PRESENT: Leroux, Miron, Stoltzman City Administrator, Robert MUseus City Attorney, Greg Galler Citi Engineer, Joel Dresel Citi Clerk. Mary Ann C.reaoer ABSENT: Debra Barnes and Bernard Brunotte Miron made motion, Stoltzman seconded, to approve the minutes for the City Council meeting of June 6, 1994, as submitted. All aye. Motion Carried. Miron made motion. Leroux seconded, to approve the claims for June 2(). 1994, in the amount. of $13,469.90. All aye. Motion Carried. PUBLIC HEARING . (WALh,:ER CEMETERY) A public hearing was held to consider adoption of an ordinance providing for the improvement, maintenance, and regulation of the Walker Historic Cemetery. The public hearing was called to order and Teddy Peltier inquired as to why the name had been changed. She was informed that the Walker family was the first to be buried there, and it was considered appropriate to attach their name to the cemetery. There were no other oral or written comments. Leroux made motion, Stoltzman seconded, to adopt ORDINANCE 94-292. AN ORDINANCE PROVIDING FOR THE IMPROVEMENT, MAINTENANCE, AND REGULATION OF THE WALKER CEMETERY. VOTING AYE: Leroux, Miron, Stoltzman Motion Carried. Miron made motion, Leroux seconded, directing staff to transfer ownership of the property and have it platted. All aye. Motion Carried. PUBLIC HEARING (ATP*.INSON) A public hearing was held to consider the request of Dean Atkinson, 1+542 Goodview Avenue, to renew his permit to mine gravel from a 40 acre parcel located in SW 1/4 of Section 23, T31N, R21W. The City has a current, site -restoration plan on file, and staff recommended approval of the Permit, subject to security in the amount of $17,500 to assure reclamation of the property, and provision of proof of insurance. Miron made motion, Leroux seconded, to approve the Mining Permit for Dean Atkinson, subject to conditions of previous permits. Staff was directed City Council meeting of June 1.994 P a a e to review City ordinances regarding allowing rock: crushing as part of the Mining Permit. All aye. Motion Carried. FINDINGS OF FACT (BRAMSTEDT REZONING On June 6, 1994, the Hugo City Council denied an application made by Harold and Nancy Bramstedt to rezone approximately 20 acres located in the north east quadrant of the intersection of Goodview Avenue and County Road BA from SFE to SFLJ. Per Council direction, the City Attorney prepared Findings of Fact to Outline the reasons for denial. Leroux made motion, Miron seconded, to accept the Findings of Fact, as drafted by the City Attorney, outlininq the reasons for denial of the Harold and Nancy Bramstedt rezoning request. All aye. Motion Carried. WILD ANIMAL ORDINANCE The Council considered a draft ordinance, prepared by the City Attorney, on June 6, 1994. The ordinance cited regulations for control and maintenance of wild animals in the City of Hugo. The Council expressed concerns regarding the definitions used for wild animals in the draft ordinance, and the City Attorney prepared a revised ordinance for Council consideration. After hearing PLAblic concerns expressed from the floor, it was determined revisions would be necessary to limit the impact of the ordinance to only those animals which could be a public safety hazard to the community. 'The City Attorney is to review State and Federal policies and provide a recommendation to the Council. BALD EAGLE AREA ASSOCIATION REQUEST The BEAR seeks to control the debris left on Fuld Eagle Lake following the ice fishing season through regulating the construction and maintenance of ice houses on the lake. The Association requested that a Council member from the City of Hugo be appointed to work with a committee, made up of representatives from each municipality adjacent to the lake and the DNR, to develop these regulations. Leroux; made motion, Miron seconded, to appoint Councilman Brunotte as Hugo's representative. All aye. Motion Carried. 1994 CRACK SEAL PROGRAM Washington County has entered into a contract with the Bergman Companies, Inc., for crack filling of county roads. The contract price of $0.87 per pound of material may be extended to the City of Hugo. Included for Council consideration was a price estimate and separate report from the City Engineer regarding the crack filling of 165th Street. Stoltzman seconded, approving the Agreement between the City of Hugo and Bergman Companies for crack filling of certain City roads. All aye. Motion Carried. LAKE AIR ESTATES DRAINAGE CORRECTION RECOMMENDATION The City Engineer reviewed the report prepared by TKI'DA, as well as information from Howard Kuusisto, regarding the correction of drainage problems in the area of the Lake Air Estates subdivision. Mr. Dresel reviewed his recommendation with the Council. Mr. DeYoung, a resident of Lake Air Estates, suggested that the Council survey residents about how they would like to have the problem resolved. Miron made motion, directing staff to send notices to residents, impacted by the proposed drainage improvement in the area of Lake Air Estates, of an informational meeting for the purpose of answering questions regarding the project. All aye. Motion Carried. RICE LAKE PARK LEASE The New Heights Charter School of Stillwater, MN., submitted an offer for the lease of the Rice Lake Park building for a one-year period. The school would use the site for an environmental learning program. The City Administrator's analysis of the lease proposal was provided to the Council for their review. Dick Houde, President of the Charter School, addressed the Council explaining the school's curriculum, and answered Council questions. Miron made motion, Leroux seconded, to approve a one-year lease for use of the Rice Lake Park building by the New Heights Charter School, subject to the development of an acceptable lease contract under the following conditions: 1. The lease shall be for a one-year period, and any extension of the lease be subject to negotiation. 2. The building and facility is leased to the school in an "as is" condition. The City makes no warranty, specified or implies, for use of the facility in any manner by the school. 3. Any improvements required to the building for use by the school be done solely at the school's expense, and only with the approval of the Hugo City Council. 4. Joint use of the facility be specifically spelled out to include the City's authority to use the building for meetings, storage, and elections. :. Some space in the building be specifically set aside for use by the City for storage. 6. Any future lease of the facility to New Heights Charter School be subject to determination of full value, based on the school's actual use of the property. All aye. Motion Carried. City COUncil meeting of June ''Ci, 1.994 Page 4 SURFACE WATER MANAGEMENT WORKSHOP Based on discussions with Fete Willenbring of (ISM at the Council's last meeting, staff requests the Council to schedule a special meeting to consider the City's Surface Water Management Flan. Stoltiman made motion, Leroux: seconded, to schedule a special meeting of the Hugo City Council for July 25, 1994, at 7:30 PM, for the purpose of consideration of the City's Surface Water Management Flan. All aye. Motion Carried. MISCELLANEOUS The Mayor received a letter from a resident regardinq "street" problems and how he felt they should be remedied. The Mayor will represent Hugo on the White Bear Counseling Center's float in White Bear's ManitoU Days parade. The City received a letter from the U.S. Department of Commerce (Census) regarding the City's cost to hold a special census. Leroux made motion, Miron seconded, to approve the Agreement between the Bureau of Census and the City of Hugo, for the purpose of conducting a Special population census, and authorize payment of $18,400 to the Bureau to cover their costs for the census. All aye. Motion Carried. The Finance Director submitted a report regarding City funds invested in Piper Jaffray institutional government funds. 'These funds have been adversely affected by the increase in interest rates, and as a result, some investor=_ have experienced a loss in their investment in the fund. The City did not suffer any loss, and the Director will track: events as they unfold. The City Attorney updated the Council on the status of the Harley Davidson motorcycle, soon to be owned by the City. Jack Kornovich, White Bear Meadows, appeared before the Council regarding preliminary plat approval. Leroux made motion, Stoltiman seconded, directing the City Attorney and City Engineer review easement documents for the White Bear Meadows subdivision and be placed on the next Council agenda for preliminary plat approval. DISCIPLINARY HEARING At the request of the individual involved, the following action was taken: City Council meeting of June 20, 1994 Page 5 Stoltzman made motion, Miron seconded, to reschedule the disciplinary hearing originally set for June 27, 1994, for July 119 1994, at 7:30 PM, to review allegations of misconduct by a member of the Hugo Volunteer Fire Dept' All aye.
