PRESENT: Barnes, Brunotte, Leroux, Miron, Stoltzman City Administrator, Robert Museus City Attorney, Greg Ga•ller City Engineer, Joel Dresel City Clerk, Mary Ann Creager Brunotte made motion, Miron seconded, to approve the minutes for the City Council meeting of April 4, 1994, as amended. All aye. Motion Carried. Brunotte made motion, Miron seconded, to approve the minutes for the special City Council meeting of April 11, 1994, as submitted. All aye. Motion Carried. Leroux made motion. Brunotte seconded, to approve the minutes for the special City Council meeting of April 13, 1994, as submitted. All aye. Motion Carried. Miron made motion, Brunotte seconded, to approve the claims for April 18, 1994, in the amount of $51,971.43. All aye. Motion Carried. OFF-SITE GAMBLING PERMIT (HUGO LIONS CLUB) The Hugo Lions Club applied for a Minnesota Lawful Gambling Permit to conduct a raffle, sell pull tabs, and conduct other lawful gambling at the Hugo Park, 5524 Upper 146th Street during Good Neighbor Days, June 4, 1994. Staff recommended approval of the permit. Stoltzman made motion, Miron seconded, to approve the off-site gambling permit for the Hugo Lions Club to conduct a raffle, sell pull tabs, and conduct other lawful gambling at the Hugo Park on June 4, 1994. All aye. Motion Carried. LEASE AGREEMENT (HUGO LIONS CLUB) The Hugo Lions Club requested to lease 48 sq. ft. of the City park, 5524 Upper 146th Street for charitable gambling activities during Good Neighbor Days on June 4, 1994. Activities will include a raffle and the sale of pull tabs. Staff recommended approval of the lease agreement. Miron made motion, Brunotte seconded, to approve the Lease Agreement for the Hugo Lions Club to conduct charitable gambling at the Hugo City Park during Good Neighbor Days on June 4, 1994. All aye. Motion Carried. City Council meeting of April 18, 1994 Page 2 JIM FURE (WASHINGTON COUNTY SHERIFF'S DEPT.) The Washington County Sheriff's Department has appointed Sergeant Jim Fure as liaison officer to the City of Hugo. Sergeant Fure appeared before the Council to introduce himself and explain his duties as liaison officer. The Council suggested that the Sheriff's office prepare an annual report outlining types of crime in Hugo to determine if there is a pattern. CULVERT REPLACEMENT REQUEST (PARKER) Mr. Jerome Parker, 12866 Ingersoll Avenue, requested that the City realign a drainage culvert running under Ingersoll Avenue to move the flow of water from the center of his property to the property line adjacent to 12930 Ingersoll Ave. The adjacent property owner, Richard Ophus, has agreed to the realignment. The Council considered this request on April 4, 1994 and tabled action pending further study. Mr. Parker appeared before the Council to explain the request. Administrator MUSeL15 stated that there would be a benefit to the City, which is needed to expend City funds. Miron made motion, Barnes seconded, directing the City Engineer to review Mr. Parker's request, and have the culvert realigned, if necessary. All aye. Motion Carried. HOME REQUEST (TRETTEL) Marilyn D. Trettel, 1412 Andover Blvd., Andover, Minnesota requested that the City of Hugo allow construction of a new home at 9446 130th Street while occupying the present home on site. The present home will be converted into a storage building for grain, seeds, tools, etc. upon completion of the new home. Miron made motion, Barnes seconded, to approve the request of Marilyn Trettel allowing construction of a new home at 9446 130th Street while occupying the present home on site. Approval is subject to the following conditions: 1. The applicant submit a $3,000 performance deposit in the form of a cash deposit at the time the building permit is obtained to ensure the existing residence is vacated within 60 days of issuance of the certificate of occupancy of the new structure. If the property owner fails to vacate the existing home within the designated period, the $3,000 deposit shall be forfeited to the City and the funds used to bring the property into compliance with City ordinance. 2. Upon occupancy of the new home on the parcel, the existing building be designated as a farm accessory building. 3. If, at any time in the future, the property wishes to use the existing house for human habitation, the property owner will need t subdivide the parcel in conformance with the ordinance. All aye. City Council meeting of April 18, 1994 Page 3 IMPROVEMENT PETITION (FARNHAM AVENUE Mr. Dan Eldridge, 5212 130th Street, and Judd Jackson, 5118 130th Street, have submitted a petition under Chapter 429 for the improvement of Farnham Avenue from the north line of 130th Street to the north line of Parcel 93030-2010, by construction of bituminous paving, concrete curb and gutter, and municipal sewer and water. Mr. Eldridge and Mr. Jackson own 100% of the property abutting the requested improvement. Though a public easement is in existence for a portion of the street, the project amounts to new construction and the developers are requesting the City share in the cost of improving the street. Leroux made motion, Miron seconded, Monday, May 16, 1994, 7:05 PM, for an improvement on Farnham Avenue. All aye. Motion Carried. EAW PETITION (WOODS OF BALD EAGLE) to schedule a public hearing for the purpose of consideration of making The Environmental Quality Board and the City of Hugo have received a petition from property owners adjacent to the proposed development known as WOODS OF BALD EAGLE, asking for the preparation of an Environmental Assessment Worksheet for the project. The Hugo City Council considered the petition on April 4, 1994, and directed the City engineer to review the petition and make a recommendation to the Council whether an EAW is required. A report, prepared by Mr. Peter Willenbring, OSM, was provided to the Council with a recommendation that a discretionary EAW be prepared for this subdivision. Miron made motion, Leroux seconded, that the City will require a discretionary EAW for 46 acres proposed for development by Grace Development Corporation, to be known as WOODS OF BALD EAGLE. All aye. Motion Carried. TRAFFIC STUDY (WHITE BEAR MEADOWS) On April 4, 1994, the Council considered a preliminary plat identified as WHITE BEAR MEADOWS. Action on the plat was tabled subject to a traffic engineering study for the development to be performed by the City Engineer. A report on the study was provided to the Council for their review. A lengthy discussion continued relating to drainage and a second access for the project. Developer Jack Kornovich, agreeing that a second access was necessary, suggested that the City approve 25 homes, and when a second access is acquired, approve the balance of the development. Administrator Museus felt that a meeting of two Council members, the developer, the City Engineer, and himself could resolve issues raised by residents and the Council. Leroux made motion, Brunotte seconded, that the City postpone action on WHITE BEAR MEADOWS to allow time for the developer, staff, City engineer, and Council members Barnes and Miron to meet and resolve issues. A recommendation to be provided to the full Council for their approval. All aye. Motion Carried. Citi/ Council meeting of April 18, 1994 Page 4 Brunotte made motion, Barnes seconded, that the City of Hugo accept the traffic study for WHITE BEAR MEADOWS, as prepared by City Engineer, Joel Dresel. All aye. Motion Carried. (COUNCIL MEMBER BARNES LEFT THE MEETING AT 9:00 PM.) STREET DESIGN (DUCK; PASS) On February 7, 1994, the Hugo City Council approved the preliminary plat known as DUCK: PASS, located in the S 1/2 of the NW 1/4 in the N 1/2 of the SW 1/4, T31, R21W. As part of this approval, the Council reiterated the City's policy to require concrete materials in the construction of curb and gutter. Mr. Dan Dolan, project developer, is requesting the Council reconsider the use of concrete curb and gutter given the development's rural nature, large lots, and the high cost of concrete curb and gutter. As a rural development, the City does not require curb and gutter on the streets proposed. It is the staff's opinion that where curb and gutter are necessary as part of street design, that concrete materials be used in order to avoid the near-term replacement of the curb and gutter and the resulting assessments on the future home owners. Staff saw no objection to removing the curb -and gutter from the project's design, given engineering review shows that it is not necessary to control storm water or erosion. Attorney stated, if approved, he would change the Developme► Agreement to reflect a rural section road. RESOLUTION (TRAFFIC SIGNAL AT COUNTY RD 8 AND HIGHWAY 61) An agreement between MNDOT, Washington County, and the City of Hugo regarding future maintenance of the traffic signal to be place at C.R. 8 and Highway 61, was approved by motion by the Hugo City Council on April 4, 1994. MNDOT has requested that this approval be made by resolution. Stoltzman made motion, Miron seconded, to adopt RESOLUTION 94-7, A RESOLUTION APPROVING AN AGREEMENT WITH MNDOT FOR THE INSTALLATION OF A TRAFFIC CONTROL LIGHT AT HIGHWAY 61 AND COUNTY ROAD S. All aye. Motion Carried. 1994 PARK MAINTENANCE Mr. Floyd Laska has indicated a willingness to continue maintaining city parks during 1994, with no increase from 1993. The current rate for Mr. Laska is $25.00 per hour, including machine for grass cutting, and $15.00 per hour for general maintenance. Staff recommended approval of the contract, as proposed. City Council meeting of April 18, 1994 Page 5 Stoltzman made motion, Miron seconded, that the City of Hugo hire Floyd Laska to maintain City parks for the year 1994, at a rate of $25.00 per hour, including machine for grass cutting, and $15.00 per hour for general maintenance, effective April 18, 1994. All aye. Motion Carried. JOINT MEETING WITH LINO LAKES The City of Lino Lakes has indicated a preference for April 20, 1994 for the joint meeting with the Hugo City Council. Staff recommended recessing the April 18th meeting to 7:0UPM, April 20, 1994, at Trout Air, 14536 W. Freeway Drive, Forest Lake. Stoltzman made motion, Brunotte seconded, that the City Councils of Lino Lakes and Hugo hold a joint meeting of April 20, 1994, 7:00 PM, at Trout Air, 145.6 W. Freeway Drive in Forest Lake. All aye. Motion Carried. MISCELLANEOUS Mayor Stoltzman stated that he will be meeting with a representative of the U.S. Post Office, along with the City Administrator, to help find a new location for a Post Office in Hugo. The Council will be kept informed of their progress. Miron made motion, Leroux seconded, to recess tonight's meeting at 10:00 PM until April 20, 1994, 7:00 PM, at Trout Air in Forest Lake, MN.
