Bruce Charpentier RE: Subdivision 4, Robert McCullough RE: Special Use Permit " MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION February 8, 1978 The public hearing to consider the request of the Bald Eagle Sportsman's Association for a Special Use Permit was called to order by Chairman Ehret at 7:10 PM. PRESENT: Ehret, Peloquin, Peltier, Greger, and McAllister Dan Koehler, Washington County Planning, was also present. ABSENT: Rosenquist and Gillen The club presented the Commission with a site plan of their plans to curb noise problems for the future. At this point, the club is not financially able to imple— ment the desired goals. Mr. Charles Shubat inquired as towha.t the club is permitted to do under their existing permit. Mr. Ehret stated that the club has never had a Special Use Permit so there is nothing of record stating exactly what was permitted. Mr. William Peters, the club's attorney, arrived at 7:17 PM. Mr. Peters stated that the intended changes, as proposed, would not change the membership status nor the usage. The changes would be for noise reduction only. The changes are based on the ability to negotiate with the National Guard and U.S. Army Corps of Engineers to do the work. They have the equipment and manpower to move the large amounts of dirt as needed. Mr. Peters stated that the club's membership ranges from 175 to 225. Dr. Stephen Chapman,12833 Goodview Avenue, asked what the club's relationship was with the Army Corps of Engineers, and Mr. Peters stated that they have on occasion sought the area for target practice and small arms training. They have also done some project road work on the property. An Environmental Impact Statement was done some time in 1976 in relation to this road project. Chapman asked if the club had cleared any measurements with the Polliition Control Agency on noise control, and Mr. Peters responded "no". Chapman said that they would have to be cleared before any action r. -an be taken by the Planning Commission. He also stated his'objection to the club because of his close proximity. He felt that because of the increase in development in the area, the club no longer fits into the city's plans for the commu— nity. (MIKE GILLEN ARRIVED AT 7:45 PM). Mr. Peters stated that the club is planning on constructing noise bafflers on the rifle range. He also presented possible changes the club has considered to help in its relations with the community. 1. No shooting of firearms after 4:00 P. M. on Fridays. 2. No use of club facilities prior to noon on Sundays (except for requested exceptions). 3. Plant more trees for noise abatement 4. Permission from the city before anyone can use the range after dark. Mr. Chapman suggested that the Commission: 1. Grant no variance to the Bald Eagle Sportsman Association 2. If a variance is to be granted, do not do so until all state and federal noise problems are answered. Hugo Planning Commission Februaxy 89 1978 Page 2 of 5 3. If a variance is issued, have no shooting before noon, and shooting cease by 7:00 PM. No shooting on Saturday and Sunday. 4. Better policing of the area. 5. If variance is granted, should be granted for not more than one year. The public hearing for the Bald Eagle Sportsman Association was temporarily adjourned at 7:56 PM. The public hearing to consider the rezoning request of Oneka Hill Farms was called to order by Chairman Ehret at 7:57 PM. PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister ABSENT: Rosenquist Mrs. Shirley Nelson submitted a letter designating her son, Keith Nelson, as her spokesman. They would like to construct a general store in the Withrow area. The land is presently zoned RB, and they would like rezoning to CB. Mr, Harry Olson, an adjoining land owner, had no objection to the store, but was concerned about what might come in there if the business were sold. McAllister read the permitted uses in the zoning, and stated that all others would need a Special Use Permit. It was determined that a CB rezoning would be more advantageous as far setbacks was con— cerned. The public hearing was closed at 8:08 PM. A4J The public hearing for the Bald Eagle Sportsman Association was reopened at 8:09 PM. Mr. Shubat stated that he was concerned with the safety of the children in the area due to the increase in traffic from the club. Mr. Jim Tholen, 5867 148th Street, Hugo, stated that he lives in the city and he has the same traffic problems. Mr. Clifford Axelson, 12317 Goodview Avenue, stated that the proposed change for noise abatement will bring the shooting closer to his house. He feels that the club has accelerated its membership in the last 10 years. Mr. Axelson's biggest problem is with the noise pollution. Carl Schuneman, 5754 130th Street, indicated that 15 years ago he was instrumental in deciding that the club was a rifle range only, and not a shotgun facility. He is against the extension of the club into a shotgun faciltiy. Ann Fashingbauer, 12564 Goodview, asked if there was any restrictions for gun clubs as faras acreage, and Dan Koehler stated that they are only limited by zoning. Mr. Peters offered the following proposals: 1. Would like a Special Use Permit to continue use as a gun club. 2. Continue planting of trees (approximately 100 per year) 3. Cons truction of baffles 4. Continued maintenance of fencing and posting of visible signs. 5. Limit shooting hours from 8:00 AM to 8:00 PM, CDT, or until dusk, or whichever occurs first. 6. No shooting of firearms subsequent to 4:00 PM Friday until the next Saturday morning. 7. There would be no use of firearms prior to noon on Sundays (with the exception of 22 Sundays), when shooting would commence at 9:00 AM. 8. That no police department, military organization, or other civil organization use the facility without first -contacting the Hugo Police Department, and Hugo Planning Commission February 89 1978 Page 3 of 5 obtaining clearance through the City Council. The club will also continue to do everything possible to minimize noise. Mr. Bob Waller, 14310 Homestead Avenue, felt that the area was rapidly becoming ur- banized. Cities to the south and west of Hugo no longer permit the discharging of firearms. He felt they had the right idea. Mr. Dennis Schreifels, 13125 Goodview Avenue, a member of the club, stated that he had no problems with any noise from the club. He felt the club should be allowed to continue to operate. Mr. Foster Hinton, 2156 East Minnehaha, stated the club is only open to the public on Saturday and Sundays. Let the record show that a petition has been filed with the City of Hugo listing names and addresses of people opposed to the Bald Eagle Sportsman Association. The public hearing was closed at 8:54PM. The regular Planning Commission meeting was called to order by Chairman Ehret at 9:03 PM, PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister ABSENT: Rosenquist Motion made by Peltier, seconded by McAllister, to approve the minutes of January 25, 1978, after the following changes have been made: Page 1 line 6) - there were too many restrictions on the developer Page 1 Brevig) - Mr. Brevig has requested permission Page 2 2nd paragraph) - the motion is based on Planning Commission review of these specific zoning chapters Page 2 (last motion) - 2. The present building is considered an accessory building. 4. A building of this size 6. If at any time requested use of this property ceases Page 3 (Shubat motion) - denial of the subdivision by metes and bounds All aye. Motion carried. Bald Eagle Sportsman's Association - Special Use Permit Chairman Ehret stated that in lieu of the information presented at the public hearing he would suggest that the Commission obtain more info from the PCA and Ea regarding noise pollution. Further study should be done on the ruling from the Supreme Court on noise pollution Motion made by McAllister, seconded by Peltier, that the request for a Special Use Permit made by the Bald Eagle Sportsman's Association be tabled for further study by the Planning Commission regarding noise pollution. McAllister withdrew his motion. Gillen asked Mr. Peters how he felt about the nearby residents to the club and their problem. Basically, Mr. Peters stated that everything is relative. If you belong to the club, the noise would other you. He stated that if he lived close to the club, the noise would not bother ham. Gillen stated that he feels we are in a growing Hugo Planning Commission February 8, 1978 Page 4 of 5 community, and wondered what was going to happen in the future. He also felt that a resident caretaker could better police the property. Mr. Gillen also stated that it was his opinion that hunting was a thing of the past. Motion made by Peloquin, seconded by Greger, that the Bald Eagle Suortsman's Associa— tion matter be tabled for a decision as to how the Planning Commission is going to handle until the next meeting, February 22, 1978. VOTING FOR: Peloquin, Peltier, Greger, McAllister, and Ehret VOTING AGAINST: Gillen Motion Carried, Oneka Hill Farms — Rezoning McAllister made motion, seconded by Gillen, that the request of Oneka Hill Farms to rezone property from present zoning to CB be granted. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret Motion Carried. Peloquin made motion, seconded by Peltier, that the Planning Commission recommend approval of the variance request of Oneka Hill Farms for the blacktopping of their parking area. VOTING FOR: Peloquin, Peltier, Greger, McAllister, and Ehret (Gillen had left). Motion Carried, Bruce Charpentier — Subdivision Mr. Charpentier would like to subdivide one acre of land from Fred Fulbright's property in order to start construction of his home by April. The Charpentier's would be applying for a Minor Subdivision, and need a variance for 30' easement and no road frontage. Motion made by McAllister, seconded by Peltier, to set a public hearing for March 8, 1978, at 7:30 PM, to consider the application for minor subdivision of the Fred Ful— bright property. Application submitted by Bruce Charpentier, VOTING FOR: Peloquin, Peltier, Greger, McAllister, and Ehret Motion Carried. Robert McCullough — Special Use Permit Mr. McCullough presented the Commission with the changes in his site plan, as requested: 1. Widening of driveway 2. Service road behind the property 3. Screening 4. Holding tank for septic system The Planning Commission determined that the requested use would be permitted use in either Agriculture or Retail Business zoning districts. Hugo Planning Commission • February 8, 1978 Page 5 of 5 Motion made by Peloquin, seconded by McAllister, that the Planning Commission recommend approval of the Special Use Permit for Robert McCullough for a greenhouse and nursery, as per site plan provided. Subject to the following conditions: 1. Applicant provide a letter from a licensed sewage pumper stating that they have entered into a contract. The city is to be notified wikh`'contract is cancelled. ,a"•+W-N% 2. At such time as service lane has to be constructed, the driveway access to U.S. 61 be closed and said access be from the service lane. Blacktopping of parking area and driveway to be reviewed at that tiw. VOTOG FOR: Peloquin, Peltier, Greger, McAllister, and Ehret Motion Carried. Motion made by Peloquin, seconded by Greger, to place Howard Moe on the agenda. All aye. Motion carried. Mr. Ehret received a letter of resignation from Bob Rosenquist. Motion made by Peloquin, seconded by McAllister, that the Planning Commission accept the resignation of Mr. Rosenquist, and forward to the City Council. All aye. Motion carried. Mr. Howard Moe was present stating his intention to purchase the business of Ray LaMotte, Mr. Moe would like to have a used car lot, and would like to pump gasoline. The only servicing of cars that would be done, would be on the cars he would like to sell. Mr. Moe presented a site plan of his proposed plans. Mr. Moe was instructed to get an estimate for blacktopping and have it available for the public hearing. Mr. Koehler indicated the area that should be used in obtaining the estimate. Mr. LaMotte stated that gas had been pumped at the station at lease 10-12 months ago. McAllister disputed this statement. Motion made by Peloquin, seconded by Peltier, to set a public hearing for March 8, 1978, at 7:00 PM, to consider the request of Mr. Howard Moe for a Special Use Permit. All aye. Motion carried.
