gillen MOTION CARRUD Gillen wanted the record to show that DIr. Dabe has started construction of the road without adequate prior approval, and that the city takes no liability. Motion made by Ehret, seconded by Peltier, that the recommendation of the city engineer concerning the north/south easement as being on the center line be changed to be a 30' permanent easement plus an additional 30' temporary easement all on the east side of the west property line extending the full length of the north/south property line. VOTING FOR: Peloquin, Peltier_, Greger, and Ehret ABSTAIITED: Gillen 110TION CARRL:,D JOHN Ifu^d DRU — SUBDIVISION Mr. Malinka subm;tted copies of the orginal plan as submitted by Jerry Moe for land alon.; 140th Street. I,x. Malinka was informed that he would have to submit a new preliminary plan for the subdivision, and fill out a new application. He is also to research whether pere tests were actually taken on the land as indicated on the prior plan. 1:hret stated that when application is made, another public hearing would have to be held. DICK G:,�tIRICH — VARIANG!7� TO SEPTIC SYST�14 Mr. Genrich is requesting a variance from the standard drain field septic system to electro—osmosis ystem for sewage system on two building sites. Mr. Coolborth, president of Coolbroth—Sitton Septic Tanks, Inc., was present at the last Planning Commission meeting explaining how the system works. Greger had done some checking, and he found that the system does not necessarily work the way they say it does, but it does work. Gillen stated that he was totally unfamiliar with the system. '11hret stated that the Planning Commission could recommend approval of this Minor Subdivision and variance with the understanding that an alternative esptic system be installed and that it be written right into the sales contract that the city takes no liability or guaranteeing of the system and the property be sold at the buyer's own risk. The city would like someone to research the electro—osmosis and other systems for future use. At this point, the Planning; Commission finds itself without the ability to approve or deny the system and is curious to see if it would work. Lotion made by :)hret, seconded by Peltier, to recommend approve of the variance .request of Richard Genxich (1976-76—VAR) without ?, recommendation of -the type of system to be installed.. .,hret stated that it was the opinion of the Planning Commission that they simply do not have the Rowledge to recommend. Gillen suggested that the matter should be tabled and sent to the City -�,ngineer. Peloquin felt that because he had no knowledge about the system, he would have to abstain. Yiir. Genrich said that tie was asking the Planning Commission to make some kind of decision. Motion made by Gillen, seconded by Peltier, to recommend approval of the Site Plan for Dean Atkinson to construct a. 40 x 64 pole building to be used for storage, according to the Site Plan submitted.
