PRESENT: Ehret, Peloquin, Peltier, Woeltge, and McAllister ABSENT: Greger and Gillen Motion made by Peltier, seconded by McAllister, to approve the minutes of May 24, 1978, as presented. All.aye. Motion Carried. GREGER ARRIVED AT 8:03 PM, DICK GENRICH - VARIANCE Mr. Genrich is acting as the agent for the estate of William Schletty. Theyare requesting approval of access by private driveway and variance from the -mi ur-road frontage requirement _ - }-so as to obtain a building permit for the 50A site. There is a 30A parcel that fronts 130th Street with 400' frontage. The land is zoned Conservancy. (GTLLEN ARRIVED AT 8:06 PM). The 66' easement would serve a l0A and 50 or 55A parcel. The perc tests provided by Mr. Genrich were reviewed by Dan Koehler, and it was his determination that they were unacceptable. Peltier stated that there are two ditches on the property that have to be kept open, and one may be a judicial ditch. Ehret said that if there was a judicial ditch on the pro- perty, a permit would have to be obtained from Rice Creek Watershe. The private ditch would just need a culvert. He suggested that Mr. Genrich get a better perc test for the two parcels of land, and contact Rice Creek for the possibility of obtaining a permit for the ditch. Other than that, the Planning Commission had no problem with the granting a variance for the 66' easement as frontage. Motion made by McAllister, seconded by Peloquin, to recommend approval of the variance request as applied for by Mr. William Genri6h, for a 66' easement as frontage on Goodview Avenue, subject to the following: 1. Proof of buildable lot sites. 2. Determination of location of any judicial ditches. 3. If a judicial ditch does exist, a valid permit from Rice Creek Watershed. 4. That the private easement is to serve the 50 or 55A lot and the 10A parcel lying on the northwest corner of the easement. VOTING FOR: Peloquin, Gillen, Greger, 1doeltge, McAllister, and Ehret ABSTAINED: Peltier Motion Carried. Let the record show that the Planning Commission would like to again review the request after the required material requested is provided. Hugo Planning Commission .Tune 14, 1978 Page 2 of 6 Gree Stankey — Mobile Home Petition Mr. Stankey is the owner of a greenhouse business located on Highway 61 between the MR Tourist Camp and Schmidty's 61 Club. He stated that he has been having problems with vandalism and thefts. The mobile home would service as a temporary watchman's quarters. He also stated that he has plans to construct an office at the site in the future (tendative site plan was presented.) There is a well on the property, but no septic system. There has,tbeen',perc test taken at this time. it.4; Motion made by Peloquin, seconded by Peltier, to recommend approval of watchman's quarters and office with a temporary Mobile Home Permit. The permit is to be renewed q& four (4) times or a term of 15 months. At the time of the first renewal, Yx. Stankey is to provide a satisfactory perc test along with plans for the construction of an office. VOTING FOR: Peloquin, Peltier, Gillen, Greger, Woeltge, McAllister, and Ehret Motion Carried. Let the record show that Mr. Stankey clearly understood the conditions of the approval. I.10F'iAN HORTON — AUTO DISIWITLING LICENSE No one present at this time. FISCHER CONSTRUCTION — MINING P ---%IIT Mr. Fischer was present, and stated that a new muffler had been placed on the generator that was supposedly creatin{ the noise problem. The PCA had contacted Ehret and stated that they were unable to make a noise level reading because of the wind. They will make a reading and report to the city by June 28, 1978. The Planning Commission will review the report when it is received. Motion made by McAllister, seconded by Peltier, to recommend approval of a Mining Permit for Fischer Construction, subject to the following conditions: (SEE ATTACHED) A resident was present and stated that she would like to see the Planning Commission not take any action on the permit until the report is received from PCA. Ehret stated that the report will be reviewed when it is received. VOTING FOR: Peloquin, Peltier, Gillen, Woeltge, I.4cAllister, and Ehret ABSTAINED: Greger Motion Carried. L AVINA DURAME, — SPECIAL USE PFJRMIT ;hret wanted to make note that Richard Schuh was the only Mining Permit holder that has approval made for a Special Use Permit. He wanted to know where Special Use Permits were for the rest of the permits, and if they didn't have one, why not. Hugo Planning Commission June 14, 1978 Page 3of6 Duraine — cont. Motion made by McAllister, seconded by Peltier, to recommend approval of the Special Use Permit for Lavina Duraine, subject to the following conditions: 1. Extend Special Use Permit until June 309 1979, 2. Post bondin the amount of 85,000.00 3. The bituminous hot mix plant should be allowed. 4. Special Use Pe3m it to allow for additional mining. 5. All existing trees and natural vegetation bordering the pit area shall be left undisturbed. 6. All top soil in the pit area shall be stockpiled, and at the time the operation is completed, the top soil shall be replaced and seeded to grass cover. 7. Sewer facilities shall be of the portable, chemical holding tank type. 8. Updated contour map to be provided to City Engineer. All aye. Motion Carried. MARDON HOMCS_INC. SUBDIVISION Mr. Tramm was present for Mardon Homes. There are 58 acres of land, zoned RRII, bordering Irish Avenue and 122nd Street. They submitted a site plan indicating 10 five acre homesites. Ehret stated that the plan submitted called for a cul—de—sac that far exceeds the requirements of the city. There is also some acreage on the opposite side of the lake that was not included in the preliminary plan. A resident owning land on the west side of Irish Avenue stated her concern of the possible contamination of the ground water. Ehret stated that perc tests are required for every proposed lot, and if they are acceptable, that would be the city's only means of protection. Another resident suggested that the road run north and south between Melcher's property and Van Beeks. He stated that as the road is now proposed, he would have lights shining on his bay windows. The following information is to be supplied by Tramm for the proposed subdivision: 1. Perc tests and soil borings on every proposed building site (professionally done). 2. Discuss the proposed road and crossing of stream with city Engineery Kuusisto. 3. Supply proof of ownership. 4. Names and address of property owners within 300' of the entire piece of property in question. 5. Topographical map (2' contour interval) 6. Building setback lines drawn on each lot 7. Copy of the plat showing definite locations of where soil tests were taken 8. Lot size in acreage for each lot 9. Indicate lake and outlot 10. Get review from Washington County Soil Conservation Service Motion made by McAllister, seconded by Peltier, to set a public hearing for July 269 1978, at 7:30 PM, to consider the request of Mardon Homes to subdivide 58 acres into ten five acrea lots. The material requested is to be submitted a minimum of two weeks prior to the public hearing for review of the Planning Commission. All aye. Motion Carried. Hugo Planning Commission June 14, 1978 Page 4 of 6 LAVALLE EXCAVATING — T-lINING PERMIT Mr. LaValle presented a map indicating the outline of the pit. LaValle stated that he will be mining approximately 4000 yards. The debris, as mentioned is Kuusisto's report, was to have been cleaned on June 14. Motrin made by McAllister, seconded byGillen, to recommend approval of the Mining Permit for LaValle Excavating until June 30, 1979, subject to the following conditions: (SEE ATTACHED) VOTING FOR: Peloquin, Peltier, Gillen, Greger, Woeltge, McAllister, and Ehret Motion Carried. KARIN HUN^ER — SPECIAL USE P1311MIT Motion made by McAllister, seconded by Gillen, to move the Hunter matter ahead on the agenda. All aye. Motion Carried. PIs. Hunter would like to restore an old home into an art studio. This would mean an accessory building with no primary building. There was some discussion as to what would be considered as a primary use for a building. Mr. Crever had inspected the site and stated that the building was structurally sound. Ms. Hunter stated that she hopes to builder a residence within two years. Dan Koehler suggested that a perc test be taken at the site. I -lotion made by McAllister to recommend approval of the request for a Special Use Permit by Karin Hunter to restore the existing home into an art studio subject to: 1. An acceptable perc test be submitted to the Building Inspector 2. Application be made within two years for the construction of a residence McAllister withdrew his motion. Motion made by Greger, seconded by Woeltge, to recommend approval of the request by Karin Hunter for a Special Use Permit, subject to obtaining a proper perc test. JOHN MALINKA — SSUBDIVISION Motion made by Peloquin, seconded by Gillen, to table the matter for lack of representative. All aye. Motion Carried, CHARLES SHUBAT — SUBDIVISION 1,1r. Shubat was present looking for preliminary approval for a subdivision to divide 113 acres into 11 parcels. A preliminary plan was presented, along with a copy of perc tests. Dan Koehler reviewed the perc tests but unable to make any kind of recommenda— tion because the writing was too faded to read. A request was made for a more legible copy. The present zoning of the land is Agriculture. Shubat indicated that Parcel 2 V Hugo Planning Commission June 14, 1978 Page 5of6 may haveAdivided already into two 5 acre parcels. Motion made by McAllister, seconded by Gillen, to table the request for further clarification and resolution of the following matters: 1. Clarification on Parcel 2 2. Pere tests and soil borings 3. Attorney review 4. Acreage listed on Parcels 9, 10, and 11 5. Work out which side the easement will be located 6. Correct dimensions of the road 7. Application for variance on Lot 5 8. Topographical map to be provided VOTING FOR: Peloquin, Peltier, Gillen, Greger, Woeltge, McAllister, and Ehret Motion Carried. THOMAS PERZICHILLI — SITE PLAN APPROVAL Mr. Perzichilli wants to construct a 24 x 28 showroom and a 40 x 40 warehouse to open a floor covering business alone; Highway 61. The land is zoned CB. The building was to be a pole type building with steel siding. The Planning Commission had no problems with setbacks or parking facilities. Gillen stated that he would not like to continue with pole buildings in the city proper. The city should start now with some form of urban renewal. Motion made by McAllister that the Planning Commission forward the matter for Site Plan Approval for Tom Perzichilli without recommendation due to the type of structure and let the City Council set a direction for the Planning Commission to take in the future regarding the type of building desired in the CB district. McAllister withdrew his motion. Motion made by McAllister, seconded by Greger, to recommend approval of the Site Plan for Tom Perzichilli subject to the following: 1. The entire front of the building facing highway 61 be bricked except for the windows. 2. The bricks will be on the front of the office and the rest of the material structure facing Highway 61 will be of rough sawn cedar. VOTING FOR: Peltier, Greger, 1;oeltge, and McAllister VOTING AGAINST: Peloquin, Gillen, and Ehret Motion Carried. NOTE TO CITY COTRJCIL: The Planning Commission would like some guidance from the City Council as to the type of buildings they would like the Commission to work on for urban renewal in the future, for districts zoned Industrial, RB and CB. Motion Carried. P'Lr. Dan Koehler informed the Planning Commission that the Meeting of June 28, will be his last meeting with the city. He will be taking a job with a private business. All existing fences surrounding the premises shall be maintained in the present or improved condition. 2. The double row of trees along the West property line shall be maintained, and any trees that might die, shall be replaced no later than May 1 of the year following a determination of the death of any of said trees. 3. A parkin-; area of at least twenty -four -hundred (24'0) square feet shall be paved with bituminous material, and a driveway leading from said parking lot to the driven portion of Highway #61 shall be paved with bi- tuminous material within ninety (90) days after the date of this Special Use Permit. 4. The driveway shall be maintained clear at all times so that customers are not prevented from reaching the parking area, an no auto dismantling may be conducted within fifty (50) feet of any building or within fifty (50) feet of the parking area. 5. No tires are to be piled along the southerly property line. 6. The owner shall submit a plan indicating fire lanes and the layout of the auto dismantling yard and the areas where automobiles are stored to the City of Hugo, within twenty (20) days after the date of this Special Ilse Permit. In the event the existing conditions do not comply with the plan layout as submitted, the owner shall cause the automobiles and other materials within the auto dismantling yard to be rearranged to comply with said plan with ninety (90) days after the date of this Special Use Permit. It is understood that in the preparation of said plan, the owner shall provide fire lanes between stored automobiles, and between the stored automobiles and the boundaries of the property, said fire lanes so arranged to be a minimum of then (10) feet in width at ground level and to the height of stacked automobiles; and no more than two rows of stored automobiles shall be stacked between fire lances. A spacing of at least ten (10) feet shall be maintained of any automobiles, parts, or materials, from any build- ing, or a spacing in excess of ten (10) feet that may be necessary to provide adequate fire protection. 7. Cars or other vehicles stacked in the auto dismantling yard shall not be stacked over a height equivalent of two (2) passenger automobiles. 8. The owner or operator scall provide on the site an adequate storage tank to hold any crankcase oils or gasoline or other petroleum products which may he drained from the stored vehicles prior to their desmantlin . 9. The owner shall cause signs to be erected and/or main- tained, notifying customers not to park on Hlighway 61, and directing customers to*the paved parkin; area herein required. 10. A Performance Bond in the amount of Five Thousand Dollars (5,000.00) shall be posted with the City of Hugo to insure that the conditions of this Special Use Permit are complied with. A deposit of case, or an irrevocable letter of credit in a form approved by the City may be substi- tuted for said Performance Bond. 11. The Special Use Permit, as herein conditioned, shall be reviewed annually. The violation of conditions herein set forth may result in a review of the Special Use Permit at any time. 12. Any change of operation of said auto dismantlin;r- ;card shall require application by the owner for an amendment of this Special Use Permit prior to any such change of operation being implemented. An estimated annual inspection fee pursuant to the provisions of Section 701.04, Schedule A, of Ordinance 107, in this asaamt of $235.00 shall be deposited with the City Clerk, 9.
