The meeting was called to order by Mayor Stolt man at 7:00 PM.
PRESENT: Barnes, Brunotte, Leroux:, Miron, Stolt man

Leroux: made motion, Barnes seconded, to approve the minutes for the City
Council meeting of February 22, 1994, as submitted.
All aye. Motion Carried.
Burnes made motion, Brunotte seconded, to approve the claims for March 7,
1994, in the amount of $23,266.08.
All aye. Motion Carried.
PUBLIC HEARING _(RECREATIONAL VEHICLE ORDINANCE.)
A public hearing was held to consider a proposed ordinance amending the
City's Motorized Recreational Vehicle and Snowmobile Ordinance. The
Council made the following changes to the proposed ordinance:
Brunotte made motion, Leroux; seconded, to amend 181.60, H1, as follows:
During the hours from 1.]._00 Ph to 6:.30 AN, from Sunday through Thursday;

Leroux; made motion, Miron seconded, that no motorized recreational vehicle
shall operate closer than 100' to any residence.
All aye. Motion Carried.
Miron made motion, Leroux: seconded, to table the ordinance amendment until
the meeting of March 21, 1994.
All aye. Motion Carried.
A copy of the proposed ordinance .is to be forwarded to the local
snowmobile club.
MINOR SUBDIVISIUN SI....ARcON/STEAL' ..E:F�.-'
On February 23, 1994, the Huge Planning Commission considered a request by
Verna Larson to subdivide 20 acres into two 10 acre parcels. M=_.. (._arson
is currently purchasing this property on a contract for deed, and seeks
the subdivision of the property in order obtain refinancing. The PC'.
recommended approval of the subdivision request subject to special.
conditions.
Miron made motion, Brunotte seconded, to approve the miner subdivision for
Verna Larson to subdivide 20 acres into two 10 acre parcels, subject to
the following special conditions:

MINOR SUBDIVISION (SCANLAN)
by Washington County Public Health be
by the RCWD.
Mr. Wayne Scanlan has requested a minor subdivision of his property at
17530 Henna Avenue, to allow creation of two 10 acre parcels from an
existing 20 acre parcel. In addition, Mr. Scanlan is requesting a Special
Use Permit to access Henna Avenue via a temporary, private driveway
easement. The Planning Commission recommended approval of the subdivision
and SUP subject to special conditions.
Miron made motion, Brunotte seconded, to approve the minor subdivision for
Wayne Scanlan to subdivide a 20 acre parcel into two 10 acre parcels,
subject to the following conditions:
1. The driveway easement be vacated when Mr. Scanlan's property is
further subdivided. This is to include adjacent property Mr. Scanlan
owns via separate property description.
2. Mr. Scanlan provide proof of ownership.
_. Approval of the subdivision by the RCWD.
4. Approval of the septic locations on each parcel by Washington County
Department of Public Health.
5. Submission of adequate Certificate of purvey.
6. Mr. Scanlan to attach Parcel A to his property to the west and north,
which would allow frontage on 177th Street. and not landlock Parcel A.

Leroux made motion, Stolt man seconded, to approve the Special Use Permit
for Wayne Scanlan allowinq access to Henna Avenue via a temporary, private
driveway easement.

REZONING _REOUE:S`f.._.._J_P -
Mr. Burdette Berntson of 1 '.686 Ethan R•;-enk...te has requested a rezoning of
approximately 28 acres located at Forest. Blvd., from AG to RR2 and
Retail Business. Mr, Berntson intends to SUt7divide the property into two,
five acre parcels for res.idei-it.ial use, and one 17 acre REQ parcel. The
Planning Commission considered Mr. Bernt.son`s request on February 23,
1994, and recommended denial of the reque.-•.t. of Mr. Berntson due to the
residential character of adiacent property.
Barnes made motion, Miron seconded, to deny the rezoning request of
Burdette Berntson to rezone 28 acres from AG to RR2 and RB. The City
Attorney is directed to prepare the necessary Findings of Fact for denial
of this request.

Miron made motion, Barnes seconded, to table all Auto Dismantling Licenses
until the meeting of March 21, 1994.

12. PARK: USE REQUEST (MERTES )
Mrs. Joan Mertes has requested permission to use the Hugo part: for a
wedding reception on August 27, 1994. She wishes to have live
entertainment in the form of a DJ, as well as serve alcohol. Chapter iii)
of the City Code (City Farb; Ordinance) is silent on the consumption of
alcohol in City parkas. If the Council wishes to permit the consumption of
alcohol at this event, staff recommends that no sales of alcoholic
beverages be allowed, and the permittee provide the City with proof of
adequate liability insurance. If the Council desires to grant this
request, staff recommends limiting the hours of live entertainment to no
later than 1(--):O0 PM, as a courtesy to adjacent homeowners.
Mir -on made motion. L.eroUX seconded, to deny the request of Joan Mertes to
provide alcohol beverages to guests, and have music provided by a disc
jockey, in the City park because of potential problems of liability to the
City and noise affecting adjacent property owner. She may reapply for
reserving the parb:. on AUqust 27, 1994.

ROARI:) OF ADJUSTMENT RESIGNATION
Mr. Bob Ellman submitted his resignation from the Zoning Board of
Adjustment due to a work. conflict. Eased on concerns raised during recent
appointments to the Planning Commission, that there should be balance in
City Boards by voting wards, the Council may wish to consider an
appointment f r -:?m Ward 2 or- __`7 to f i 1 I. this position.

in an effort to fill the v,�-tcancy on the Board of Zoning Adjustments.

Mr. Jim Merila, representing K.enco Construction Company, has requested a
reduction in the letter of credit for Rice Lake Meadows, Phase 1, from
City Council meeting of March 7, 1994

$141,000 to $65,475, due to work: completed as of March 1, 1994. The City
Engineer feels that the reduction will leave sufficient security to cover
the remaining work: and repairs necessary. during the project's warranty
period.
Miron made motion, LeroUX seconded, to deny the request of Jim Merila for
reduce the letter of credit for Rice Lake Meadows, Phase 1, until road
construction has experienced a frost cycle.

DISTRICT MEMORIAL HOSPITAL RESOLUTION
Per Council request, the City Attorney provided a revised resolution for
Council consideration regarding the Forest Lake District Memorial
Hospital's attempts to link: with a larger health care provider network.
Miron made motion, Barnes seconded, to adopt RESOLUTION 1994-4, A
RESOLUTION SUPPORTING THE CONTINUING EXISTENCE OF THE FOREST LAKE DISTRICT"
MEMORIAL_ HOSPITAL.

LOUIS ROSSE; (VARIANCE)
Leroux made motion, Brunotte seconded, to add Louis Ross.e to the agenda
for a variance request.

Lou Rosse of 17717 Henna Avenue is requesting a variance to construct A-

40' x 90' building on his property closer to Henna Avenue than the
principal building.

1,21S1' STREET ACCESS REPORT -
The Council reviewed a report from the City Administrator regarding the
complaints received on the 121st Street access to Bald Eagle Lake. The
Administrator recommended that the access to be used by pedestrians only.

Miron made motion, Barnes seconded, to accept the City Administrator's
report and recommendation, directing him to actively pursue implementation
of the "Pedestrian Only" policy for the 121st Bald Eagle Lake access. The
proper signs indicating this change should be installed as soon as
possible.
Barnes made motion, Brunotte seconded, amending the previous motion that
the ramp not be closed at this time until after a public hearing is held.
VOTE ON AMENDMENT: All aye. Motion Carried.
VOTE ON ORIGINAL MOTION: All aye. Motion Carried.
STOLTZMAN AGREEMENT
On February 22, 1994, the City Council proposed an agreement to the
Stolt mans as a means of settling a complaint alleging zoning violations
on the property, and directed the City Attorney to provide a copy of the
Agreement to Stolt man's attorney. The Council requested that the
Stolt mans respond to the proposed settlement within 10 days.
LerouX made motion, Barnes seconded, to amend the Agreement regarding the
hiring of employees - should include one employee Outside of immediate
family, in addition to those members of Mr. Stolt man's immediate family,
who may be employed on the site.

the removal of two 55 -gallon drums of paint from the Walter W. and Laura
Stolt man property.
