Leroux made motion, Stoltzman seconded, to approve the minutes for the
City Council meeting of May 2, 1994, as submitted.

Barnes made motion, Leroux seconded, to approve the minutes for the City
Council meeting of May 16, 1994, as submitted.

1994, in the amount of $24,791.99.

ON -SALE BEER LICENSE BOBBER ' S BOATS AND BAIT)
Mr. Robert McElmury, doing business as Bobber's Boats and Bait. 4444 129th
Street, has requested renewal of his 3.2 beer license. Proof of the
required insurance has been provided. Staff recommends approval of the
license. Mr. Elmury has also requested issuance of a cigarette license
for his business at the above address. Staff recommends approval of the
license.
Miron made motion, Leroux seconded, to approve the On -Sale 3.2 beer
license for Robert McElmury DBA Bobber's Boats and Bait, 4444 129th Street
North, Hugo, MN.

VARIANCE REQUEST (EBERT)
Mr. Joel Ebert, 14770 Geneva Avenue, requested a variance to construct a
garage 4' closer to Geneva Avenue than his residence. His property is
bounded on three sides by City streets. The Board of Adjustments
considered his request on May 25, 1994, and recommended approval of the
variance.
Leroux made motion, Stoltzman seconded, to approve the variance request of
Joel Ebert, 14770 Geneva Avenue, to construct a garage 4' closer to Geneva
Avenue than the principal residence.

VARIANCEREQUEST (VANDER TLT).
Greg Vanderbilt, 9161 125th Street, applied for a variance to construct a
accessory structure closer to the road than the principal residence. The
Board of Adjustments considered his request of May 25, 1994, and
recommended approval of the variance.
Miron made motion, Brunotte seconded, to approve the variance request of

REZONING REQUEST �F.A_MSTE>)T_)_
Harold and Nancy Bramstedt, 6104 Egg Lake Road, applied to rezone
approximately 20 acres located in the NW quadrant of the intersection of
Egg Lake Road and Goodview Avenue, from SFE to SFU. The Hugo Planning
Commission held a public hearing on May 25, 1994, and recommended approval
of rezoning since the property lies within the City's MUSA. Municipal
sewer and water are readily available to the site, and the area adjacent
to the property of the proposed rezoning has been developed for denser
housing.
Stoltzman made motion to approve the rezoning request. Motion died for
lack of a second.
Council members Barnes, Miron, and Brunotte felt that the property was
appropriately zoned, because of adjacent wetlands and property serves as a
good transition area for abutting zoning districts.
Barnes made motion, Brunotte seconded, to deny the rezoning request of
Harold and Nancy Bramstedt, and direct the City Attorney to draft Findings
of Fact for the denial.

SUBDIVISION (DESLAURIES)
Ronald DesLauries, 2095 E..Larpenteur Avenue, Maplewood, MN., made
application to subdivide 20 acres into two 10 acre parcels. The property
is generally located east of Elmcrest and north of 129th Street, and is
currently zoned agriculture. The Hugo PC considered the request at their
meeting of May 25, 1994, and recommended approval of the subdivision
subject to conditions.
Miron made motion, Leroux seconded, to approve the subdivision request of
Ronald DesLauries to subdivide 20 acres into two 10 acre parcels, subject
to the following conditions:
1. Compliance with all requirements of the Rice Creek Watershed District
2. Approval by Washington County Public Health for septic systems site
for the two parcels.

SUBDIVISION(PARE I GAT)
Gerhardt Pareigat, 799_; 14�ith Street., applied for subdivision of 20 acres
into one 10 acre parcel and two five acre parcels. 'The area is currently
zoned RR2. The south eastern five acre parcel would be landlocked, and
the Pareigats have indicated their intention to sell this parcel to an
adjacent property owner for inclusion in his property description. The
Hugo FC considered this request at their meeting of May 25, 1994, and
recommended approval of the subdivision subject to conditions.
LerolAX made motion, Miron seconded, to approve the subdivision request of
Gerhardt Pareigat for the subdivision of 20 acres into one 10 acre parcel
and two five acre parcels, subject to the following conditions:
1. Parcel C be deeded to the adjacent property owner and included in
their parcel description in order to avoid creation of a landlocked
parcel.
2. Approval of the subdivision be subject to comments, restrictions, and
requirements of the RCWD, if any.
3. Parkland dedication fee be collected, in the amount of $500.00, for
Parcel B.

SPECIALUSE PERMIT _(RIVER CITY _ASPHALT1
The Hugo Planning Commission conducted a public hearing on May 25, 1994,
regarding an application for a SUP by Richard Carron and Darrel Hanson to
conduct mining operations on the NW 1/4 of the SW 1/4 of Section 23, T31N,
R21W, and the E 1/2 of the SE 1/4 of Section 23, T31N, R21W. The PG
recommended approval of the SUP subject to the terms and conditions of the
Settlement Agreement between the City of Hugo, River City Asphalt, and
Hugo 2000, as recorded with the 10th Judicial Court, File No. C7-92-4225.
Stoltzman made motion, Miron seconded, to approve the Special Use Permit
for Richard Carron and Darrel Hanson to conduct mining operations on the
NW 1/4 of the SW 1/4 of Section 23, T21N, R21W, and the E 1/2 of the SE
1/4 of Section 23, T31N, R21W, subject to the terms and conditions of the

RICE LAME MEADOWS PHASE 2 (PUBLIC IMPROVEMENTS ACCEPTANCE)
Howard A. KUU5i5to Consulting Engineers, Inc., recommended that the City
accept the sanitary sewer and water main improvements in the Rice Lake
Meadows Phase 2 for operation and maintenance, and stated that the one
year warranty period for the improvements may begin on November 18, 1993,
the day of the final inspection of the project. Jim Merila, Merila and
Associates, had stated previously to the Administrator that there was some
confusion regarding acceptance of these improvements, and has requested
that the one year warranty period begin on the date of the City Engineer's
inspection of the project.

Barnes made motion, Miron seconded, to accept the sanitary sewer and wate

PRESENTATION (FETE WILLENBRING)
Mr. Willenbring updated the City Council on the status of the City's Water
Management Flan, and also discussed the project currently underway in the
City of Lino Lakes to review the Clearwater Creek drainage channel. A
workshop date will be decided at a later time.
199' AUDIT REPORT
Linda S. Graupman and James C. Fayette of Boyum and Barenscheer presented
the City Council their findings from the City's 1993 audit.
Stoltzman made motion, Barnes seconded, to accept the 1993 audit report
from Boyum and Barenscheer.
All aye. Motion Carried.
WASTE MANAGEMENT GRANT
The City of Hugo is eligible for a grant in the amount of $15,620 from
Washington County for the establishment, administration, and operation for
residential, curb side recycling activities in 1994. As the City is now
over 5,000 in population, the City is required, by State law, to establish
such a program. Given the availability of the grant money from Washington
County, and the legal need to establish a recycling program, the City
Administrator requested approval to advertise for a temporary recycling
coordinator to assist the City in establishing its program.
Miran made motion, Barnes seconded -authorizing the City Administrator to
advertise for a temporary recycling coordinator to'assist the City in
establishing a curb side recycling program.

FIRE DEPARTMENT FAY REPORT
Fire Chief, Jim Wisner, has requested that the City Council consider
paying fire fighters, on an hourly basis, for attendance at training
drills. Currently, the City pays a fixed stipend to fire fighters, with
over five years experience, who attend at least 75% of all scheduled
training exercises and meetings. The City Finance Director, Ron Otkin,
has reviewed the fire fighter pay policies from 21 metro suburbs, of under
10,000 population, to compare city pay practices for fire fighters. His
report was provided for Council consideration.

Miron made motion, Stolt man seconded, directing the Finance Officer, Ron
Otkin, to include paying fire fighters on an hourly basis for attendance
at training drills in the 1995 budget.

REQUEST FOR TEMPORARY HELP (PUBLIC UTILITIESZ
Roger Bacon, the City's Utility Superintendent, requested authority to
employ, on a temporary, as -needed basis, an individual to assist him in
his duties in operating and maintaining the City's sewer and water
system. He recommended that the temporary help be paid $7.00 an hour.
Staff recommended that Mr. Bacon be allowed to employ temporary help, from
time to time, with the approval of the City Administrator.
Stolt man made motion, Barnes seconded, to authorize employment of
temporary help, on an as -needed basis, to assist Roger Bacon in his duties
in operating and maintaining the City's sewer and water system. Rate of
pay to be set at $7.Ot) per hour.

CEMETERY ORDINANCE
The City Council reviewed a proposed ordinance regarding the City's
proposed participation and maintenance of the Walker cemetery. 'This
ordinance establishes a mechanism for the City to assist the Sunshiner's
4H Club in the care and restoration of the cemetery.
Leroux, made motion, Miron seconded, to schedule a public hearing for June
20, 1994, at 7:05 PM, to consider an ordinance regarding the City's
proposed participation and maintenance of the Walker cemetery.
All aye. Motion Carried.
WILD ANIMAL ORDINANCE
The City Attorney prepared a draft ordinance regulating the keeping of
wild animals in the City of Hugo. The ordinance prohibits the keeping of
any wild, dangerous, or nondomesticated animals within the corporate
limits of the City, except as specifically permitted by the ordinance.
Miron made motion, Brunotte seconded, to table this matter to allow time
for the City Attorney to make revisions to the ordinance, as requested by
the Council.

FINDINGS OF FACT:___( WOODS OF BALD EAGLE REZONING)
On May 16, 1.994, the City Council denied the application of Grace
Development Corporation to rezone certain property located south of 130th
Street in Section 31, from SFE to SFU. The City Attorney was directed to
develop the written Findings of Fact Substantiating the Council's action.
Barnes made motion, Miron seconded, to approve the Findings of Fact, as
prepared by the City Attorney, substantiating Council action in denying
the request. of Grace Development Corporation to rezone certain property
located south of 130th Street in Section 31, from SFE to SFU.

1994-1996 STREET MAINTENANCE CONTRACT
The Council reviewed the Agreement between the City of Hugo and Washington
County Public Works Department for maintenance of the City streets for the
period July 1, 1994 to June .(), 1996. Washington County requested a
two-year contract, in lieu of the annual Agreements previously entered
into, as a method of reducing the time and effort involved in contract
administration. The Agreement, as presented, represents no change to the
Agreement currently in effect between Washington County and the City of
Hugo. Labor rates are, as in the past, subject to the County's collectiv
bargaining process. Staff recommended approval of the Agreement as
presented.
Leroux; made motion, Stoltzman seconded, to approve the 1994-1996 Road
Maintenance Agreement between the City of Hugo and Washington County
Public Works, and authorize the Mayor to sign said Agreement on behalf of
the City.

1994 STREET GRAVELING PROJECT
The Council reviewed an advertisement for bids for the City's annual road
graveling project. Staff requested approval to advertise for bids to be
received on July 8, 1994.
Miron made motion, Leroux; seconded, to advertise for bids for the annual

1994 SEALCOAT PROJECT
Based on prior Council action, the City of Hugo entered into an Agreement
with Washington County and Allied Blacktop for the sealcoating of certain
City streets. Based on the bid-price received from Allied Blacktop, this
project is expected to cost the City $32,330, and the work will be
performed on June 15, 1994, or shortly thereafter, depending on the
weather. No action was required on this matter.

ALLEGATIONS OF' M I SCONDUC ]" (FIRE DEPARTMENT "
Allegation=_ have been made regarding misconduct by a member of the Hugo
Volunteer Fire Department. These allegation=_ have been investigated by
the City Administrator, and it is his opinion that the allegations may
have some findings in fact. Staff recommended that the City Council
establish a date and time to conduct a disciplinary hearing for the
subject fire fiqhter.
Miron made motion, Lerou;; seconded, to schedule a disciplinary hearing for
June 27, 1994, at 7:30 PM, to review allegations of misconduct by a member
of the Huqo Volunteer Fire Dept.

Leroux made motion. Miron seconded, authorizing the City Administrator to
hire an administrative law judge to hear evidence at the disciplinary
hearing of June 27, 1994, at a rate of $80.00 per hour.

PLANNING COMMISSION VACANCIES
Due to recent resignations, there are two vacancies on the City's Planning
Commission, with one term ending 12/31/95 and the other 12/31/96.
Advertisement of the vacancies was made, with one application submitted by
Sandy Malaski, 8+51 140th Street. Mrs. Malaski served as a chair for one
of the Comprehensive Flan subcommittees, and is recommended for the
position by Planning Commission Chairperson, Theodora Peltier.
Miron made motion, Leroux; seconded, to appoint Sandy Malaski to the Hugo
Planning Commission, for a term to expire 12/31/96.
All aye. Motion Carried.
MISCELLANEOUS
City Engineer, Joel Dresel, stated that he has reviewed the drainage plan
for Charles Lowell, relative to construction of a building in the Bald
Eagle Industrial Park, and it meets with his approval.
The City Administrator informed the Council of the dates that he will be
at National Guard camp and his scheduled vacation in July.
The City Attorney updated the Council on the status of the City's receipt,
by forfeiture, of a 1990 Harley Davidson motorcyle.
Councilman Leroux, suggested that the City establish a policy regarding
City participation in the infrastructure of commercial and industrial
development in order to clarify the City's objectives and level of
participation.

The COunci.l again disci..issed the hiring of a maintenance Supervisor and jol.
description for inclusion in the 1995 budget.
Jim Breviq addressed the Council regarding the dike and drainage easement
located on his property. City Engineer Joel Dresel is doing an
investigation into this matter, and will make a report when he had
determined the legal level of the pond.
Harley Johnson, Jr., presented the Council with a history of his sod
business because of concerns he has with the proposed development known as
White Bear Meadows, and its impact on his business.
