Charles Shubat RE: Subdivision MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION January 259 1978 The public hearing considering the multi fmaily uses ordinance was called to order at 7:39 PM by Chairman Ehret. PRESENT: Ehret, Peloquin, Gillen, McAllister Larry Irsfeld, City Council, was also present. ABSENT: Peltier, Greger, Rosenquist Mr, James Brevig, 14120 Hyde Avenue, stated that it was his opinion that there Uz�r too many restrictions on the developer. The public hearing was closed at 7:45 PM. The regular meeting of the Planning Commission was called to order by Chairman Ehret at 8:17 PM. PRESENT: Ehret, Peloquin, Gillen, and McAllister ABSENT: Peltier, Greger, Rosenquist Motion made by Peloquin, seconded by Gillen, to approve the minutes of January 11, 19789 as presented. All aye. Motion Carried, MULTI—FAMILY USE ORDINANCE Motion made by McAllister, seconded by Gillen, that the Planning Commission recommends that the City Council adopt the proposed Multi—Family Use Ordinance. All aye. Motion carried. JAMES BREVIG — SPECIAL USE PERMIT Mr. Brevig?permission to construct a 50 x 100 pole barn on his property. The land is z ed RRII. The Ordinance Committee had been instructed to define the terms of the ordinance. Their report of January 10, 1978 is on record. Mr. Ehret stated that there is already an attached garage on the property, and Mr. Brevig stated that he does not feel that it is a garage, because it is not used as such. Mr. Ehret stated that there is already a pole barn on the premises. The Planning Commission proceeded with discussion relating to the Ordinance Committee minutes. (Greger arrived at 8:25 PM). Mr. Ehret stated that the Commission should keep in mind that there is no commercial use on an accessory building in RRII zoning. (Peltier arrived at 8:32 PM). Greger stated that he would not like to think that Hugo would not allow a home and a place for a hobby. Gillen said that he did not think the size of the building was good for RRII zoning. He felt the building should be kept the same size as the homes in the area. He also questioned when an accessory building, by size alone, become the principal structure. There is some point where a home is not the principal structure. Hugo Planning Commission January 259 1978 Page 2 of 4 JAMES BREVIG - cont. Mr. Brevig stated a list of the many things he would be storing in the proposed building, including many antique automobiles, personal autos, one 28' tandem car trailer, one 20' tandem car trailer, and one camping trailer 281. Peltier quoted ordinance 320-3(881) stating the maximum length of a recreational trailer is 200. Mr. Peloquin considered the problems that could occur if Mr. Brevig decided to sell. Motion made by McAllister, seconded recommend denial of the application construct a 50 x 100 pole barn. Let Commission review of these specific 1. 320-3, Bl 2, 320-3, B38 3, 320-3, B81 4. 320-4. F2 & 3 5. 320-7. Subd C by Peloquin, that the Planning Commission by Mr. James Brevig for a Special Use Permit to the record show the motion is based on Planning zoningi t77 - 1 : > r -av 320-3.B1(paragraph 1) - The Planning Commission does not feel the building meets purposes customarily incidental to those of the principal building. (paragraph 2) A use subordinate to the main use of the land. We don't feel that it is customarily incidental thereto. 320-3.B38 - self explanatory 320-3.881 - We do not find antique autos listed in that section, and Mr. Brevig's camper exceeds the 20' length limit specified 320-4. F2 & 3 - self explanatory 320-7. Subd C - self explanatory Please refer to the Ordinance Committee report of January 100 1978 Gillen stated that the Special Use Permit is for the building and not the hobby. Greger said he would rather see a building that would blend in with the area. Mr. Brevig stated that LaValle Excavating uses the same roads he would be using, and that he had signed signatures from adjoining property owners stating their approval of the building. Peloquin said that petitions have very little bearing on the matter. Motion made by Peloquin, seconded by McAllister, to amend the motion to include the following: 1. Mr,.,Bmig already has a house and garage. 2. "a building is considered an accessory building. 3. A building of this size is not compatible to the area. 4. A building othis size should be in a commercial or industrial zone. 5. Could cause e traffic problem with additional comings and goings in resi- dential area. 6. If at any time P use of this property ceases, the outcome could not be controlled. Hugo Planning Commission January 25, 1978 Page 3 of 4 VOTE ON AMENM ENT - VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret MOTION CARRIED. MOTION AS AMENDED - VOTING FOR: Peloquin, Peltier, Gillen, and McAllister VOTING AGAINST: Greger and Ehret MOTION CARRIED. CHARLES SHUBAT - SUBDIVISION Mr. Shubat has an application in to extend 130th Street eastward for 13201, and to subdivide 120 acres into 10 acre building sites. The City Engineer, Howard Kuusisto, has stated that the cartway follows the section line, but there is some question as to its width. Mr. Ehret suggested that Mr. Shubat submit in writing a request to have the road constructed in gravel according to the city's standards. It was deter- mined that the first part of the request (extension of 130th Street ) can be acted on, but more information will be needed on the subdivision request. Motion made by Ehret, seconded by McAllister, that the Planning Commission recommend approval of the application for extension of 130th Street for an additional 13201. The entire 2640' of 130th Street to be brought to 60' width and city, standards with appropriate turn around at the end. A T style is suggested. Further, that a variance for gravel surface be granted. The street is to be placed on the section line. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret MOTION CARRIED. Motion made by Greger, seconded by Gillen, that the Planning Commission recommend denial of the subdivision by metes and bounds. Mr. Shubat is to follow"subdivision procedure as specified in the subdivision ordinance. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret MOTION CARRIED, ROBERT MCCULLOUGH - SPECIAL USE PERMIT Motion made by Peloquin, seconded by Peltier, that Robert McCullough be placed on the agenda for discussion purposes. All aye. Motion carried. (Gillen refrained from discussion) Mr. McCullough was informed that no action would be taken by the Commission - discussion only. Mr. McCullough presented a site plan for his proposed nursery. The land is one acre located directly south of Sophie Arcand's easement. McCullough was instructed to work with Dan Koehler, Washington County Planning, regarding the required septic system that will be needed. Mr. McCullough will need a Special Use Permit whether the land is rezoned or not. (Gillen left the meeting at 10:15 PM), Mr. McCullough Hugo Planning Commission January 25, 1978 Page 4 of 4 will be present at the next Planning Commission meeting (February 8,, 1978) with the requested changes in his site plan (driveway, screening, service lane). The draft for the Special Use Permit check list as supplied by Dan Koehler will be reviewed at a later date. Motion made by McAllistery seconded by Peloquin, to name Mrs. Theodora Peltier as Vice Chairperson of the Planning Commission. All aye. Motion carried.` 1 Motion made by McAllisterq seconded by Greger, to name Vern Peloquin as Treasurer of the Planning Commission. All aye. Motion carried.
