P`'L:SiR'T: Peloquin, Hanson, Lorch, McAllister and Peltier ?Houle arrived at 6:30 PM and Greger at 6:55 PM - Mr. Dale reviewed the questionnaire that was submitted to the residents of Hugo. He will prepare a summation of the responses for the next special meeting. Mr. Dale will be contacting the city attorney regarding the court's decision on the Rehbein matter. The Commission again reviewed the proposed development of the business district. Dale felt that it would be a good idea to relocate the fire department to the lot next to the b,%nk. The possibility of an overpass at the intersection of 8A and Highway 61 wras also discussed. Potion made by McAllister, seconded by Peltier, to set a Special Meeting to meet with Carl Dale for December 12, 1979, at 6:00 PM. All aye, Motion Carried. The regular meeting of the Planning Commission was called to order by Chairperson Peltier at 8:16 PM. PRESENT: Peloquin, Hanson, Houle, Greger, Lorch, McAllister and Peltier Motion made by Peloquin, seconded by Peltier, to approve the minutes of October 24, 1979, after the following change has been made: Page 2 (Shubat and Prazich) item 1 of motion — Hugo does not need any additional Industrial. land. All aye. Motion Carried. JOHN NORTON — SPECIAL USE PERMIT Mr. Norton has made an application for a Special Use Permit to fill Lot 7, Block 1, R oyalhaven Estates, for a building site. A permit has been obtained from 'lice Creek. The DNR submitted a letter stating that because the fill and grading plan does not. involve working in the d of blic water, no DNR permit is required. I®ter contacted �' , and stated that he opposed the filling of the Clarke property and Mr. Norton's lot is even lower. Mr. Norton stated that he would not be able to comply with the request of Mr.. Kuusisto to provide 4:1 slopes. The slope will be 4:2. The fill would be required to set for one year, and Mr. Norton thought he might compact the fill as he goes along. Motion made by McAllister, seconded by Houle, that the Planning Commission forward the request of Mr. John Norton to fill Lot 7, Block 1, Royalhaven Estates on Sunset Lake to the City Council without recommendation. Let it be noted that the City Council reversed the Planning Commission's recommendation on a similar lot just recently. VOTL?G FOR: Hanson, Houle, McAllister and Lorch VOTING AGAINST: Peloquin, Greger, and Peltier MOTION CARRIED Hugo Planning Commission November 14, 1979 Page 2 of 3 NEIL MCLEAN - DIVISION OF LAND ON 170TH STREET Mr. McLean, realtor for Hermes, is selling land on 170th Street (Section 12). They want to divide a 40 acre parcel into two 2.0 acre parcels with an easement to the back 20 acres to provide access. After review of the ordinance regarding Land Division, the Commission had a problem as to whether the 33' easement would be public or private and the rear lot would not have the required road frontage as stated in the ordinance. McAllister requested the City Clerk obtain an opinion from the City Attorney regarding this matter. The attorney is to refer to Land Division, Chapter 290-9, Subd. G. H, and I. Mr. McLean requested that he be placed on the City Council's agenda for dis- cussion of this matter. TIM WALLACE - SPECIAL USE PERMIT Mr, Wallace rents 42 acres at 4504 170th Street, all in the Agriculture zone. Mr. Wallace owns 14 sled dogs, and has made application for a Special Use Permit for a kennel. The dogs are used for sled races, and each has their own house. There would be no new construction. It was determined that no application would be re- quired (permitted use). Motion made by McAllister, seconded by Lorch, that the Planning Commission recommends the the City Council that they refund the applicant's fee of ;035.00 for the Special Use Permit, as none is required according to Chapter 320-4, C2. THs C.LPITAL IIPROVEMEI`IT PROGRAM Should the capital improvement program .for regional recreation open space adopted by the Council include all projects and all sources of funds? Or should it continue to include only projects to be funded with regional park funds? Funds raised through local methods should be used for local parks only. Regional parks should be maintained by regional funding. 9. CONVERSION OP PARKLUIT (1) Should the procedure the Council has adopted governinp, the interim use of undeveloped regioml Parklands be incorporated in the policy plan? No. Any interim use should be subject to local municipality approval. (2) Is Policy 18 in the current policy plan governing conversion of undeveloped parklands adequate? The local municipality would determine whether any reasonable alternative exists, and if such conversion is unavoidable, the payment or replacement value should be determined by the local municipality and funded with regional funds. Motion made by McAllister, seconded by Peltier, that the secretary be directed to transcribe all comments relating to the Metro Council Policy Statement and provide Mr. Carl Dale and the City Attorney with a copy. NIclUlister objected to the postponement of this meeting from its original date of November 28, 1979. The appropriate people are to be notified of the change in meeting date.
