PRESENT: Barnes, Brunotte, Stoltzman, Attorney Galler, Engineer Dresel, Administrator Museus, Carole LaBelle ABSENT: Leroux, Miron Motion made by Barnes, seconded by Brunotte to approve the minutes of July 5, 1994, as amended. All aye, motion passed. Councilmembers Leroux and Miron arrive. Motion made by Brunotte, seconded by Barnes to approve the Minutes of July 11, 1994, as amended. All aye, motion passed. Motion made by Leroux, seconded by Miron to approve the claims in the amount of $169,299.07. All aye, motion passed. VARIANCE REQUEST (LABUDA) Mr. Jerrold Labuda, 4809 180th Street, has requested a variance to construct a 24' x 34''detached accessory building closer to the road than the residence. The present zoning classification of the lot is conservancy, and the parcel consists of five acres. Mr. Labuda has indicated a need for the variance to avoid his septic system and to preserve trees on his property. The proposed accessory building will be located 280' from 180th Street and 145' from the closest side lot line. Motion made by Leroux, seconded by Miron to approve the variance request of Jerrold LaBuda, 4809 180th St., to construct a 24' X 34' detached garage on his property closer to the road than the principal residence. All aye, motion passed. 1994 GRAVEL BIDS The City of Hugo received one bid for its 1994 road graveling project. The bid was from Valley Paving in the amount of $5.210 per ton. This amounts to a 4% cost increase from the $5.00 per ton paid in 1993. River City Asphalt is a responsible bidder, has performed work for the City before, and the cost is within reason. Staff requests acceptance of the bid, and authority to enter into a contract with Valley Paving for 13,173 tons of Class 5 gravel, at a cost of $68,498. This includes an additional $4,921 for gravel on Henna Avenue and 165th Street, and 170th Street, that the Council had previously expressed an interest in graveling this year. Motion made by Miron, seconded by Brunotte to accept the 1994 gravel bid and direct the staff to enter into an agreement with Valley Paving to provide 13,173 tons of Class 5 gravel in the amount of $68,498.00. Council Minutes - July 18, 1994 Page 2 DEFIBRILLATOR PURCHASE The Hugo Volunteer Fire Department has received a donation from the Hugo Lions Club for the purchase of a defibrillator for the Department's rescue squad. In order'to use the machine, the Department will require training and certification, as well as access to a medical advisor. The cost of the machine, with a five-year service contract, is $6,179 from Space Labs, Inc., of Redmond, Washington. The training for use of the device will he provided by the St. Paul Ramsey Medical Center for $25.00 per person, or approximately $750.00 for the entire Department. St. Paul Ramsey will also provide a contract to provide a medical advisor for $300.00 per year, which will include "refresher" training for use of the defibrillator. The Fire Department requests approval to purchase the machine, and enter into a contract with the St. Paul Ramsey Medical Center for training and the services of a medical advisor. Administrator Museus stated that there would be no change in the City's insurance because of the purchase of the defibrillator. Ron Gray, 2nd Asst. Chief stated that no new radio equipment would be required for use of the machine and that when the defibrillator was in 4se Hugo contact White Hear Ambulance and they contact Ramsey Hospital. Motion made by Miron, seconded by Brunotte to approve the request of the Hugo Fire Department to purchase a defibrillator in the amount of $6,179, including a five year service contract and enter an agreement with St. Paul Ramsey Medical Center to provide training on the machine for $25.00 per person and provide a medical advisor at a cost of $300.00 per year. All aye, motion passed. Staff is directed to send a letter of thanks to the Hugo Lions Club for their contribution. ROCK CRUSHER POLICY During the recent renewal of a mining permit, the City Council expressed interest in clarifying the City's policy on the permitting of rock crushers as incidental uses to mining operations. Clarification is necessary regarding certain conflicting City codes. Administrator Museus prepared a resolution establishing a policy for the operation of rock crushers. Attorney Galler stated that any change to the code would have to be done by ordinance. Leroux made motion, seconded by Miron to establish a committee to study the rock crushing problem in the City. Council Minutes - July 19, 1994 Page 3 Motion made by Miron, seconded by Leroux to direct the staff to prepare an ordinance reflecting the Council's views on rock crushing, which then may be discussed at a public hearing. All aye, motion passed. PLAYGROUND EQUIPMENT DONATION The Hugo Lions Club has donated $3,000 to the City of Hugo for the purchase of additional playground equipment for the City park adjacent to the City Hall, and have recommended the purchase of three pieces of equipment at an installed price of $3,020. The City would also be required to potentially purchase protective surfacing material for the ground under the play structures for child safety. Administrator Museus raised the following issues regarding the playground equipment. One, that additional upgrades to the existing park were proposed when there has been a request for neighborhood parks and secondly, that there should be some design consideration for the installation of the equipment. Joel Dresel, offered to donate the services of OSM and their landscape architect to assist in the design and installation of the project. Motion made by Leroux, seconded by Miron to accept the donation from the Hugo Lion's Club of the playground equipment and to send a letter of thanks, and to accept the offer of OSM to assist in the design and installation of the equipment. All aye, motion passed. ICE FISHING ORDINANCE DISCUSSION Councilman Brunotte updated the Council on the activities of the joint committee studying the need for ice fishing regulations on Fuld Eagle Lake. The committee was requested by the Fuld Eagle Lake Association, and is comprised of members from the cities of Lino Lakes, Hugo, and White Bear Township. Vice President of the Fuld Eagle Homeowners Association, informed the council of the enormous amount of debris left on the lake from the ice shacks. The bulk of which was construction materials actually from the shacks themselves. White Dear Township proposed a ban on all permanent ice shacks for one year. Councilman Brunotte stated that the fisherman should not be blamed for all of the debris nor be categorized as "slobs". Mr. Rrunotte encouraged the Council to assist in a solution that would benefit all users of the lake. Council Minutes - July 18, 1994 Page 4 165TH STREET DRAINAGE DISCUSSION The Mayor has requested that discussion of the drainage problems on 165th Street and Highway 61 be placed on the agenda. Staff has been in contact with MNDOT-regarding potential alleviation of drainage concerns raised by residents and business owners in the area. Various options were discussed to resolve the drainage problems in the area. Joel Dresel stated he would research the problem and report to the Council on August 1, 1994 Motion made by Miron, seconded by Leroux to table this issue until August 1, 1994, at which time the engineer will provide additional information. All aye, motion passed. 1995 BUDGET PRIORITY WORKSHOP In preparation for development of the City's 1995 budget, staff requests that the Council schedule a workshop to discuss projects and budget priorities for the upcoming year. Motion made by Miron, seconded by Stoltzman to schedule a meeting date for August 8th, 1994, 7:30PM to discuss the City's budget. All aye, motion passed. Administrator Museus has received documents from Washington County regarding the recycling grant eligible to the City. In order to receive the funds, the City must commit to having a solid waste recycling program in place by December 31, 1994. Motion made by Leroux, seconded by Barnes to enter into an agreement with Washington County for recycling. All aye, motion passed. The City has received a premise permit application from the Stillwater Dead Broke Saddle Club which operates out of Woodloch Stables, to continue selling pull tabs at the Blacksmith.Lounge, 17205 Forest Blvd., Hugo. Motion made by Miron, seconded by Stoltzman to approve the premise permit application from the Saddle Stillwater Dead Broke Club to sell pull tabs at the Blacksmith Lounge, 17205 Forest Blvd. All aye, motion passed. Attorney Galler stated he would review the recommendations of Ms. Barnes for the proposed wild animal ordinance and provide the city with a revised ordinance. Motion made by Miron, seconded by Barnes to request staff to send a letter to the resident maintaining wild animals on their property informing them of the liabilities and dangers of maintaining such animals. Administrator Museus stated he has been in contact with MNDOT regarding the striping} regulation of the stop light and the crosswalk. on Highway 61 and 145th St. They have indicated that final markings and signal regulating would be done in the fall when the last layer of bituminous is installed. Staff was directed to request Washington County to install a "Dead End" sign on Flay Ave. at 147th and children playing signs in the area of the park.
