HomeMy WebLinkAbout1979.05.09 PC Minutesr MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION May 99 1979 The public hearing to consider the request of Howard Moe for an Amended Special Use Permit was called to order at 7:34 PM by Chairwoman Theodora Peltier. PRESENT: Peloquin, Peltier, McAllister, Hanson and Houle ABSENT: Gillen and Greger Mr, Don Wenzel, 14124 Flay Avenue, was present, and stated that he would like to see the annual review remain as a condition to the permit. He stated that the original permit allowed for a total of 14 cars, and there are now 25 — 30 cars on the property. If Mr. Moe was allowed to store 50 cars, would he have 70 — 80 cars? Mr. Bill DeJarlais, 14054 Flay Avenue, asked Mr. Moe if he was planning on paving, and Moe said that he was asking for an extension until 1980. Dan Spitzer asked Mr. Moe the average number of cars on the property since the original Special Use Permit was granted. Moe stated that until spring he was well within the 11 cars limit. He stated that it was not economically feasible to stay in business with only 11 cars allowed. McAllister asked if paint work has ever been done on cars other than owned by the business, and Moe stated that his son has worked on friend's cars. Moe also stated that there a* num erous times cars on the lot that are not for sale ( customers and employees) . Ql`' Mr. Wenzel stated that he would like to see some screening along the eastern property line rather than a fence. It was determined that the additional cars parked along the eastern boundary would not be closer than 50' to the property line. (GREGER ARRIVED AT 7:55 PM). McAllister asked if a flammable waste trap had been installed, and Moe replied no. The public hearing closed at 8:00 PM. The regular meeting of the Planning Commission was called to order by Chairwoman Peltier at 8:04 PM, PRESENT: Peloquin, Peltier, Greger, McAllister, Houle and Hanson ABSENT: Gillen Motion made by Poloquin, seconded by McAllister, to approve the minutes of April 25, 1979, after the following corrections are made: Page 3�Peloquin) Peloquin- McAllister stated they were trying to treat industrial development Page 3 — Chairperson Peltier stated that they were only considering the pre— liminary plan All aye. Motion Carried. HOWARD ME — AMENDED SPECIAL USE PERMIT Peltier asked why the extension on the blacktop, and Moe stated that he lost three months because of the fire in December. McAllister commented on Moe's unwillingness to comply with the original conditions of the permit, and that Mr. Moe has shown no reason to be— lieve he would comply with the amended permit. The Commission then discussed highway Hugo Planning Commission May 9, 1979 Page 2 of 5 Howard Moe - cont, right-of-way on the Moe property, and it was determined that Mr. Moe met all require- ments. It was the concensus of the Commission that the request for 50 cars was not in order. McAllister stated that he would like to table the request until blacktopping is installed. There were already too many violations to the original permit. Motion made by Peltier, seconded by Peloquin, to recommend approval of the request for an Amended Special Use Permit made by Howard Moe. Amended permit to read as follows: 1. That the access and egress to the business have a minimum of 30' width driveway, hard surfaced. 2. That the area to be blacktopped as proposed in the submitted site plan. 3. An irrevocable letter of credit in the amount of $3,000.00 be provided to insure blacktopping by October 19 1979• If work not completed by this date, letter of credit to be renewed. 4. That minor body and paint work be allowed subject to all state and federal regulations or codes for work on vehicles owned by the business only. 5. Refer 320-5-M-3: Refers to said regulations for inoperable cars. That the back area of the property be maintained in a neat and order fashion. 6. The Special Use Permit is subject to annual review. 7. No more than thirty (30) cars be allowed on the property. There shall be no cars stored on the eastern 50' of the property. 8. Trees for screening to be placed on the northern 2 of the east property line. 9. If Mr. Moe accepts the conditions of this permit, he allow the City Council to count the number of cars inside and outside at any time. VOTING FOR: Peloquin, Houle and Peltier VOTING AGAINST: Hanson, Greger and McAllister MOTION FAILED Motion made by Greger, seconded by Peltier, to recommend approval of the Amended Special Use Permit as requested by Howard Moe. Amended permit to read as follows: 1. That the access and egress to the business have a minimum of 301 width driveway, hard surfaced. 2. That the area to be blacktopped as proposed in the submitted site plan. 3. That an irrevocable letter of credit, in an amount to be determined by the City Engineer, be provided to insure blacktopping, per submitted plan, for all parking spaces and the required screening, to be accomplished by June 1, 1980. VOTING FOR: Peloquin, Houle, Hanson, Greger and Peltier VOTING AGAINST: McAllister MOTION CARRIED DAROU TAVmRNIFR - SITE PLAN (26 x 40 garage) Mr. Tavernier presented his revised site plan. He restated that he has never been out of business since the fire in April, 1977, and no new boats have been purchased. Mr. Tavernier maintains an inventory of 10 boats. McAllister stated that the only option the Commission has is to recommend to the City Council that they concur with the business. Greger referenced 320-3, Subd. B. paragraph 101 and 320-59 Subd. 4 as reasons for con- trolling the operation with a Special Use Permit. McAllister stated that a Special Use Permit cannot be issued in the SFE zone for a boat rental business. Motion made by McAllister, seconded by Peloquin, to recommend approval of the Site Plan as submitted. The facts brought forth indicate that the business has never ceased since the time of the fire and we recognize the business as a lawful non -conforming use. Let the record show that the motion.was based on the feeling that this will not intensify a lawful non -conforming use. VOTING FOR: Peloquin, Houle, McAllister and Peltier ABSTAINED: Hanson (no direct opposition to boat facility) VOTING AGAINST: Greger MOTION CARRIED DAN SPITZER - SITE PLAN APPROVAL Mr. Spitzer would like authorization to construct a 40 x 40 pole barn as indicated in Site Plan as submitted. Motion made by Peloquin, seconded by Peltier, to recommend approval of the Site Plan for Dan Spitzer, to construct a 40 x 40 pole barn to be used for storage and livestock. All aye. Motion Carried. MID AMERICAN METAL CRAFT Mr. Clemas and Mr. Larson, owners of Mid American Metal Craft, are interested in purchasing the old Arlington Furniture store. The building is in the RB zone, and does not allow for the light industrial performed in their business. The business makes small parts for the computer business. All the work would be interior, with no outside storage. The business presently employs 7 full-time and 3 part-time. They do have a small amount of walk-in business. They extended an invitation to the Plan- ning Commission to visit their place of business to see their operation. It appears as this time that a rezoning would be in order. They will be on the agenda for the City Council meeting of May 23, 1979, to discuss the matter again. RALPH STRECKER - SITE PLAN 11r, Elmer Peterson, Strecker's brother-in-law, is going to purchase the property at 15435 Forest Blvd (rock shop). He would like to construct a 24 x 30 garage for personal storage. The land is in the AG zone. The present attached garage will be made into living quarters. Motion made by McAllister, seconded by Peltier, to place Mr. Peterson on the agenda for other than discussion purposes. All aye. Motion Carried. Motion made by McAllister, seconded by Peloquin, to recommend approval of the Site Plan as submitted by Elmer E. Peterson, to construct a 24 x 30 garage for his own personal use as allowed in the Zoning Ordinance. All aye. Motion Carried. MISCELLANEOUS Motion made by Peloquin, seconded by Peltier, to appoint Bill Greger as Vice Chairman of the Planning Commission. Mr. Greger requested that his name be withdrawn. Motion made by Houle, seconded by Greger, to appoint Mike McAllister as Vice Chairman of the Planning Commission. VOTING FOR: Peloquin, Peltier, Greger, Houle, Hanson ABSTAMD: McAllister MOTION CARRIED t Hugo Planning Commission May 9, 1979 Page 5 of 5 Motion made by Hansong seconded by McAllistert recommending that the City Council petition the Minnesota Department of Transportation to investigate the adequacy of the existing railroad warning devices at the public crossing of County Road QA (170th Street) and Burlington Northern, Inc.
