Bald Eagle Sportsman Assocciation RE: Special Use Permit MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSICN March 8, 1978 The public hearing to consider the request of Howard Moe for a Special Use Permit was called to order by Chairman Larry Ehret at 7:11 PM. !'RESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Koehler, Washington County, was also present. ABSENT: Peltier Mr. Moe has applied for a Special Use Permit to operate a used car sales and rental lot at 14057 Forest Blvd. The property is presently zoned Retail Business (RB). Mr. LaMotte was present, and clarified a statement he made at the previous meeting. He stated that the gas pumps were removed in September, 1977. The last time gas was pumped was in the latter part of 1975. Mr. Moe presented a site plan indicating the pxea proposed to be blacktopped. Concrete bumpers will be installed. Mr. Moe was certain on his hours of operation, but for sure he will be closed on Sundays. Mr. Moe also stated that the stored vehicles and other debris will be cleaned up as soon as possible. In the future, the area in the rear would be used to store cars that are.,4heed of a part. A cyclone fence will be installed along the rear property to prevent vandalism. McAllister stated that he did not want anything back there automotive, because the property abuts a residaztial area. carrell Granger asked if the Special Use Permit was only for a used car lot or was it also for a station and body shop facilities. Mr. Moe stated that there will be no major body work done, and only touch up paint jobs. Mr. Granger was required to follow state codes for painting work to be done on his premises. He felt it was unfair to allow them to operate without following all the regulations that he had to. (MRS. PELTIER ARRIVED AT 7:40 PM). The public hearing was c�nsed at 7:42 PM. Bruce Charpentier — Subdivision The public hearing to consider the request of Bruce Charpentier fora minor sub— division to divide one acre of land, and for a variance to allow for the use of a private 30' driveway for access to their property. The driveway would be used by the Charpentier's and the Pugh's. When the rest of the land is developed (7 acres), there will have to be negotiations between the developer and the land owners involved. The Charpentiers' will lave city sewer, but no city water. The public hearing was closed at 7:47 PM. The regular meeting of the Planning Commission was called to order at 8:17 PM, PREPSNT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Dan Koehler and Larry Irsfeld were also present. Motion made by Peltier, seconded by Peloquin, to approve the minutes of February 22, 1978, as presented. All aye. Motion carried. Hugo Planning Commission March 8, 1978 Page 2of5 Howard Moe — Special Use Permit Mr. Moe stated that in the future, he would like to engage in the renting of cars and pickup trucks. It was McAllister's opinion that painting was not allowed in a service station. Other members felt that touch up painting was acceptable. Motion made by McAllister to approve the request of Howard Moe for a Special Use Permit to operate a used car sales lot and a retail gas service station subject to the following conditions: 1. That all local, state, and federal codes be adhered to as far as retail gas business is concerned — to include facilities available to the public. 2. The retail gas station be connected to the city sewer system by August, 1978. (Application has been made for connection to public sewer, but it has not been installed.) 3. That all exterior storage behind the service station and in the rear yard area is not allowed. 4. That the 24' driveway on the south property line be closed by August, 1979• 5. Both entrances to property be 301 wide, hard surface. 6. The hard surface area be completed by August, 1979• 7. An irrevocable letter of credit, in the amount of $3,000.00, be provided to the city to cover the cost of the blacktopping. 8. Refer to Section 32A-3 B-89 — prohibiting general painting or paint jobs. Painting is not allowed. 9. Incidental body work to vehicles owned by the business is permitted. For lack of second, the motion failed. Motion made by Ehret, seconded by Greger, to approve the Special Use Permit for Howard Moe to allow for retail auto sales and retail auto rental, subject to the following conditions: 1. That the access and egress to the business have a minimum of 301 width driveway, hard surfaced. 2. That the area be blacktopped as proposed in the site plan submitted. 3. An irrevocable letter of credit in the amount of $3,000.00 be provided to insure blacktdpping by October 1, 1979. 4. That the public restrooms, as required by law, be connected to city sewer no later than October 1, 1978. 5. That minor body and paint work be allowed subject to all state and federal regulations or codes for work on vehicles owned by the business only. That the back area of the property be maintained in a neat and orderly fashion. 7. That no more than three (3) cars be allowed under Condition #6. 8. A performance bond in the amount of $5,000.00 be provided to insure that all regulations of state codes be met for above body work. to be returned upon satisfactory compliance with state regulations. 9. That the equipment and materials now stored on the property be removed by July 1, 1978. 10, The Special Use Permit is subject to annual review. 11. No more than eleven (11) cars allowed for exterior storage. There shall be no cars stored on the eastern 50' of the property. VOTING FOR: Peltier, Greger, Peloquin, Gillen, and Ehret VOTING AGAINST: McAllister MOTION CARRIED., Bruce Charpentier - Subdivision and Variance Motion made by Gillen, Seconded by McAllister, that the request for a variance by Bruce Charpentier be allowed subject to the restriction that the dwelling or other buildings be so located as to permit the additional 30' of roadway in the future and subsequent setback. This 30' driveway is to serve the existing resi- dents and the resident referred to in this application, and no more. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret MOTION CARRIED. McAllister made mot ion, seconded by Peloquin, that the request for a minor sub- division made by Fred Fulbright be approved as submitted. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret MOTION CARRIED, Bald Eagle Sportsman Association - Special Use Permit Mr, Al Perez, Minnesota Pollution Co,31trol Agency, was present to answer any questions of the Commission or the audience. LIW first comment was that, as of now, there are no state standards regulating the control of impulsive noise levels. Mike Prokosh, the club's president, was present and stated that he would like to ask for an ex- tension regarding the information asked for. Mr. Prokosh illustrated different methods the club had discussed to help for noise abatement. Mr. Perez stated that unless the facility was totally enclosed, noise barriers would eliminate only a small portion of the sound for people that were close by. Hugo Planning Commission March 89 1978 Page 4 of 5 Mr. Perez suggested that the Commission consider the following: 1. Limiting the load size and the number of shots. 2. Curfews 3. Hours of operations 4. Number of people using the facility ped In essence, Pair. Perez said that the R&A could not give any concrete standards, and it was up to the community to determine what they could live with. There have been some states that have set up impulsive noise standards, and Mr. Perez will forward these documents to City Hall. Mr. Perez gave several examples of decibels as they relate to every day living. He was also optimistic that some kind of standards re— lating to impulsive noise could be determined by the end of summer of this year, 1978. Mr. Prokosh stated that he had gone to the club's board with the Commission's ideas as to acceptable hours and days of operation. The board was reluctant to accept these new concepts, but he will again reiterate these proposals to them. Gillen felt that the Special Use Permit should be denied until the courts gave a ruling on the White Bear Rod & Gun Club. He felt the Commission should be looking at long range planning, and that Hugo should not have to have two gun clubs only one mile apart from each other. Chairman Ehret questioned the legality of such a proposal. He was not sure that if the Commission moved to deny, and the motion was upheld, whether they could reapply. It was also mentioned that there is a 60 day time limit to act on a Special Use Permit. Motion made by Gillen, seconded by Peltier, that the application by the Bald Eagle Sportsman Association for a Special Use Permit be denied until considerations on the White Bear Rod & Gun Club are resolved and then ask that the Bald Eagle Sportsman Association submit another application at that time. There should also be available regulations concerning impulsive noises from MPCA when both those items are determined. The Bald Eagle Sportsman Association should then reapply for a Special Use Permit. VOTING FOR: Peltier and Gillen VOTING AGAINST: Peloquin, Greger, McAllister, and Ehret MOTION FAILED. Motion made by Peloquin, seconded by McAllister, to table the matter until April 12, 1978, for time to obtain legal advice, and the club to get the information requested of them. Matter to be placed last on the agenda. VOTING FOR: Peloquin, Peltier, Greger, McAllister, and Ehret VOTING AGAINST: Gillen (because of time period) MOTION CARRIED. Hugo Planning Commission March 8, 1978 Page 5 of 5 Jim Husnik — Site Plan Motion made by McAllister, seconded by Gillen, to approve the site plan as presented by Mr. Hiusnik. A satisfactory perc test and septic system is to be provided. All aye. Motion carried. Mr. Jim Metry, 4696 126th Street, was present expressing his desire to fill the vacant position on the Planning Commission, Mr. Metry has some background in ar- chitecture, and is presently a salesman for Pella Windows. Motion made by Peloquin, seconded by Peltier, to submit the names of Art Thornquist, Dave Wielke, and Jim Metry to the City Council for their consideration to fill the vacancy on the Planning Commission.
