PRESENT: BrUnotte, Miron, Stoltzman City Administrator, Robert MUseUS City Attorney, Greg Galler City Engineer, Joel Dresel City Clerk, Mary Ann Creager ABSENT: Debra Barnes Councilman LeroUX arrived at 7:10 PM. Miron made motion, Stoltzman seconded, to approve the minutes for' the City Council meeting of November 21, 1994, as submitted. All aye. Motion Carried. Brunot.te made motion, Miron seconded, to approve the minutes for the City Council meeting of November 29, 1994, as submitted. VOTING AYE: Brunotte, LerolAX, Miron ABSTAINED: Stoltzman Motion Carried. ( COON(; I LMAN LEROUX ARRIVED AT 7:10 PM) . Miron made motion, LerolAX seconded, to approve the claims for December 5. 1994, in the amount of $126,069.34. All nye. Motion Carried. LIQUOR LICENSE ORDINANCE On November 21, 1994, the City Council considered adoption of an amended Liquor License Ordinance, which was subject to a public hearing on November 7, 1994. At the request of the liquor license holders, the Council table action on the proposed ordinance until tonight's meeting. The liquor license holders were unified in their objection to any increase in the fee for an on -sale liquor license. They also questioned the closing_ time on Sundays when food is sold at the establishment, and the hiring of an 18 year old to sell liquor. The Administrator explained the relationship between the license fee and costs covered by the fee. Leroux: made motion, Miron seconded, to table action on the proposed ordinance to allow time for staff to research State law relative to Sunday closing and the selling of alcohol by an 18 year old. There will be no increase in liquor license fees over those established by current ordinance. VOTING AYE: LeroU:;, Miron, Stoltzman VOTING NAY: Brunotte Motion Carried. WASTE MANAGEMENT ORDINANCE The Hugo City Council conducted a public hearing on November 21, 1994, to consider adoption of a Solid Waste Management Ordinance regulating the City Council meeting of December 5, 1994 Paae 2 collection and disposal of municipal solid waste in the City of Hugo. Due to certain outstanding issues regarding the responsibility of farm waste, the Council tabled action on the proposed ordinance until tonight's meeting. The Council discussed changes to the proposed ordinance as follows: include an alternative farm waste clause in accordance with M.S. 17.1.35, reference burning ordinance, allow six months for haulers to establish route, and add water softeners to Major Appliance definition. Leroux made motion, Miron seconded, that after amendments are made to the proposed ordinance, to adopt ORDINANCE 94-293, AN ORDINANCE AMENDING CHAPTER 120 OF THE HUGO CITY CODE REGULATING AND LICENSING THE COLLECTION, STORAGE, AND DISPOSAL OF GARBAGE, OTHER REFUSE, RECYCLABLES, AND YARD WASTE. VOTING AYE: Brunotte, Leroux. Miron, Stoltzman Motion Carried. MUNICIPAL STATE AID RESOLUTION The Council considered a resolution, prepared by the City Engineer, applying for Municipal State Aid Street funds. Miron made motion, Brunotte seconded, to adopt RESOLUTION 94-23, A RESOLUTION DESIGNATING A MUNICIPAL STATE AID STREET SYSTEM FOR THE CITY OF HUGO. VOTING AYE: Brunotte, Leroux, Miron, Stoltzman Motion Carried. 1995 BUDGET RESOLUTION The Council considered a resolution establishing the City's budget for 1995. The budget has been amended, at Council request, to include a new account for the maintenance and upkeep of the old school house located on County Road 4, funded in the amount of $5oO.oO. Miron made motion, Leroux seconded, to adopt RESOLUTION 94-24, A RESOLUTION APPROVING THE GENERAL FUND BUDGET FOR THE 1995 FISCAL YEAR. VOTING AYE: Brunotte, Leroux, Miron VOTING NAY: Stoltzman Motion Carried. 1995 PROPERTY TAX RESOLUTION The Citi/ of Hugo conducted its Truth in Taxation hearing on November 29, 1994, and the Council received numerous public comments on the proposed tax levy and property taxes in general. The Council considered a resolution establishing the City's property tax levy for 1995. Leroux made motion, Prunotte seconded, to adopt RESOLUTION 94-24, A RESOLUTION APPROVING PAYABLE 1995 TRUTH IN TAXATION LEVY CERTIFICATION. VOTING AYE: Brunotte, Leroux, Miron, Stoltzman Motion Carried. City Council meeting of December 5. 1994 Page _ AUTOMOBILE CLAIM ACTION On September 6, 1994, the City Council authorized the City Attorney to commence legal action to obtain possession of a 1984 Chevy Blazer by forfeiture due to the owner's repeated convictions of driving while under the influence of alcohol. The City of HLAQO recently received notice from Granger's Inc., that $973.58 is due as of 11/30/94 for storage of the vehicle. Given the low potential resale value for the Blazer, staff questioned whether it is financially prudent to continue with the forfeiture action, and requested Council guidance. Staff was directed to have the vehicle moved to the Sheriff's impound lot. It was determined that now, and in the future, any vehicle being held for forfeiture be stored at that site. LETTER OF CREDIT REDUCTION (DUCK PASS DEVELOPMENT) Lerous: made motion, Miron seconded, that the letter of credit for the development know as DUCK PASS be reduced to $84,474.67. All aye. Motion Carried. Dan Dolan, Duck Pass developer, requested special consideration to allow snowplowing of roads in the development prior to City acceptance. The Jeff Barbour family resides within the development, and school buses are unable to gain access to their residence. Attorney Galler stated that the roads are private and the City cannot .legally plow them. He stated that it could be done if the owner agreed to pay for the service. It was suggested that, in the future, this concern be addressed at the time the Development Agreement is drafted. Mir -on made motion, LeroUX seconded. authorizing staff to enter into a Contractual Agreement with the developer of DUCK; PASS for the purpose of plowing of roads within the development. All aye. Motion Carried. REPAIRS TO OLD VILLAGE HALL The City's building department inspected the site and submitted their findings for needed repairs to the building. Although the building is structurally sound, it was determined that between $25,000 and $5(),000 would be needed to bring the building into compliance with ADA and correct other problems, including well and septic. Miron made motion. LeroUX seconded, directing staff to start on a plan to preserve the old Village Hall by investigating grants available, obtain quotes for renovation, and establish long-range plans/use with community involvement. All aye. Motion Carried. AMENDMENT TO UNIFORM STREET NAMING AND PROPERTY NUMBERING SYSTEM The Council considered a letter from the Washington County Public Works Department regarding a proposal to change the naming Jamaca Avenue to City Council meeting of December 5, 1994 Page 4 Jamaica Avenue. Currently, the City of Hugo does not have any streets named Jamaca Avenue, but under the Uniform Street Naming and Property Numbering System, such a street could be developed in the City. It is the staff's opinion that usinq a more common spelling for a street name would be of benefit, and recommended adoption of an ordinance chanqe. Stolt man made motion, Miron seconded, to schedule a public hearinq for January 3, 1995, at 7:05 PM, to consider adoption of an Ordinance amending Chapter 2178 by changing the spelling of Jamaca Avenue to Jamaica Avenue. All aye. Motion Carried. PROPOSED JUVENILE CURFEW ORDINANCE The Metropolitan Area County Attorney's Association prepared a draft ordinance establishinq a juvenile curfew for individuals under 17 years of age. It is their belief that in order to make such a curfew effective in any community, that it needs to be undertaken on a region -wide basis. This would require that each county and municipality in the metropolitan area adopt the ordinance. 'The Association is concerned with the 14% increase in juvenile crime in 1994, and especially, the .increasing amount of violence directed at juveniles. A formal proposal for adoption of the ordinance is not being presented to the City at this time, but as this issue will likely need to be addressed in the upcoming year, the proposed ordinance was provided to the Council for their information. No formal action was required for this matter. UTILITY BILLING ABATEMENT REQUEST On November 7, 1994, the City Council received a letter from a resident requesting that the City adopt a policy abating sanitary sewer and municipal water charges when a resident is absent from their home for extended periods of time. Between the time this letter went out to the Council in their agenda packet and the Council meeting of November 7th, the City Finance Director reviewed past records of the City, and determined that the City had, indeed, abated water bills when the water service was disconnected at the curb. This is not a common request from the City, occurring only once in the last five years. As a precedence had been set, staff wrote a letter to the resident requesting the abatement, informing him of the City's practice. The Council has recently received an additional letter from this resident requesting that the Council take formal action on his request. After a discussion regarding a history of utility billing and how costs are determined, the following motion introduced: Miron made motion, LeroUx seconded, that the City, as a policy will continue charging for utility bills through the winter months during the absence of the property owner. A letter of explanation is to be sent to the resident requesting the abatement. ;i11 aye. Motion Carried. City Council meeting of December 5, 1994 Page 5 COMPREHENSIVE PLAN REVIEW Lerou>; made motion, Miron seconded, to schedule a joint meeting of the Hugo Planning Commission and City Council on December 21, 1994, at 7:30 PM, Rice Lake Park [wilding, for the purpose of discussion of progress made on the City's revised Comprehensive Plan. All aye. Motion Carried. HARDWOOD CREEK MAINTENANCE There was discussion on Rice Creek Watershed's maintenance of Hardwood Creek and placement of culverts along the creek within the City. Engineer Dresel will check on the following, and report his findings at the meeting of 12/19/94: 1. The elevation of certain culverts in Hardwood Creel:: to insure that they are set at an elevation that takes care of the drainage in the City. 2. That regulatory agencies have not established certain culvert elevations .in Such a manner as to change traditional patterns of drainage in the City. ADJOURNMENT Ler-OUX made motion.
