Barnes made motion, Miron seconded, to approve the minutes for the City
Council meeting of September 12, 19949 as amended'
All aye. Motion Carried.
Leroux made motion, Miron seconded, to approve the minutes for the special
Council meeting of September 12, 1994, as submitted.
All aye. Motion Carried. (COUNCILMAN BRUNOTTE ARRIVED AT 7:05 PM.)
Miron made motion, Leroux seconded, to approve the claims for September
19, 1994, in the amount of $32,856'03'
All aye. Motion Carried.
On September 6, 1994, the Hugo City Council considered the request of
Terrance and Josephine Young, 17396 Ingersoll Ave', to rezone 20 acres of
their property located on Ingersoll Avenue in Section 3, T31N, R21W, from
conservancy to agriculture. After consideration, the Council denied the
request for rezoning, and directed the City Attorney to prepare findings
of fact for the denial based on the Council's discussions.
Barnes made motion, Leroux seconded, to accept the Findings of Fact, as
prepared by the City Attorney, outlining the Council's reasons for denial
of the application of Terrance and Josephine Young to rezone their
property.

IN -PROGRESS REVIEW (REQ.YCLING: POLjCY).
Based on funding provided by the County, the City of Hugo hired Laurie
Mesera-Kerr, an administrative intern, to assist the City Administrator
and the Council in preparing a solid waste/recycling plan for the City of
Hugo. Such a plan is required by law. Mrs. Kerr appeared before the
Council with an explanation of the process she is using in developing the
required policies. She would like a focus group, comprised of citizens
from the community, to aid in development of the recycling and mandatory
garbage collection ordinances, and asked that the Council provide guidance
on individuals who may be interested in serving on such a committee.

BALD EAGLE LAK.*.E ACCESS
At the special Council meeting of September 12, 1994, the Council
requested that the issue of the Bald Eagle Lake access at 121st Street be
placed on tonight's agenda. There was a lengthy discussion regarding
safety conditions at the site, and some unwillingness to close the access
without establishing a new one.
Brunotte made motion, Miron seconded, directing staff to locate an
alternate site for access to Bald Eagle Lake, and provide this information
to the Council for consideration as to whether or not to close the 121st
Street access for winter use.

PROPOSED ONEKA ESTATES SUBDIVISION
Mr. Jack Kornovich, developer of the proposed Oneka Estates Subdivision,
appeared before the Council regarding the easements for a second, street
access to the site. Attorney Galler reviewed his report relative to the
submitted easement documents' There was then a lengthy discussion
regarding future development and roadways in the area. Mr. Kornovich
asked the Council if there was an ordinance requiring dual access for a
major subdivision, and the response was no. He also requested that the
three-year limit on the access easement remain in place, as requested by
Rosemary Linden.
Brunotte made motion, Barnes seconded, to amend the conditions of
preliminary plat approval for the development known as ONEKA ESTATES
(White Bear Meadows) to allow the developer to provide the City a
temporary, second road access for three years instead of the indefinite
period originally specified' All other concerns raised by the City
Attorney, in his letter of 9/16/94 regarding the easement, shall be met as
a condition of final plat approval.

DISCIPLINARY HEARING
The disciplinary hearing regarding allegations of misconduct made against
a member of the Hugo Volunteer Department was continued from September 6,
1994 to tonight's meeting. In order to complete consideration in this
matter, the continued hearing has been scheduled for 8:30PM.
Stoltzman made motion, Brunotte seconded, to recess from open City Council
meeting to closed City Council meeting. Pursuant to the provisions of
Minnesota Statutes 471.705, we close the public portion of this meeting
and adjourn into a closed session for a disciplinary hearing to consider
allegations or charges against an individual subject to our authority.

This meeting is called for the purpose of allowing the City Council to
deliberate and determine what type of discipline, if any, is appropriate
against Cheryl Istvanovich. Cheryl Ist.vanovich is an employee t: -•'f the City
of Hugo, employed as a fire fighter. The City Administrator provided the
Council with a summary of the case at issue, as follows:

Because of the previous motion of dismissal, no action was taken on the
other allegation of abusive language/insubordination, but the following
motion was made relative to that allegation:
Miron made motion, Leroux seconded, that based on the information
reviewed, discipline would be warranted against. Cheryl Istvanovich for
abusive language/insubordination, and a suspension from the Department,
for a period of 90 days, would be warranted.

DRAFT LIQUOR LICENSE ORDINANCE
The Council considered a draft revision to the City's liquor license
ordinance. The City's current liquor ordinance is somewhat convoluted and
difficult to administer. The proposed ordinance would allow for more
consistent administration, and update the City's liquor license policies
to current law. As the proposed ordinance would increase the fees for

licenses, the Cit; must provide current license holders 30 days written
notice before the hearing may be held on the change. staff recommended
the Council establish a public hearing to consider the revised liquor
license ordinance on November 7, 1994.

November- 7, 1994, at 7:05 PM, for the purpose of consideration of a draft
revision to the City's liquor license ordinance.

DRAFT ANIMAL_ CONTROL ORDINANCE
In April of this year, the Council received a draft animal control.
ordinance prepared by the City Attorney. Discussions of this ordinance
were delayed due to the potential of including exotic animals in the
ordinance. As exotic animals are not to be included .in this ordinance,
staff represented this ordinance to the Council for consideration. There
was general discussion regarding animal control, and .it was decided to
continue discussion of this matter, along with the following service
contract matter, at a future meeting.
ANIMAL CONTROL SERVICE CONTRACT
Since the .1988, the City of Hugo has contracted with Animal. Control.
Management., of White Dear Township, for animal control services. This
firm w.i.11 no longer be serving the community, as .itos contract has not
been renewed by adjacent communities. Mahtomed.i, White .Bear Township, and
other nearby communities changed their contract to Animal Control
Services, Inc. A proposed contract between the City of Hugo and Animal
Control. Services, Inc., was provided to the Council their consideration.
COUNCIL_ WORKSHOP (NEW POST OFFICE)
At the Council meeting of September b, 1994, the Hugo City Council
established a special meeting for Wednesday, September 21, 1994, 7:0PM,
to consider and discuss the location for the post office. !Marvin L.aVal.le
suggested that the Council consider the property located north of 147tH
Street. and Flay Avenue in their location process.
