PRESENT: Barnes, Brunotte, Leroux, Miron, Stolt man City Administrator, Bob Museus Citi/ Attorney, Kevin Shoeberg Citi/ Clerk, Mary Ann Creager Miron made motion, Barnes seconded, to approve the minutes for the City Council meeting of April 5, 1993, as submitted. All aye. Motion Carried. Leroux made motion, Miron seconded, to approve the minutes for the special City Council meeting of April 6, 1997, as amended. All aye. Motion Carried. Stolt man made motion, Brunotte seconded, to approve the claims for April. 19, 1993, in the amount of $36,345.03. All aye. Motion Carried. EX TENSION OF MUN I C I PAL ._ WATE:_F __ HALD -EAGLE _[ NDUS_I"F_I AL PARK) A public hearing was called to consider a petition by property owners in the Bald Eagle Industrial Farb: for extension of municipal water to serve= their businesses. The estimated project cost. is $122,506, all of which .is accessible against the benefitted property owners. Since the last Council. meeting, Judd Jackson, representing both Judd A. Jackson, Inc., and (grace Development Corporation, has added his name to the petition, bringing the owners of 77% the front -footage to be benefitted by this project requesting the extension. Eric Wharton, representing the City's consulting engineer firm, was present to explain changes to the project requested by certain property owners to be benefitted. the public hearing was opened, with only one comment from Torn Emery, Wilson Tool, supporting the project. Leroux made motion, Miron seconded, to adopt RESOLUTION 1993-4, RESOLUT l 0,1 ORDERING THE IMPROVEMENT OF 130TH STREET AND FARNHAM AVENUE_ IN THE BALD EAGLE INDUSTRIAL PARK BY THE INSTALLATION OF MUNICIPAL WATER SERVICE. VOTING AYE: Barnes, Erunotte, Leroux, Hiron, Stoltzman VOTING NAY: None Motion Carried. RUF'KU (UF F ; APJGE� Mr. Jerome Rupkus requested a variance to construct a pole building on the street -side of his home located at 16315 Harrow Avenue North. Section 320-5, Subd. H(4) of` the City's zoning ordinance disallows accessory buildings from being located nearer to the front lot line than the principal building on a lot in an agriculture district. As Mr. Rupkus is using his property for agricultural purposes, the variance may be granted as part of his farm site plan approval. City Council meeting of April 19, 1993 Page Miron made motion, Leroux seconded, to grant a variance to Jerome Rupkus, 16315 Harrow Avenue, to construct an accessory building closer to the front lot line than the principal building, according to the submitted site plan. LUTZ (SITE PLAN REVIEW)_ On October 7, 1991, the Hugo City Council granted permission to John Lutz to construct a new single family dwelling on his property located at 8050 157th Street. North. As there was already an existing residence on this property, the Council conditioned approval of the site plan by giving Mr. Lutz three options in meeting the City's requirement that only one residential dwelling by placed on a lot in an agricultural district of the City. Mr. Lutz's options were: 1. Designate the older residence a farm accessory building with no human habitation allowed. 2. Removal of the older residence from the site. 3. If the older residence is to be used as a single family dwelling, the property would have to be subdivided consistent with City subdivision regulations. Mr. Lutz requested that the City allow him an add:i.ti.onal six months to bring his property into compliance with the conditions of site plan approval in order to provide his family the opportunity to settle the estate of his parents, with which the parcel is .included. RAMSEY ACTION PROGRAM The Hugo City Council received a request from Patrick Miller that he be appointed to the Ramsey Action Programs, Target Area Advisory Council for Washington County. The Council requested that staff review •t.;• -:.is program and appointment, and report to the City Council. Majel Carroll! representing the Ramsey Action Programs, addressed t:.t•e Council with _-.. background brief on the program. Stoltzman made motion, Barnes seconded, to appoint Mr. Patrick Miller as Hugo's representative on the Ramsey Action Programs, Target Area Advisory Council, for Washington County. Mr. Miller is appointed to the Council for a two-year period. All aye. Motion Carried. City Council meeting of April 19, 1993 Page _ DMH AMBULANCE SERVICE Mr. Joseph Graff appeared before the Council to brief them on the DMH's ambulance service, and, specifically, the possibility of a Joint Powers Agreement for future operation of the ambulance service. Miron made motion, Leroux; seconded, the Mayor Stolt man be appointed to represent the City of Hugo at a meeting to be held on May 6th to discuss the feasibility of formulating an "Ambulance Task Force" to explore options available to provide for the health and welfare of residents. Debra Barnes will serve as an alternate. All aye. Motion Carried. HUGO FIREMAN `.S RELIEF ASSN _CHAR I TAQLE_-GAMHL I 1 !G _L 1 [TErJ'SE The Hugo Fireman's Relief Association requested a charitable gambling license in order to conduct a raffle on June 6th as part of the Hugo Lions Club Good Neighbor Days celebration. Miron made motion, Brunotte seconded, approving the charitable gambling license for the Hugo Fireman's Relief Association to conduct a raffle on June 6, 1993, as a part of Good Neighbor Days. All aye. Motion Carried. WATER SUPPLY WELL #2 Miron made motion, Stolt man seconded, to approve change order #1 placing the well -depth in the Shakopee aquifer. All aye. Motion Carried. BALL FIELD_FENCE SOUOTES) Last Fall, the City of Hugo received a complaint from a property owner living on the east side of Fitzgerald Avenue that balls from the City's softball field were routinely bouncing off his garage, and at one time, had broken a window on the garage. Council. directed staff to review options in establishing a fence along the west side of Fitzgerald Avenue to block balls from crossing the street.. Ouotes have been received from three firms for the construction of an N' fence along Fitzgerald Avenue, which ranged from $2,615 to $2,935. In discussing this issue with the White Bear ',....ak:e sc.:h'tc:ol district sl.lfllfTter recreation program's manager, it was the staff's conclusion that installation of this fence would not solve the problem of balls crossing Fitzgerald Avenue. The reason for t:hi., is that according to information received from the school district, the desired outfield -fence distance from home plate is 00', and there is only 275' available from the plate to the roadway. The school district's estimate is that an 8' fence would catch approximately 50% of the balls that are now currently entering the complainant's property. To resolve this concern, the school district has agreed to schedule adult softball City Council meeting of April 14, 1993 Page 4 play on the north western field so that players would be batting towards the cemetery. This would eliminate balls flying into the property located east of Fitzgerald Avenue, except for tournament play where both fields would be necessary. This option has the benefit of relieving the. City of the cost of installing a fence, and would provide greater relief to the property owner in question. Miron made motion, Barnes seconded, to accept staff's recommendation so that adult softball games be scheduled on the northwestern field so that players would be batting towards the cemetery, VOTING AYE: Barnes, Miron, Stoltzman VOTING NAY: Brunotte ABSTAINED: Leroux Motion Carried. OPEN MEETING L.AW F I ND I NGS The Council received the revised Findings by City Attorney, Greg Galler, regarding the recent court case involving Sell Publishing and the City Council. Mr. Galler is recommending acceptance of the Findings by the Council, and approval of a Petition to the 10th Judicial District for review of the Findings and approval of the City's reimbursement to the Council of legal expenses incurred in this matter. Leroux made motion, Brunotte seconded, directing the City Attorney, Greg Galler, to file the Findings of Fact along with the Petition for review and other documents with the District Court. All aye. Leroux made motion, Brunotte seconded, to adopt RESOLUTION 1993--5, RESOLUTION REGARDING REIMBURSEMENT OF ATTORNEYS FEES INCURRED BY INDIVIDUAL COUNCIL MEMBERS IN DEFENDING AN OPEN MEETING LAW VIOLATION LAWSUIT. WASHINGTON COUNTY 4m"10- I C:AL ScI E:T'Y Councilman Miron discussed his recent visit with the WCHS, and their efforts to preserve/renovate the "Brisson" cemetery on 147th Street. 121ST LAKE ACCESS Jess Rausch addressed the Council regarding the 121st Street access. Because of a recent White Bear Press article, there was some confusion regarding what was to be discussed at tonight's Council meeting. Miron made motion, Brunotte seconded, directing the City Administrator to communicate with the Oak Shore Park.
