The meeting was called to order by Mayor Stolt man at 7:00 PM.

ABSENT: Leroux; and Miron (Both arrived at 7:10 PM.)
Barnes made motion, Brunotte seconded, to approve the minutes for February
16, 1993, as submitted.
All aye. Motion Carried.
Barnes made motion, Stoltzman seconded, to approve the claims for March .1.,
199.3, in the amount of $53,642.33.
All aye. Motion Carried.
SPEC I AL. -USE PERMIT _LR . , NIL OTTA)
Robert. P. Bilotta has applied for a SUP to operate a "pick:. -your --own" fruit
and vegetable garden at 6909 132nd Street. This operation would include
use of the existing building on the site, with the addition of a 60' x 96*
greenhouse, as well as additional parking. The Planning Commission
recommended approval of the SUP to construct and operate a greenhouse .in
accordance with the approved site plan, and sell at retail, vegetable.,
fruit, and other produce and f lower=_. grown on site, sub.:iect to spec.i.a1.
conditions. Mr. Bilotta appeared before the Council stating his plant= for
the property. (COUNCILMEN L.E.ROUX AND MIRON ARRIVED AT :10 PM) . There
was a lengthy discussion about the nature of the business, and what wf.=uldh
and would not, be done on the site. Mr. Bilotta stated that he will N01'
be selling landscape rock: or timbers, and will NOT be operating a
commercial nursery business. There was Council concerned about the
potential, additional traffic on 132nd Street, which is a gravel road. If
the road was ultimately black topped, what [portion of the assessment would
be the responsibility of the business_., which has only limited frontage on
the road.
Leroux: made motion that the City Administrator meet with Mr. bi:lot.ta tr:;
review the proposed conditions, and table this matter until the Council
meeting of March 15, 1.993.
Motion died for 'lac_k of a second.
Miron made motion, Brunotte seconded, to approve the reqt_est. of Robe -.rt. K.,
Bilotta for a Special Use Permit to operate a "pick:. -••your -•own" flowers,
fruit, and vegetables garden at 6909 132nd Street. This operation wouYl
include use of the existing building on site, with the addition of a 60'
96' greenhouse, as well as additional parking, according to the submitted
site plan. Approval is subject to the following special conditions, as
well as a possible additional condition regarding future road assessments:
1. This permit shall expire with any subdivision or change of ownership
of the property.

. Activities on this site shall be subject to reasonable regulation,
including future licensing, if deemed necessary by the City, through
ordinance.
3. Retail sales shall be limited to the hours between sunrise and sunset.
4. One (1) sign, constructed in accordance with the City's sign
ordinance, shall be permitted to identify the services being provided
to the public on-site.

SITE FLAN _APF'ROVAL_.!L]�A I EBL )
Don Baierl of 9.35 Duchess Street, St. Paul, MN., has requested site plan
approval to construct and operate a facility for the storage and
maintenance of classic and performance automobiles on his property located
along Highway 61, in the NE 1/4 of Section 17, 'T31N, R21.W, in the City of
Hugo. The site is zoned industrial. Staff has recommended approval
subject to special conditions.
Stolt man made motion, Miron seconded, to approve the site plan request of
Don Baierl, 935 Duchess Street, to construct and operate a facility for
the storage and maintenance of classic and performance automobiles on
property located in the NE 1/4 of Section 17, T31.N, R 1W. Approval is
subject to the following special conditions:
1. The owner shall obtain a septic system permit from the Washington
County Department of Health.
. The owner- shall obtain a driveway permit from MNl:iO .
_.. The owner shall provide verification from the RCWD of an approved site
drainage plan.
4. All unlicensed vehicles shall be stored inside of the building, or the
owner shall be required to apply for an auto dismantling/junk yard
license.
5. The owner shall obtain a Hazardous Waste Permit from the Washington
County Health Dept.

JUNK. YARD ORDINANCE
Eased on the public hearing held by the City Council on February 161 1993
and review by the City Attorney, revisions have been made to the City's.
proposed auto dismantling/junk yard ordinance. Staff recommends adoption
of the ordinance, as revised. Roger Dupaul , Mike Brandt, and ;james Brevig
addressed the Council asking that. the Council consider not adopting the
proposed ordinance. Mayor Stolt man stated that he, would abstain from
voting on this issue because of a possible conflict of interest.
Barnes made motion, Leroux seconded, to adopt_ ORDINAN(::E:. 1993-27V, AN
ORDINANCE REGULATING THE OPERATION OF AUTO DISMANTLING F=AC1LITIES AND JUNK.
YARDS IN THE CITY OF HUGO.

WELL CONTRACT
On Tuesday, February 2=, 1993, the City received bids for construction of
a 24' x 18' water -supply well, in accordance with the engineer's
specifications, as part of the City's 1993 water -system improvement
project. Five bids were received, ranging in price from $52,885 to
$70,240. The City Engineer recommends awarding the project to E.H. Renner
Q< Sons of Elba. Fiver, MN., as low bidder, at a price of $52,885.
Miron made motion, Brunotte seconded, to award the bid for construction of
a 24' x 18' water -supply well to E.H. Renner '1-: Sons, Inc., 15688 Jarvis
Street NW, Elba, Fiver, MN 55.3=0, in the amount of $52,885.00.

AMENDMENT TO BROWN'S CREEK WMO JOINT POWERS AGREEMENT
The Council reviewed an amendment to the City's Joint Powers Agreement
with the BCWMO. The amendment would include the cite; of Oak. Park. Heights
in the organization, due to the recent annexation of a portion of Baytown
Township, which is located within the watershed. This is an action to
include representation of all local subdivisions, which are impacted by
the watershed management organization's policies and activities on the
Board of Directors. Staff recommends approval of the amendment.
Stoltzman made motion, Barnes seconded, to approve the amendment to the
City's Joint Powers Agreement with the BCWMO, to include the city of Oak.
Park. Heights in the organization. The Mayor and Clerk etre authorized to
sign said Amendment on behalf of the City of Hugo.

LETTER REGARDING LAKEVIEW INN
James E. K:ellison of 4394 129th Street North has submitted a letter to the
City regarding a pending, SUP application for a change in ownership, and
continuing operation, of the Lakeview Inn .located on the north side of
Bald Eagle Lake. Mr. Kel1icon expressed concerns about the hours of
operation, sale of alcohol, parking, traffic congestion, sanitary
facilities, and general safety of pedestrians crossing 129th Street to the
Lakeview Inn's docks. The Lakeview Ing-, is in the process of being sold,
and the new owner has expressed an interest in obtaining a SUP to clarify
the facility's future, given that the operation is located in an area
zoned RR2, which does not permit commercial activity. The City received
an application (3/1/93) for a SUP, and Mr. Kellison is to be informed that
a public hearing would be held by the Planning Commission on 3/24/93.

On February 18, 1993, Mayor Stoltzman and the City Administrator met with
the owners of businesses located in the Pelocauin Industrial Parti... The
business owners indicated a strong interest in improving the industrial
park by the addition of sewer, water, and paved streets. This industrial

park is not currently located in the the City's MUSA. Staff recommends
that the Council authorize the City Engineer to provide a feasibility
study for providing municipal services to this site, and that expansion of
the MUSA, to include the Peloqui.n Industrial Farb.:, be considered as part
of the City's Comprehensive Flan revision process.
Stolt man made motion, Barnes seconded, directing the City Engineer to
provide a feasibility for installation of sewer, water, and paved streets
in the Peloquin Industrial Park, including the businesses north of 152nd
Street.

ADMINISTRATOR'S SALARY REVIEW
Based on an Employment Aqreement between the City of HUQO and Robert A.
Museus, City Administrator, Mr. MUseus was to receive a performance review
in December, 1992, and subject to a satisfactory performance review, a
salary adjustment on January 1, 1993. The City Council conducted a
performance review of the Administrator on February 3. 1993, and received
final report on the review from the City's personnel consultant for this
issue at the Council meeting of February 16, 1993.
Barnes made motion, Stoltzman seconded, to approve a 5: pay increase for
the City Administrator, Robert MUseUs, for the year 199=, retroactive to
January 1. 199:3.
Motion and second were withdrawn.
Barnes made motion, M.iron seconded, to approve a 2.5% pay increase for the
City Administrator, Robert. MUseus. effective January 1, .199-3.

MISCELLANEOUS
The City received an invitation from NSF' to attend the 2nd annual
community topic program at. Ruberto's, on April 7 at 1C>:(*-'(-) AM.
The Council received a report from Howard K:L-usisto regarding the
completion of construction of the watermain and sanitary sewer in the Rice
Labe Meadows subdivision. The City will need to accept these improvements
to allow the Building Inspector to issue certificate e -of occupancies.
Miron made motion, LeroU-.; seconded, that. the City accept the wat.ermain and
sanitary sewer improvements in the Rice Lab. -.e Meadows• subdivision for
maintenance purposes, with escrow money not to be released Until after
completion of the final testing.

Nelson from the Hugo Volunteer Fire Department, effective March 1, 1993.

City Administrator will review data from the State of Minnesota regarding
their regulations for auto dismantling/salvage yards so that the City can
now start our licensing process.
