PRESENT: Peloquin, Hanson, Greger, Houle and Peltier Icillister (&: /7 Pm.) Larry Ehret was also present at the meeting. Large lot zoning was discussed, and Thr. Dale mentioned that Washington County went to 5 acres. Grant Township will stay with 10 acres. 'Fr. Dale also informed us there may be funds available for our City Attorney. Questions to add to the questionnaire for mailing to the residents of the City of Hugo were as follows: 1. Please explain how construction has, or has not, occurred in Hugo. 2. Add to 2 — ',lhat changes would you like to make? Suggest changes. ?^could you accept tax breaks to encourage business? 3. Should we plan for mass transit? 4. Should Hugo blacktop all their streets and roads, and how should they be paid for? 5. Should we shorter. our 600' cul—de—sac requirement or decrease our lot size? 6. Do you favor Hugo maintaining; their own roads instead of con— tracting with Tashington County? 7. Should we develop business where zoned? 8. Should public parking area be acquired by the City of Hugo or acquired by the merchants? J • '/ould you like the parkland on Sunset I:ake developed? 10. Do you approve of 5, 10, and 20 acre zoning? 11. How longi, have you lived in Hugo? FOR CITY COTTP?CIL OTTLY: Does the City Council want an Ordinance establishing procedures to refer all proposed Capital Improvement to the Planning Commission? Discussed Fu;o's park fund — money should be used for nark maintenance. Mr. Dale stated there are monies available for playground equipment city should look into this. Discussed lowering lot size, but this penses. Read report from Carl Dale. for August, 1979, at 6:00 PM. Theodora Peltier i Acting Secretary could increase government ex— Next meeting with Mr. Dale set , MINUTES OF THE PROCEEDINGS OF THEP HUGO PLANNING COMMISSION July 25, 1979 The public hearing to consider request of Darrell Tavernier for rezoning from SFE to RB, and Curt Leibel for a Special Use Permit was called to order at 7:37 PM. PRESENT: Peloquin, Hanson, Greger, Houle, McAllister and Peltier Mr. Leibel presented the Commission a perc test for the property to be rezoned and a site plan for the proposed marina operation. Mr. Dave Potter, 4394 129th St, requested that Fir. Leibel elaborate on the operation. Leibel stated that he intended to construct a 60 x 100 pole barn to be used for storage with an increase in the number of boats to be rented from 10 to 20. Gas would be sold on the dock, and at the building for his own use. The site plan indicated parking spaces for 16 cars with a possibility of 6 more spaces in the rear. There would be a launch on the lake, but would not be used by the public. The proposed dock has room for 44 boats, and buoys would be placed in the water for rental. Mr. Leibel would also furnish snacks and beverages on the premises. Mrs. Jeanette Farley, 12521 Ethan Avenue, stated that the road could not handle the added traffic, and more boats would be too much for the lake because of the large number boats already there on the weekends. Mr. Kevin Farley concurred with his wife's statements. Mr. Bill Clark felt that fishermen did not use the road on peak hours, and did not feel that Leibel's operation would seriously damage the lake. Myron Johnson, 2134 Park Avenue, said that he had discussed the matter with a number of residents around the lake, and they felt it would be nice to have a place to purchase gas on the lake. He also felt that there would not be that much more traffic on the lake. Mr. Potter said that he approached the city a number of years ago to get No Parking signs in front of his property, with no success. He stated that with the added number of boats, and the limited parking area, he probably�,have to contend with parking problems again. /-,( Bill Hanson stated his concerns regarding off—street parking. The streets would take a beating, and the operation would be catering to people outside of Hugo at the city's expense. Greger stated that 'ze had no objection to V -e boat rental on Br:-ld Eagle Lake, but could agree with spot rezoning — SFE to RB. ilj� The public hearing was closed at 8:15 PM. Hugo Planning Commission July 25, 1979 Page 2 of 4 The regular meeting was called to order at 8:21 PM. PRESENT: Peloquin, Hanson, Greger, Houle, McAllister and Peltier Motion made by Peloquin, seconded by Greger, to approve the minutes of July 11, 1979, as presented. All aye. Motion Carried. CURT LEIBEL - REZONING AND SPECIAL USE PERMIT Consideration was given for the rezoning from SFE to RB and request for Special Use Permit to operate a marina and related business. Motion made by McAllister, seconded by Greger, to recommend denial of the application of Darrell Tavernier for rezoning from SFE to RB at 4444 129th Street North. The Planning Commission feels that it would be spot rezoning and would not be beneficial to the City of Hugo to put a RB zone in a primarily rural residential and lakeshore resi- dential area. VOTING FOR: Greger, Hanson and McAllister VOTING AGAINST: Peloquin, Houle and Peltier Motion Failed, McAllister suggested that the no votes consider whether that operation would be an asset in that area. McAllister had no objection to the conditions as they are now, but not in favor of intensification. Peloquin made motion to go on to next item on the agenda and let the City Council decide. Lotion failed for lack of second. Carl Dale agreed that this would be considered spot rezoning, and would be poor zoning practice. If area was rezoned, would have to contend with what could possibly move in there if the marina business failed. 'Notion made by McAllister, seconded by Greger, to reconsider the pre— vious motion. VOTING FOR: I•'anson, Greger, Houle and TicAllister VOTING AGAINST: Peloquin and Peltier T?otion Carried. Motion made by McAllister, seconded by Peltier, to table the request of Curt Leibel for a Special Use Permit to op me a marina until the meeting of August 8, 1979. fatter tabled pending action by the City Council on request for rezoning. All aye. Motion Carried. •. Hugo Planning Commission July 25, 1979 Page 3 of 4 BILL CLARK - SPECIAL USE PERMIT ��Ir. Clark presented a contour map (topo survey, proposed elevations) to the Commission. Y.uusisto had contacted Chairwoman Peltier regarding this matter and stated that after Mr. Clark filled his lot, it would be 5' above the road. The first livable floor has to be 107', and it would be 109' after filling. The only suggestion Kuusisto had was regarding the amount of fill on the land. Maybe a different house plan could be used that would not require as much fill. Hanson ques- tioned whether the land was needed for overflow or wasn't it. Peloquin stated that two years ago the area was full. Mr. Clark stated that two years ago the culvert from the lake was not functioning. After that, the culvert was opened to eliminate this problem. Pebquin e --pressed his concern about the balance of the lots having this same water problem. He thought that Rice Creek determined that these lots were unbuildable. Clark said that he did not purchase land that was not buildable. Rice Creek only refused to issue a permit for a septic system. Kuusisto was unable to submit a written report because con- tour map was not provided until the day of the meeting. Peloquin made motion, seconded. -by McAllister, to recommend denial of the application of Rill Clark for a Special Use Permit to construct a house at 12601 Homestead Drive. VOTING FOR: Peloquin, Hanson, Greger, Houle, McAllister and Peltier Motion Carried. Peloquin stated that he voted for denial for the following reasons: 1. Other 5 lots could have same problem and require fill 2. Filling would do away with the reservoir 3. Septic system would not work in fresh fill Carl Dale concurred with the Planning Commission's recommendation because in the RRII zone it would be creating a substandard lot and not a sound principle for a septic system. TARRY HANSEN - FARM SITE PLAN Mr. Hansen, 14355 Irish Avenue, owns 45 acres in the AG zone. He would like to construct a 36 x 72 pole barn to be used for personal storage. Motion made by McAllister, seconded by Peloquin, to recommend approval of the Farm Site Plan for Larry Hansen, to construct a 36 x 72 pole barn for his personal use, as per submitted Site Plan. All aye. Motion Carried. MID AMERICAN METAL CRAFT - SPECIAL USE PERMIT Tony Larson and Jerry Clemas were present, and stated that they will be constructing a 40 x 40 cement addition to the building at 15657 Forest Boulevard to be used for welding. The addition will also be roughed in with facilities for an additional lavatory. They were informed that a perc test would have to be provided. McAllister Hugo Planning Commission July 25, 1979 Page 4 of 4 MID AMERICAN METAL CRAFT - cont. stated that a Special Use Permit is needed because of the welding to performed in the building. Motion made by McAllister, seconded by Houle, to recommend approval of the request of Mid American Metal Craft for a Special Use Permit to operate a sheet metal fabricating welding shop in conjunction with the manufacturing facility. The Site Plan submitted indicates a total masonry construction building and, therefore, the requirement of tin shielding in the welding area would not be required. The Special Use Permit does not constitute a welding shop. VOTING FOR: Peloquin, Hanson, Greger, Houle, McAllister and Peltier Motion Carried. ROGER GFRERER - VARIANCE Mr. Gfrerer, 7656 128th Street, would like to construct a 3 -car garage, and the present attached garage would be converted into a familyroom. A Site Plan was presented to the Commission. The garage cannot be constructed to meet the 40' front yard requirement because of the existing grade level. Mr. Gfrerer said that a great amount of fill would be required. Greger did not feel there was a hardship in this case, and could meet the 40' requirement. Motion made by Peltier, seconded by Peloquin, to recommend approval of the request of Roger Gfrercr for a Variance to construct a 3 -car garage with a 25' front yard setback instead of the required 40'. VOTING FOR: Peloquin, Hanson, Houle, McAllister and Peltier VOTING AGAINST: Greger Motion Carried. Chairwoman Peltier noted that a Special T"eeting of the Planning Commis- sion will be held on August 8, 1979, at 6:00 PM, with Carl Dale to further discuss the Comprehensive Plan. The City Council and Ordinance Committee are to be notified. Motion made by Peloquin, seconded by 'Hanson, to adjourn at 10:15 PM. All aye. Motion Carried.
