PRESENT: Peloquin, Greger, Gillen, Hanson, Houle and Peltier McAllister arrived at 7:40 PM. FRED BENSON - REZONING Mr. Bill Jensen, Suburban Engineering, stated that the land was purchased to operate a dog kennel, and the property is larger than what is required for that purpose. The northern property willbXdivided into 10 acre home sites, and a request has been made to rezone the south westerly portion of the property from AG to RRI. There are h' h knolls located there, and appear to be good for homesites. These sites would,i'nterfer with the kennel operation. The land south of the area requested to be rezoned is in the RR2 district. The lots would be made up of approximately 7A9 8A, and 5A lots. The size of lots would be determined by topography. Ray Olson, 7600 132nd Street, was present, and asked if the kennel operation had already been approved, because he had not heard anything about the operation. Mr. Olson was informed that the kennel had been approved in 1978. Mr. Olson also wanted to know what Hugo was going to do about future development. Peloquin and McAllister agreed that before the rezoning can be approved, perc tests would have to be taken to prove buildable sites. A report had been submitted from Dan Koehler stating that the area was questionable as to possible approved perc tests. Hanson stated he was concerned with where Hugo would stop with rezonings in that area. The publt hearing closed at 7:57 PM. The regular meeting of the Planning Commission was called to order at 8:02 PM. PRESENT: Peloquin, Grger, Gilleng Hanson, Houle, McAllister and Peltier Motion made by Peloquint seconded by Hanson, to approve the minutes of May 9, 1979, after the following correction is made: Page 1 (paragraph 3) - Moe also stated that there are numerous times All aye. Motion Carried. Motion made by Hanson, seconded by McAllister, to revise the agenda to move Carl Dale down to #6 and Mining Permits to y#7. All aye. Motion Carried. FRED BENSON - REZONING Peltier stated that the Planning Commission should have soil tests stetted -before a vote could be taken on the rezoning. Motion made by McAllister, seconded by Gillen, to table the Fred Benson request for rezoning until the meeting of June 139 1979, at which time Mr. Benson is to provide professional perc tests for the proposed rezoning. All aye. Motion Carried. FRED BENSON — AMENDED SPECIAL USE PERMIT Because of the change in location of the kennel, and the smaller amount of acreage for the operation, an Amended Special Use Permit is needed. Because of the change in location, it was determined that a new perc test be taken for the kennel. Motion made by Peloquin, seconded by McAllister, to table the request of Fred Benson for an Amended Special Use Permit until the meeting of June 13, 19799 at which time a professional perc test be submitted for the new location of the kennel. A copy of the perc test for the residence also to be submitted. All aye. Motion Carried. MID X RICAN METAL CRAFT — REZONING Motion made by McAllister, seconded by Houle, to set a public hearing for June 13, 19799 at 7:30 PM, to consider the requests of LeRoy and Lauren McCullough, Clyde Rehbein, and Mid American Metal Craft, to have land rezoned from the RB district to the Industrial district. City Clerk be directed to provide the applicants with all information necessary for the procedure. A11 aye. Motion Carried. RON GRANGER — SPECIAL USE PERMIT Mr. Granger's plumbing building is in the CB district, and he is requesting authorization to convert the building into a restaurant. Paul's Pizza would be the new occupant. Peloquin stated his concern for the A & W Drivein next door, and said that he would not like to see any curb—side service. Mr. Granger felt this statement was infringement on the free enterprise system. All interior plans would be subject to the Minnesota Board of Health for their approval. Mr. Granger said the entrance would be from Highway 61, and vision was very good from both directions. Inside modification would be the only necessary work on the building. The parking lot is presently blacktopped on the south side of the building. McAllister stated that any screening along Highway 61 would be hazardous. The present plumbing sign wouldbe replaced by a Paul's Pizza sign. Hanson stated some objection to the Highway 61 entrance, and he felt the public should be notified. McAllister felt that a public hearing would not be needed. Mr. Granger met with all the requirements of the Special Use Permit checklist. Motion made by McAllister, seconded by Gillen, to recommend approval of the Special Use Permit for Ronald Granger to convert his plumbing building into a restaurant, as per submitted Site Plan. VOTING FOR: Peloquin, Gillen, Hanson, Houle, McAllister and Peltier ABSTAINED: Greger Motion Carried. Hugo Planning Commission May 239 1979 Page 3 of 4 LA14RENCE JASINSKI — REZONING Mr. Jasinski is requesting authorization to rezone property from AG to RRII. Mr. Jasinski was present and submitted a site plan of the property. Greystone Avenue appears to extend to 30' of the north border of the proposed 5 acre parcel. At this time, Mr. Jasinski is not asking for rezoning for the balance of the property. Motion made by Peloquin, seconded by McAllister, to set a public hearing for June 27, 1979, 7:30 PM, to consider the request of Lawrence Jasinski to rezone property from the AG district to the RRII district. All aye. Motion Carried. Secretary instructed to write a letter to the City Engineer inquiring as to where Greystone Avenue actually ends to the south. Motion made by McAllister, seconded by Peloquin, requesting Dan Koehler to comment on the rezoning request of Lawrence Jasinski. Mr. Jasinski to received a copy of the report. FISCHER CONSTRUCTION — PRIG PERMIT Howard Kuusisto inspected the site and stated that the blacktop on Irish Avenue needs patching. Other than that, he had no problem with the area. Fischer agreed to the request to have Irish Avenue patched. Motion made by McAllister, seconded by Gillen, to recommend approval of the Mining Permit for Fischer Construction until June 30, 19809 subject -to the attached conditions. Mr. Fischer is also requested to repair Irish Avenue subject to the satisfaction of the City Engineer. All aye. Tiotion Carried. RICHARD SCHUH — MINING PERMIT Mr. Schuh questioned whether he could have his letter of credit reduced ($25,000.00). McAllister suggested that at the City Council meeting of June 49 Howard Kuusisto should take a look at the possibility. Kuusisto inspected the Schuh gravel pit and stated that the area appeared to be satisfactory. However, the haul road to the east (152nd St) and south to point of beginning of bituminous paving from that pit area is in need of reshaping and grading. Motion made by McAllister, seconded by Hanson, to recommend approval of the Mining Permit for Richard Schuh until June 30, 1980. subject to the attached conditions. Mr. Schuh is requested to comply with the City Engineer's recommendation to add gravel to two haul routes. The Planning Commission would ask the City Council to review the letter of credit for Mr. Schuh for possible reduction. All aye. Motion Carried, LAVINA DURAINE — SPECIAL USE PERMIT Motion by McAllister, seconded by Peloquin, to recommend approval of the Special Use Permit for Lavina Duraine until June 30, 1980, subject to the attached conditions. Hugo Planning Commission May 239 1979 Page 4 of 4 BALD EAGLE SPORTSMAN ASSOCIATION — RENMWAL OP SPECIAL USE PERMIT Mr, Timm, President of the club, was present, and stated that because of the Sunday closing condition, their revenue on the rifly range has decreased by 40%. He also stated that their taxes have been increased. McAllister stated that the present system has worked to the satisfaction of the adjoining neighbors, and he would not be willing to vote for any change. Motion made by McAllister, seconded by Peloquin, to recommend approval of the renewal for the Special Use Permit for the Bald Eagle Sportsman Association as it exists. Mr. Timms is to provide the telephone numbers of the club's officers. VOTING FOR: Peloquin, Greger, Gillen, Houle, McAllister and Peltier ABSTAINED: Hanson Motion Carried. CARL DALE Mr. Dale reviewed with the Planning Commission the requirements for the updating of the city's Comprehensive Plan. Mr, Dale listed a number of areas the Commission should consider when reviewing the plan: 1. Deadend streets created by large lots 2. Consider another survey questionnaire 3. Take a look at the business district along Highway 61 4. Consider designated areas acquired for parks 5. Punds for industrial areas 6. Increment tax financing 7. Substandard housing Mr. Dale will be present at the Planning Commission meeting of June 27, at 6:00 PM, to further discuss the Comprehensive Plan. The City Council, Ordinance Committee, and Dan Koehler is to be invited to attend this meeting. MISCELLANEOUS McAllister stated that in early 1978, the City Council directed either the City Attorney or the Ordinance Committee to draft a new ordinance requiring site plan review in the CB district. The City Council is requested to report to the Planning Commission on the status of that directive. Motion made by Peloquin, seconded by Greger, to adjourn at 11:32 PM. All aye. Motion Carried.
