HomeMy WebLinkAbout1979.02.14 PC MinutesMINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMIISSION February 14, 1979 The public hearing to consider the requests of Vern Peloquin, David Schwartz, and Robert Bernier for rezoning was called to order by Larry Ehret at 7:10 PM. PRESENT: Peltier, Greger, McAllister and Ehret ABSENT: Gillen - Peloquin was present as a member of the audience There was no one present stating objections to the rezoning. Peloquin stated that Joe Glamos and Joe Oman verbally told him they were not opposed to the rezoning. Mr. Robert Bernier stated his only concern was the 200' strip of land between the trailer court and his property which is zoned CB. He said that he would not like to see a business on that land because of the proximity of residential homes. If the business did not concur with the permitted use, the land owners in the area would be notified of a public hearing. The public hearing was closed at 7:24 PM. RICHARD GENRICH'- SPECIAL USE PERMIT The public hearing to consider the request of Richard Genrich to construct a 40 x 60 pole barn to be used in the operation, mainte- nance, and storage of a split wood supply was called to order by Larry Ehret at 7:35 PM. PRESENT: Peltier, Greger, McAllister and Ehret ABSENT: Peloquin and Gillen Mr. Ken Zimmerman, prospective owner of the property, was present and stated that the building will be constructed approximately 1100 feet from Goodview Avenue, on a 25 acre parcel zoned Agriculture. sirs. Steinkraus, 12821 Goodview Avenue,;inquired as to the type of vehicles to be used in the operation. Mr. Zimmerman said that four trucks will be used (1 - 22 ton and 3 - one ton). GILLEN ARRIVED AT 7:40 PM Robert Taylor, 12861 Goodview, questioned why he was not notified of the public hearing. Mrs. Peltier said that Deana Wells, 12182 Goodview, should have been notified because she was within the 300' boundary, but that Mr. Taylor's residence did not apply. Mr. Steinkraus requested that Zimmerman state the type of operation. The logs will be brought in from the Hinckley and MacGregor area. An electric hydraulic bar saw will be used so there will be no high pitched noise involved in the operation. The log splitter will also be of a hydraulic nature. All the work will be housed within the building, and the logs will be stored outside. The sawdust will be sold to a poultry business and nurseries. Mr. Zimmerman will not be using diseased trees, but cannot guarantee this statement. Hugo Planning Commission February 14, 1979 Page 2 of 5 Dr. Chapman, 12833 Goodview, stated that he would have to insist that no diseased trees be brought into the area to protect the existing area. He said that the area was basically residential, and a commercial opera— tion would not be consistent. Mr. Zimmerman stated that the trucks would be making approximately 8 trips a day. Mrs. Steinkraus questioned the load limit on Goodview Avenue. Gillen stated that Goodview was a 3 ton gravel road. Zimmerman stated that the majority of the traffic would be late summer and early fall, and did not plan on using the trucks during the spring. He would have to abide by the state's regulations regarding limits in the spring. He said that there would be no private traffic — all wholesale. Dr. Chapman asked if a house would be constructed, and Zimmerman stated that a house would be constructed in the future, subject to loan approval. Deana Wells, 12182 Goodview, asked if local residents would be liable for road improvements as a result of further damage to Goodview Avenue. Gillen stated that if a majority of home owners petitioned for im— provement, the benefited property would be assessed. The application for the Special Use Permit is for the entire 105 acres. Mrs. Peltier stated that there are two deeds involved (one for 25 acres and one for 80 acres). Dn Chapman asked about the 66' easement on the property, and Ehret stated that there was a 10 acre parcel that access would have to be provided. There would be more than one property owner using the road. It was determined that 130th Street would not be used for access because of the terrain. McAllister asked Mr. Zimmerman if he was aware of the problem of finding a perc on the property, and Zimmerman stated that there was a certified perc test on the 25 acre parcel. Deana Wells stated that extensive investigation had been done on zoning prior to their purchasing of the property, and were not aware of a possible commercial business going into the area. The public hearing was closed at 8:25 PI -Z. The regular meeting of the Planning Commission was called to order by Larry Ehret at 8:30 PM. PRESENT: Peloquin, Peltier, Greger, Gillen, McAllister and Ehret Motion made by Peltier, seconded by Peloquin, to approve the minutes of January 24, 1979, as presented. All aye. Motion Carried. Hugo Planning Commission February 14, 1979 Page 3 of 5 PELOQUIN, SCIWARTZ, BERNIER — REZONING Motion made by McAllister, seconded by Peltier, to recommend approval of the requests of Vern Peloquin, David Schwartz, and Robert Bernier to rezone their property from the CB district to the SFE district. VOTING FOR: Peltier, Greger, Gillen, McAllister and Ehret ABSTAINED: Peloquin Motion Carried. RICHARD GENRICH — SPECIAL USE PERMIT Mr. Zimmerman stated that there would be two heavy loads coming in a day, and smaller loads going out. He would not be opposed to the storing of the logs behind the building. be Gillen did not feel there would/any futher deterioration to Goodview Avenue unless the road was wet. Zimmerman stated that the truck would leave for up north at 6:00 AM, return at noon, make a return trip, and be back again at 7:00 PPT. He would construct a building the color determined by the Commission. Gillen stated that auto reduction yards are allowed in the Agriculture zone, and the wood operation is about the same in theory. I-1cAllister said that he was considering the Special Use Permit for the entire 105 acres, but not necessarily in favor of a permit for 25A. Motion made by Greger to table the request until the meeting of 2/28/79 for futher review. Motion failed for lack of second. Mr. Zimmerman stated that the building is being constructed on land in relation to the approved perc test taken. Ehret stated that the permit could be attached to the 105 acres, and could be null and void if the property is sold. Ehret stated that because of the concern expressed over the possible deterioration of Goodview Avenue, he would like to see a report from Howard Kuusisto. Notion made by Greger, seconded by Peloquin, to table the request of Richard Genrich until the meeting of 2/28/79, reason being the report from the City Engineer in regard to the status of Goodview Avenue and possible affect on said road by the use of hea trucks, not to exceed 8 or 10 trips a day (one 21 ton and three 1 ton7. If a Special Use Permit is issued to the applicant as presented (105 acre tract of land), does it address itself to the entire tract of land taking into considera— tion said tract currently has a deed for 80 acres and a deed for 25 acres, and the proposed building site for said request will be on the property on the 25 acre deed. VOTING FOR: Peloquin, Greger, Gillen, ITcAllister and Ehret ABSTAINED: Peltier Motion Carried. Hugo Planning Commission February 14, 1979 Pave 4 of 5 GERALD DABS - SUBDIVISION Mr. Dabe was present and stated that the parties involved have come to a stand still, because financial arrangements can't be resolved re- garding the road. Ehret felt that the only avenue left to Mr. Dabe was to go to court, and file a suit against the ;°Teber's. Mr. Dabe requested that his name be placed on the agenda for the City Council to discuss this matter further for some possible direction. Motion made by Peloquin, seconded by McAllister, to add Regal Plastics to the agenda. All aye. Motion Carried JOHN MOORE - SUBDIVISION (Discussion only) Mr. Moore stated that he has purchased the two homes previously owned by Ida Molitor. He questioned why the pre-%rinus request to divide the lots was turned down. Ehret stated they were non -conforming lots. It was the opinion of the Planning Commission that creating two addi- tional non -conforming lots was not what they wanted to do. Moore stated that the green house has been brought up to state code, and is now a single family resident (previously a duplex). The white house has only about 10 years before it woul�/ unfit for occupancy. Mr. Moore was instructed to make application for & Minor Subdivision. REGAL PLASTIC PRODUCTS Nr. Richard Olson stated that he is requesting permission to construct a 5000 sq ft cement block building on one acre of land in the Peloquin Industrial Park. Peloquin stated that the land was sold two years ago by metes and bounds. At present, a hardshell is being drawn for the area and should be ready by the end of the month. He said that right now the land is landlocked,and a temporary easement would have to be given. In the future, Freeland Avenue will provide access to the build- ing. Ehret stated that a perc test will be needed, and also a drainage plan for the ground water. Mr. Olson will also have to provide the number of employess in conjunction with the operation. A copy of the proposed site plan is to sent to Howard Yuusisto for his comments for the meeting of 2/28/79. EV,RETT GALLIVAN - REZONING Motion made by Ehret, seconded by T"cAllister, to table the request and a letter be sent requesting Mr. Gallivan to appear at the meeting of 2/28/79 to state exactly what he wants. All aye. i'otion Carried. REVIE'T OF APPLICATIONS FOR VACANCIES Motion made by Peltier, seconded by Greger, to recommend approval of Bill Hanson to fill the vacancy on the Planning Commission. LETTER FROM DAN KOEHLER The Planning Commission recommends to the City Council that charges to the city by the professional staff be for work authorized by the city only — notto include walkins.
