PRESENT: Peltier, Peloquin, Hanson, Houle, McAllister and Greger Motion made by Peloquin, seconded by Houle, to approve the minutes of the Special Meeting of June 27, 1979, after the following change is made:#3 - review SAC charges for presently unsewered areas. All aye. Motion Carried. Motion made by Peloquin, seconded by Greger, to approve the minutes of the regular meeting of June 27, 1979, after the following changes are made: Page 1 (2nd para) - Bergman stated that he did not want to see the trees removed either It (3rd para) - 33' for i� ngress and egress to his property on the west Page 2 1st para - reviewing the ordinance it 3rd para - Koehler regarding this request asking him to verify it 6th para - the five acres is zoned Industrial All aye. Motion Carried BILL CLARK - SPECIAL USE PERMIT Peltier stated that the city haS received a letter from Rice Creek Watershed suspending the permit previously issued to Bill Clark for the filling of his property on Homestead Avenue. Peloquin stated that the City Engineer and Mayor were to make an onsite inspection of the property, but has not yet been accomplished. Mr. Clark requested that Dan Koehler be present when this inspection is made, because he felt Koehler was the most knowledgeable of the Flood Pldn Ordinance. Motion made by Peloquin, seconded by Peltier, to table the request of Bill Clark until the meeting of July 25, 1979, to obtain the results of the meeting of the City Engineer and Mayor. Rice Creek Watershed is to be notified of the tabling of the request until further reports are obtained, and the Planning Commission would like to be notified when the permit is reissued. All aye. Motion Carried. CURT LEIBEL - REZONING AND SPECIAL USE PERMIT Mr. Leibel is attempting to purchase the Darrell Tavernier property on Bald Eagle Lake to operate a marina. He has made applications for a rezoning from SFE to RB, and a Special Use Permit to operate the marina. Mr. Leibel was instructed to obtain Darrell Tavernier's signature on the application for the rezoning Hugo Planning Commission July 11, 1979 Page 2 of 3 LEIBEL - cont. Motion made by McAllister, seconded by Houle, to set a public hearing for July 25, 1979, at 7:30 PM, to consider the request of Darrell Tavernier for rezoning from SFE to RB, and consideration of the appli- cation of Curtis Leibel for a Special Use Permit to operate a marina and off -sale non -intoxicating liquor license. The publication for this particular Special Use Permit should be published in both the Forest Lake Times and the White Bear Press. No legal necessary for the publication in the White Bear Press. VOTING FOR: Peloquin, Hanson, Houle, Greger and McAllister VOTING AGAINST: Peltier Motion Carried. FRED BENSON - AMENDED SPECIAL USE PERMIT No representative present. RICHARD PILLARD - COMBINING OF LAND IN HUGO AND GRANT TOWNSHIP Mrs. Pillard was present, and stated that they own a total of 20A, and would like to give their daughter 5 acres to build on. A total of 3.95 acres is located in Hugo, and the balance would be in Grant Township. The house would actually be constructed in Grant. The land is located along July Avenue. Peloquin stated that he would like to see a restrictive covenant attached to the deed stating that a house would not allowed to be built on the land located in Hugo. Motion made by McAllister, seconded by Peloquin, that the Planning Commission recommend to the City Council that they notify Grant Township that the City of Hugo has no objection to the issuance of a Building Permit for a residence in Grant Township and combining the acreage in Hugo and acreage in Grant Township - 5 acres or more. Portion of Hugo not to be used as building site. All aye. Motion Carried. JACK LYSNE - FARM SITE PLAN Motion made by Peloquin, seconded by Hanson, to add Jack Lysne to the agenda for all purposes required. All aye. Motion Carried. Mr. Lysne owns 5 acres along Greene Avenue, and requesting authorization to construct a 30 x 48 pole barn to be used for storage. A site plan was submitted to the Commission. The building will be located appro- ximately 100' from Oneka Lake Boulevard. Hugo Planning Commission July 11, 1979 Page 3 of 3 JACK LYSNE - cont. Motion made by Peloquin, seconded by McAllister, to recommend the approval of the request of Jack Lysne, 15063 Greene Avenue, for a Farm Site Plan for the construction of a 30 x 48 pole barn to be used for storage. All aye. Motion Carried. TOM FITZPATRICK - SCHOELLER SUBDIVISION (discussion only) Mr. Fitzpatrick presented the Commission with a revised site plan for the subdivision indicating 50 lots, 100 x 134. The plan calls for hookup to the interceptor of the 101CC and blacktop streets. Fitz- patrick was looking for some indication from the Commission as to whether they concurred with the revised plan. It was the general con - census of the Commission that the city would have to comply with the present Comprehensive Plan - low-density zoning. LAWRENCE JASINSKI - REZONING Mr. Jasinski had called City Hall on June 29, 1979, requesting that his application be tabled indefinitely. It was determined that the Commission has 15 days, after the public hearing is held, in which to make some kind of decision. Motion made by Peloquin, seconded by Hanson, to table the request of Lawrence Jasinski for rezoning from AG to RRII pending receipt of the following: 1. Report from City Engineer interpreting the Flood Pldn Ordinance. 2. Professional perc test for the land to be rezoned, or 3. A letter from Lawrence Jasinski verifying his phone call of June 29, 1979, asking for tabling of the request indefinitely. All aye. Motion Carried.
