PRESENT: Barnes, Brunotte, Leroux, Miron, Stoltzman City Administrator, Bob Museus City Attorney, Greg (caller City Clerk:, Mary Ann Creager Leroux made motion, Brunotte seconded, to approve the minutes for the regular Council meeting of March 15 1993, as amended. All aye. Motion Carried. Miron made motion, Brunotte seconded, to approve the minutes for the special Council meeting of March 8, 1993, as submitted. All aye. Motion Carried. Leroux made motion, Miron seconded, to approve the claims for March 15, 1993, in the amount of $19,764.19. All aye. Motion Carried. REPRESENTATIVE DOUG SWENSON Mr. Swenson addressed the Council thanking them for the opportunity to hold his Town Meeting at Hugo City Hall. B I LOT'TA SPECIAL USE PERM'1' "f The City received a letter from Robert B. Bilotta regarding the special use permit granted for his operation of a greenhouse and retail sales of produce at 6919 132nd St. No. Mr. Bilotta requested that the City Council reconsider condition #1 on the special use permit which states, ""this permit shall expire with any subdivision or change of ownership of the property." Mr. Bilotta is concerned with the protection of his investment in this property, and would like to reserve the option to transfer ownership of the operation, intact, to another- party. He has no objection, to maintaining the condition that the special use permit expire with any subdivision of the property. Leroux made motion, Miron seconded, to change the SUP for Robert Bilotta, by deleting the words "or change of ownership" from Condition #1, and dating the reference to the Site Plan in the SUP. All aye. Motion Carried. BUILDINCa INSPECTION INTERN The City of Hugo advertised with local technical/vocational schools for a building intern to assist in the building inspection department. Applicants were interviewed by John Denson, City building official,, and Gene Saboy, building official from White Gear Lake. Lased on the review of their resumes, academic performance, and these interviews, it is recommended that Timothy John Saari be hired as the building inspection intern for a six-month period, to begin on April 5, 1993 . All aye. Motion Carried. STATE AID STREET FUNDING UPDATE Eased on the 1990 census, and the rate of new home construction in the City, Hugo should reach a population of 5,000 this year. This would make the City eligible for State Aid Street Funding. According to the Minnesota Department of Transportation, the City must obtain certification of the City's population from the Bureau of the Census by conducting a special census in order to prove its eligibility for this program. According to the Census Bureau, the cost of a special census would be between $15,000 and $20,000. Given a certain margin for error in population estimates, and the high cost of conducting the census, the City Council needs to make a decision on what level of risk it is willing to accept in contracting for the census. Based on the best: data available, the City's population would be approximately 5,025 at the end of 1990, leaving a margin for statistical error at 1/2 of 1%. Given a consistent rate of growth, the City's population by the end of 1994 would be approximately 5,227. The Council stated that they will consider this issue during the City's budget process this summer. BALD EAGLE 1 NDUSTR 1 AL_ PARh:: 1 MPRQVF_.MENT PRQJ ECT' UPDAT-E'. The staff has been in contact with property owners in the Bald Eagle Industrial Park regarding their desire for municipal water service. The engineer's cost estimate for installing water service through the industrial park. is $1225506, all of which would be assessable under the City's past practice. Business owners in the park have indicated a strong interest in obtaining municipal service, which is being made possible through the construction of the new water tower. Staff has prepared a petition under Minnesota Statute, Chapter 429, to implement this project, and is in the process of obtaining the required signatures under statute. There was no formal action taken on this matter. COUNTY ROAD 8A UPDATE Representatives from Kuusisto Engineering and the City Administrator met with the Washington County's Deputy Public Works Director on Mach `•:}', i947 to discuss proposed improvements to County Rd. SA. The County Board of Commissioners will be conducting a public hearing on the evening of April 6th to consider allocating funds for this project. A final decision .is expected to be made during the County Board's regular- meeting of April 13. Decisions will need to be made by the City on the following items: 1. Addition of sidewalk to the project. 2. Extension of the 12' watermain to Goodview Ave., as proposed in the City's comprehensive plan. 3. Obtaining additional right-of-way to allow for the improvements. 4. Maintenance of detour routes during the construction process. 5. Method and amount of assessments against benefitted property owners City Council meeting of March 15, 1993 Page _ Debra Barnes asked that. the City Administrator consider further installation of a bike path connection to Rice Lake Park:, and research assessment policies of adjacent communities regarding sidewalks. MISCELLANEOUS The Council was informed of a Local Board of Review training session to be held at Washinqton County on March 18, 1993. Hugo's Board of Review will. be held on Monday, April 12, 1993.. between 9:C>(-') AM and 1.1:00 AM. The City received a request from Stanford M*:rueger requestinq that his $1,00(--) refund, as conditioned in his SUP, be returned to him. It was the opinion of the City Attorney, Greg Galler, that the deposit should be refunded based on the following reasoning: 1. Money was deposited to cover the cost of building removal if home construction is not started. It is apparent that the City has no intention to have the building removed now. 2. The City did not follow through on threatened litigation. It was Mr. Caller's opinion that the $1,000 should be refunded to the Kruegers upon their showing proof that the property has been sold. Miran made motion, Barnes seconded, that the City of Hugo reimburse Stanford and Sandra Krueger their $1,000 deposit upon submission of proof that the property has been sold. All aye. Motion Carried. SELL PUBLISHING VS. HUGO CITY COUNCIL Leroux made motion, Barnes seconded, that the City Attorney review and prepare Findings of Fact regarding reimbursement of Council expenses incurred during litigation of Sell Publishing vs HLAgo City Council.
