HomeMy WebLinkAbout1979.06.13 PC MinutesA MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION June 139 1979 The public hearing to consider the requests of Leroy and Lauren McCullough, Clyde Rehbein, and Robert Lundgren to have rezoned to the Industrial District was called to order by Chairwoman Peltier at 7:33 PM. PRESENT: Peltier, Greger, and Hanson ABSENT: Peloquin, Gillen, Houle and McAllister The notice, as published in the Forest Lake Times, was read. Discussion was opened to the audience. Mr. Gerald Nelson, owner of the CB business in McCullough's building, was present to state his concerns regarding the possible rezoning. He questioned whether the present industrial parks were full at this time, and the purpose of the rezoning. Peltier stated that Mid American Metal Craft initiated the request, and that it was recommended that the balance of the property also be rezoned to avoid "spot" rezoning. Mr. Nelson stated if the land was rezoned, it would affect three retail businesses in the area. Mr. Tony Larson stated that Mid American also has some walk-in business. Nelson stated his concern with the lack of space for semis to make deli- veries in the area. Larson said that his business has full control on the type of trucks making deliveries to their business (20' trucks). Mr. Nelson expressed concern about the lack of city water and sewer. Larson stated they employ only 7 people, and understood that the city had full control as to what type of industrial bus�W�* ss would go in the area. Jerry Clemas, Mid American, stated that at this time theyitrinancially unable to purchase land and construct a building in the industrial park. They do not like the area because of the large amount of outside storage in the park. They feel their needs require a different appearance. Bill Hanson inquired as to what the other landowners would be using the buildings for, and Harvey Karth, representing Clyde Rehbein, stated that at present the building is for sale. He stated that Mr. Rehbein went along with the rezoning because of the request of the city. The public hearing closed at 7:52 PM. The regular meeting was called to order at 8:04 PM. PRESENT: Peltier, Greger, Hanson and McAllister ABSENT: Peloquin, Houle, Gillen Motion made by McAllister, seconded by Greger, to approve the minutes of May 239 19799 after the following corrections are made: Page 1 (1st paragraph) - The northern property will be divided it - These sites would not interfere Page 1 (last paragraph) - should have soil tests submitted it - Perc tests are to be done professionally All aye. Motion Carried. Hugo Planning Commission June 13, 1979 Page 2 of 4 REZONINGS Mr. Nelson stated that if the land were rezoned, the city would be getting rid of too much Retail Business. McAllister felt there was something lacking in the Zoning Ordinance, because there was no area for limited manufacturing. Mr. Nelson again stated his concern that a warehouse could go into the area thereby necessitating deliveries by semis. McAllister felt that the Planning Commission should table the request and recommend that the City Council direct the Ordinance Committee to draft a zoning classification of light industrial or limited industrial manufacturing. Bill Hanson said that he had visited the business of Mid American, and could not imagine that they wouldn't expand. Mr. Larson stated that he and his partner had set maximum goals for their business. In two years that would probably plan on expanding, but do not want to employ more than 10 people. Mr. Karth felt that retail business were having troubles in that area because of the lack of traffic between Hugo and Forest Lake. Motion made by Peltier, seconded by McAllister, to recommend approval of the rezoning requests;of Robert Lundgren, Clyde Rehbein, Leroy McCullough and Lauren McCullough, to rezone land from RB to Industrial. Greger felt that there was enough Industrial districts in the city and more RB was needed. VOTING FOR: McAllister, Hanson and Peltier VOTING AGAINST: Greger Motion Carried. Let the record show the Planning Commission would like to see an establishment of a limited manufacturing zone. NORMAN HORTON — AUTO DISMAN'T'LING LICENSE Motion made by McAllister, seconded by Greger, to recommend approval of the Auto Dismantling License for Norman Horton, for a term of one year, subjectto the pre— vious conditions. All aye. Motion Carried. FRFs BENSON — REZONING AND AMENDED SPECIAL USE PERMIT Mr. Jansen, Suburban Engineering, present the Commission with perc tests taken on the three lots to be rezoned, along with a copy of the perc test for the homesite. A perc test was unable to be taken for the location of the new kennel. Tom Crever reveiewed the submitted perc tests, and stated that Tract J was marginal. Addi— tional tests would have to be taken on that particular site. Motion made by McAllister, seconded by Greger, to recommend approval of the request of Fred Benson to rezone property from Agriculture to RRII. VOTING FOR: McAllister and Greger VOTING AGAINST: Peltier ABSTAINED: Hanson Motion Carried. Hugo Planning Commission June 13, 1979 Page 3of4 Fred Benson - cont. Let the record show that the only thing missing for consideration of the Amended Special Use Permit is a perc test at the new proposed kennel location. TIMOTHY WRIGHT - TWO MINOR SUBDIVISIONS AND VARIANCE Mr. Bartholdi, representing the Wright family, and stated that Timothy Wright's house encroached on the west property line. He would like to purchase a 15' strip so that the house would be within the property boundaries. A variance to sideyard setback would be required (10' requirement). Motion made by McAllister, seconded by Greger, to recommend approval of the request of Timothy Wright for a variance to the sideyard setback. All aye. Motion Carried. Motion made by McAllister, seconded by Greger, to recommend approval of the request of Timothy Wright for a Minor Subdivision to add 15' on the western boundary to an existing parcels listed as an exception in certificate of survey on 121st Street, that does not meet the minimum zoning requirements. All to become one deed. All aye. Motion Carried. Motion made by McAllister, seconded by Hanson, to recommend approval of the request of the seconded Minor Subdivision of Timothy Wright for the subdivision of the en= tirety into three (3) lots so that parties can build single family housing units as listed in the certificate of survey dated May 6, 1979. VOTING FOR: McAllister, Hanson and Peltier ABSTAINED: Greger Motion Carried. Let the record show that the City Clerk should be directed to not place the matter of the agenda until the Butding Inspector states that he does, in fact, have the perc tests for the additional lots in his possession. KATHY LACASSE - PURCHASE OF LAND (Section 30) Ms. LaCasse is interested in purchasing 10 acres in the AG district and 4 - 5 acres in the Cons district to make one piece of property. The balance of the land in the Cons district is divided by a road thereby creating the 5 acres. McAllister sug- gested that Ms. LaCasse submit a plan of the entire piece of property. Mrs. Peltier will inspect the site to determine what might be required. BILL HENNING - DIVISION OF LAND (Hilo and 125th) Mr. Henning presented the Commission with a concept plan for the division of 74 acres into 6 homesite of 12 acres or more. A road will need to be constructed with a cul-de-sac 700' long. Mr. Henning was looking for some indication from the Commission as to whether they would approve the division. McAllister stated that the City Council has made a directive requiring blacktopped roads for all future subdivisions. Mr. Henning was not aware of this ruling. McAllister also felt it would be appropriate Hugo Planning Commission June 13, 1979 Page 4 of 4 to have written comments from Howard Kuusisto and Dan Koehler along with some perc tests before the Commission would make any indication. The City Council is requested to reaffirm their position on the requirment for blacktop streets for future sub— divisions, including 10 acre subdivisions. MISCELLANEOUS Motion made by Peltier, seconded by McAllister, to accept the resignation of Mike Gillen as a member of the Planning Commission. All aye. Motion Carried. Motion made by McAllister, seconded by Peltier, to add Tom Crever to the agenda. All aye. Motion Carried. Crever stated that Mort Hueber would like to construct a boat house on his property located in Hugo. His homesite is in Ramsey County. If the land is on a separate deed# Mr. Hueber would need a variance. The people who purchased the Fellman property has purchased 2z acres across the street from the house (Ingersoll Avenue) and is considering construction of a garage there. He would need a Special Use Permit. Mr, Bill Clarkq owner of Lot 59 Royalhaven Estates, has received a permit from Rice Creek to place fill on the lot. Roy Schultz, DNR, does not advise fill because of the high water. He said that Rice Creek had stated in 1976 that the lot was uribuildable.
