MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION May 24t 1978 The meeting was called to order by Chairman Ehret at 8:03 PM. PRESENT: Ehret, Peloquin, Peltier, Woeltge, Gillen, and McAllister Larry Irsfeld, City Council, was also present. ABSENT: Greger Motion made by Peloquin, seconded by Peltier, to approve the minutes of May 10, 19781, after the following changes have been made: Page 2 2nd paragraph) - prior to the adoption of the Zoning Ordinance Page 2 Ray Neeser) - stamp the land division with the approval of the City Council Page 3 Carl Dale) - Mr. Dale will be notified when the contract is signed. Page 4 �Hollihan) - McAllister voted no because he felt documentation would be incomplete All aye. Motion Carried. FISCHER CONSTRUCTION - MINING PERMIT Residents of Evergreen Hills presented the Planning Commission with a list of names stating their complaints regarding the Fischer operation, listed as follows: 1. Operating before 7 A.M. and after 7 P.M. 2. Excessive noise 3. Excessive speed on 8A 4. Odor Mr. Fischer was present, and stated that up to now, he was unaware of any problems with the mining operation. B -Tu -Mix operates that hot mix plant at his pit, and Ehret informed Fisher that it was his responsiblity to see they operate under thf- terms of the permit. The noise problem is created by a generator needed to keep' the oil hot for the next days work. The speed problem will have to be investigated by the sheriff's office because 8A is a county road. As for the odor, Mr. Fisher said that PCA had not no trouble with their operation. Mr. Vincent Verrecchio, 14107 Hyde Avenue, said the major concern of the Deo le was the constant manufacturing throughout the night. He stated that he lives 17 of a mile west of the pit. Donna Goetl, 14481 Hyde Avenue, inquired into the possibility of expansion. Ehret said the permit would have to be reviewed if they request expansion. Herb Foot, 14425 Hyde, stated that no one was informed of a public hearing last year. Ehret told Mr. Foot that hot mix plants are included in Mining Permits, and a public hearing is not required. Dave Kirk, 14359 Hyde Avenue, wondered how long they would have to put up with the noise, and Ehret said they would request a report from the Police Department, and request Mr. Fischer to bring the noise problem under control. Hugo Planning Commission May 24, 1978 Page 2 of 4 James Brevig, 14120 Hyde Avenue, suggested that the Planning Commission recommend denial of the Mining Permit for Fischer. Engineer Kuusisto's mining report is on file at City Hall. Mr. Gillen stated that he lives closer to the mining operation than any of the resi— dents present, and he has never had a problem with the noise and odor. Motion made by Peloquin, seconded by Gillen, that the request for Mining Permit as requested by Fischer Construction be tabled until June 14, 1978, at which time the following will be ava%ble: 1. A report from the Police Department regarding the noise problem. 2. Sheriff's report on truck traffice on County Road 8A. 3. Request FCA to obtain a noise reading on night time operation. VOTING FOR: Peloquin, Peltier, Gillen, Woeltge, McAllister, and Ehret Motion Carried. Let the minutes show that when a complaint is filed with the Police Department, that the holder of the permit be notified of said complaint. A copy of the complaint is to be filed 'with the Planning Commission. The permit holder is responsible for responding to the city regarding said complaint. Mr. Fischer gave the Planning Commission permission to inspect the area during hours of operation.,. RICHARD SCHUHk— MINING PERMIT Mr. Schuh was present at the meeting, and questioned the difference in expiration of time from Nis permit and Mr. Fischer's. Let the record show that all Mining Permits shoulA expire on June 30 of a given year. 1 Mr. Kuusisto'4 report stated that the haul road to the east (152nd Street) from the pit area is iii need of reshaping and grading. Mr. Schuh stated the problem was created by frost boils, and he planned on filling with gravel. Mr. Brevig stited that he would like to see the Planning Commission recommend denial. Motion made bi McAllister, seconded by Gillen, to recommend approval of the Mining Permit for MrRichard Schuh until June 309 1979. Mr. Schuh stated that the haul road of 152nd treet will be reshaped and gravel added to the satisfaction of the City Engineer within 30 days. Mining Permit also subject to the following: (SEE ATTACHED) Ehret suggest4d that the motion should include that any noise caused, be brought under the sam) � standards of other pits in the city. LAVALLE EXCAVATING — MINING PERMIT Hugo Planning Commission May 249 1978 Page 3 of 4 Mr. LaValle's secretary was present, and could not answer the questions presented to her. Motion made by Gillen, seconded by Peloquin, that the request for a Mining Permit for LaValle Excavating be table until June 14, 19781, at which time Mr. LaValle should be present to answer the following questions: 1. Where are the limits of the pit area? 2. How much is going to be mined? 3. Removal of debris as stated in Kuusisto's report. All aye. Motion Carried. ADDITIONS Motion made by Peloquin, seconded by Peltier, to add Lametti and Sons, Tom King, and Bernie McDermaid to the agenda. All aye. Motion Carried. LAMETTI & SONS — SPECIAL USE PERMIT Jerry Lametti presented a site plan for the construction of an office at their place of business. The land is zoned Industrial. Let'the record show that the Planning Commission feels that offices directly pertaining to use in the Industrial Park, currently under a Special Use Permit, be considered part of that Special Use Permit, and that the only thing to be considered by the Planning Commission is site plan approval. Motion made by McAllister, seconded by Peloquin, to recommend approval of the Site Plan as presented by Lametti, subject to the filing of an adequate septic system and perc test for ten (10) additional employees, and a drainage plan. The present area as indicated for parking is adequate for the number of employees to be added. VOTING FOR: Peloquin, Peltier, Gillen, Woeltge, McAllister, and Ehret Motion Carried. THOMAS KING — VARIANCE AND FARM SITE PLAN The Kings' are purchasing two parcels of land (12 & 14A) fronting on Henna Avenue and 180th Street. The land is zoned Agriculture. They would like clear title to the 12A. The land fronting Henna Avenue has only 233' of frontage, and the ordinance calls for 300' so a variance would be in order. There is no more land available. Motion made by McAllister, seconded by Gillen, to recommend approval of the variance request of Thomas King for 233' on Henna Avenue, because there is no more land available. VOTING FOR: Peloquin, Peltier, Gillen, Woeltge, McAllister, and Ehret Motion Carried. Hugo Planning Commission May 249 1978 Page 4 of 4 Motion made by Peloquin, seconded by McAllister, to recommend approval of the site plan as presented contingent on a perc test and current building permits. All aye. Motion Carried. BERNIE MCDERMAID Mr. McDermaid has been working with Hugo's attorney and Mr. Briggs, Grant Township, in an attempt to resolve the 1.1 acre of land lying in Hugo. The best solution that can be determined is annexing 4.9 acres of land from Grant Township creating a 5 acre parcel with the house sitting in Hugo. There would be a restrictive covenant stating that none of the land can be sold off — registered as 5 acres. The land would have 128.8 feet frontage on the road. Mr. McDermain has been informed that Tom LaValle will be reconstructing the road (July Avenue) on May 31, 1978. Motion made by Ehret, seconded by McAllister, to recommend approval of the proposal as submitted by Mr. McDermaid, including a letter of credit to insure completion of the road, in an amount to be determined by the City Council. VOTING FOR: Peloquin, Peltier, Woeltge, McAllister, and Ehret ABSTA32ED: Gillen Motion Carried. TONY NTEMCZYK — LAND DIVISION Motion made by Ehret,seconded by Peloquin, to recommend approval that Lot #8, as described in Proposal #2 for Tony Niemczyk, be allowed to be sold by metes and bounds and no further action be taken at this time. All aye. Motion Carried. Motion made by Gillen, seconded by McAllister, to adjourn at 11:30 PM. All aye. Motion Carried. Mary A�Creagert Secretary Hugo Planning Commission GRAVEL PIT AND STOClPII,E OPERATION Pursuant to the provisions of Ordinance 107 of the City of Hugo, Minnesota, entitled "An Ordinance Establishing Mining Regulations to Provide For Orderly, Economic, and Safe Removal of Sand, Gravel, Rock, Soil, and Other Natural Deposits and to Promote the Public Health, Safety, and Morals, and General Welfare in the City of Hugo, Washington County, Minnesota", a Mining Permit is issued to: RICHARD F. SCHUH 1087 County Road H2 White Bear bake, Minnesota 55110 For a period to expire on June 30. 1979, unless sooner terminated pursuant to the provisions of said Ordinance, and subject to the following conditions: 1. All applicable provisions of the City of Hugo Ordinance governing mining shall be complied with. 2. The scope of the Mining Permit shall be limited to the terms included in the "Application for Mining Permit" dated October 27, 19759 a copy of which is attached hereto and incorporated herein by reference, it being understood that the permit is limited to stockpiling and hauling away the existing stockpile of granular material and asphalt mix and restoration of the area, and that no material may be hauled to the site except for approximately 4500 tons of 5/8" crushed rook to blend with the existing material on the property, and the excavation, crashing, stockpiling and hauling away of material shown on the contour map. 3. No top soil or overburden shall be removed from the site. 4. Haul roads shall be Irish Avenue South to County Road 8A, and 152nd Street east to Jeffrey Road, only. 5. Dust control on all city streets shall be by the use of oil (crankcase oil), or calcium chloride, as directed by the City Engineer. 6. The inspection fee shall be deposited in the awrunt of =500.00, and engineering and legal inspection shall be done as needed. 7. The contractor shall provide and maintain both a x109000.00 bond and a #25,000.00 irrevocable letter of credit for the maintenance and/or reconstruction of the haul roads, and to insure compliance of all conditions of the permit. 8. Recommendations fo the Engineer of the City of Hugo, as they may be made from time to time, shall be made a part of this permit. 9. Inspection to insure compliance with this permit will be done by the Engineer of the City of Hugo, and he may request that the assistance of such other persons or organizations as he my deem necessary. 10. Any violation of the terms or conditions of this permit shall be grounds for immediate termination in accordance with the City Ordinance. Mining Permit " . Richard F. Schuh Page 2 11. Haul roads shall be periodically inspected by the City Engineer and maintained by the contractor in accordance with his recommendations. 12. A speed limit of a maximum of 45 miles per hour be maintained by the contrac— tor's gravel trucks when operating on the haul roads on City Streets. On those days when school is in session, a speed limit of a maximum of 30 miles per hour be maintained by the gravel trucks when operating on haul roads on city streets between the hours of 7tOO and 7:30 A.M. 13. Any additional limitations or specifications for the haul routes which shall be deemed necessary for the health and safety reasons by the City Engineer and City Attorney, 14. The hours on mining operations ahll be 7:00 AM to 7:00 PM, Monday through Saturday. 15. There shall be no trucking or hauling in of material except as noted herein without an amendment of this Mining Permit. 16. The sight distance along the haul routes shall be improved at the expense of the permit holder according to the requirements of the Engineer for the City of Hugo. 17. A temporary portable asphalt plant may be placed on the property. The plant shall comply with PCA requirements,, and have a valid PCA number prior to operation. 18. Updated contour map to be filed with the City Engineer.
