Miron made motion, Brunotte seconded, to approve the minutes for the City
Council meeting of June 21, 1993, as submitted.

St. John the Baptist Church has applied for a daily on sale 3.2 beer-
license
eerlicense for the sale of beer at their annual Fall Festival to be held on
August 22, 1993. Due to expected sales of less than $500.00, city
ordinance does not require St. John's to provide proof of liability
insurance. Staff recommends approval of the license.
Miron made motion, Barnes seconded, to issue an on -sale 3.2 beer license
to the Church of St. John the Baptist for the sale of beer at their Fall
Festival to be held on August 22, 1993.

The Hugo Lions Club has applied for a Minnesota Lawful Gambling Permit to
conduct charitable gambling at RJ's located at 13891 Forest Blvd., in
Hugo. The Lions have held charitable gambling licenses with the City at
other locations for a number of years' Staff recommends approval of the
license'
Brunotte made motion, ri-on seconded, to aporove the Charitable Gambling
License for the Hugo Lions Club to conduct gambling at RJ's, 13891 Forest
Blvd., and waiver of an" waiting period'

Bids for the City's 1993 G.O. Water Revenue Bond were received by the
City'= financial consultant, Ehlers and Associates, the morning of July 6,
1993. The bids were tabulated by Ehlers, and Carolyn Drude reported the
results to the Council. The low bidder was Piper, Jaffray, Inc.. at an
interest rate of 4'7771%' Bond proceeds are being used to finance the
construction of the City's new water tower, well, and certain watermain
improvements.

RESOLUTION ACCEPTING PROPOSAL ON SALE OF $1,205,000 G.O. WATER AND SEWER
REVENUE BONDS OF 1993, AND PROVIDING FOR THEIR ISSUANCE

Drainage Report on Lake Air Estates, at this time.

The City received a report from Howard Kuusisto regarding improvement
corrections to the drainage facilities for Lake Air Estates- The City
Engineer provided three options ranging in cost from $55,189 to $3815107.
Barnes made motion, Stoltzman seconded, to accept the report of Howard
Kuusisto regarding drainage facilities for Lake Air Estates.

The City Engineer will meet with residents on July 27, 1993, from 4:00 PM
until 6:00 PM, to discuss his report with them.
The Council considered a revised final plat for the RICE LAKE MEADOWS 2ND
ADDITION, which includes the drainage easements requested by the Council
on June 21st, as well as alterations of drainage patterns that were
requested on the west and of 145th Street. The Council also expressed
concerns about the future improvement to Goodview Avenue, south of the
subdivision, as well as potential impact of the subdivision on the
drainage through Rice Lake. The developers indicated belief that a
requirement to improve Goodview Avenue as part of the suLdivision approval
is excessive, considering the current improved access to the site from
Geneva Avenue, and that this matter was discussed during the preliminary
plat for subdivision and a settlement agreed upon. Review of the drainage
issues indicates to staff that the primary concern for drainage from Rice
Lake are caused by blockages in Rice Creek, wnich are the responsibility
of the watershed district. Staffj indicated it mav be aLmrorriate to
condition approval of the subdivision contingent upor Wine Creek Watershed
District's correction of outflow problems from Rico Lake'

Mr' Ken Roesler of Kenco Construction requested that the watershed
condition be removed from the motion' The motion stood as approved'
The Council received a letter from Merila and Associates, representing
Kenco, requesting reimbursement for certain public improvements
constructed during the 1st phase of the RICE LAKE MEADOWS subdivision.
The request may be broken down into two parts:
1. Reimbursement for oversized sanitary sewer and watermains, through the
project to eventually serve adjacent properties'
2' A request to assess adjacent properties in the future for installing
trunk facilities from Oneka Lake Boulevard to the project site.
Paragraph 20 in the Development Agreement between Kenco and the City of
Hugo, dated July 69 1992, states that the developer agrees to pay for all
costs incurred of whatever kind or nature in order to construct the
improvements indicated in this Agreement, or otherwise develop the
property' Based on this Agreement, it would seem to be inappropriate fpr
the City to assess adjacent property owners in the future for the trunk
facilities extended into the RICE LAKE MEADOWS subdivision by Kenco, given
that the subdivision could not be developed without them' Staff supported
reimbursement to Kenco for the oversized utilities to serve adjacent
properties, as this was specifically requested by the City to serve other
properties.

The Hugo Planning Commission conducted a public hearing on June 23, 1993,
to consider the granting of a SUP to Howard Arcand, et al, for the
construction of a golf course at the E 1/2 of the SW 1/4 and the W 1/2 of
the SW 1/49 Section 32, T31N, R21W, Washington County, MN. The PC
recommended approval of the SUP with conditions.
Stoltzman made motion, Brunotte seconded, to approve the Special Use
Permit for Howard Arcand, et alr for the construction of a golf course'

the golf course under the special use permit approved previously' The
plan has received approval from the Rice Creek Watershed District' DNR

and the Corp=_. of Engineer's approval is pending. Staff stated that any
approval granted be contingent upon the developer meeting all requirements
of the Rice Creek Watershed District, Minnesota DNF:, Army Corps of
Engineers, and other regulatory agencies having authority over this
project.

Mayor Stoltzman stepped down, and Councilman M.i.ron served as acting Mayor.
On June 2=, 1993, the Hugo Planning Commission conducted a public t-ir=•ar-ing
regarding the application by Laura Stolt: man for a SUP to ooerate an auto

The Council reviewed the Development Agreement between the City of Hugo
and Arlington Properties for development of the COUNTRY PONDS
subdivision' This Development Agreement was initially prepared when the
developer intended to construct all 98 lots concurrently, and will need
be altered to represent the 34 lots currently proposed. In addition, a
paragraph outlining the developer's responsibility for site -grading may
required. The City Council, in the past, required developers to deposit
with the City funds to cover the first seal coating of the streets
constructed during the development. The Council may wish to add this
requirement to the Agreement.
Miron made motion, Stoltzman seconded, to table this matter until the
meeting of July 19, 1993.

The Council reviewed a minor MUSA amendment prepared by the City's
consulting engineer to add a portion of the COUNTRY PONDS development into
the City's municipal utility -service area. Upon Council approval, the
application will be forwarded to the Met Council for action.

Glamos Wire Products requested site plan approval for constructing a 100'
x 200' steel cold exterior warehouse onto their existing building located
at 5564 152nd Street North (Peloquin IndustriaPark). Approval of the
expansion was foreseen during approval process for the existing building
in 1987. The site -drainage plan was approved bv the Rice Creek Watershed
District on June 17, 1987. Staff review indicetes that the building meets
our requirements of the City's zoning ordinanceHugo Citv [ode, Chapter
219-6, requires parking areas be oaved.

The Committee, established to make a recommendation to the Council for the
selection of a Fire Chief, has recommended that the existing position of
City Council meeting of .July o, 199:

Fire Chief in the City of Hugo be amended to establish two separate duty
positions, one as Fire Chief and one as Fire Marshal.. The purpose of this
change is to allow the Fire Chief to concentrate more on the operation of
the Department, and provide an additional position to handle fire
prevention and inspection. The Council considered the job descriptions
prepared by the Committee for the two positions. Staff recommends
approval as presented.

SETTLEMENT_ AGREEMErJ:�
The City Attorney negotiated a settlement with the estate of Thomas
Bernier regarding Mr. Berni.er's interest in benefits from the Hugo
Firefighters Relief Assn. The Agreement calls for the payment, by the
City Council meeting of July 5, 194_-'

Relief Association, of $=,000 to the estate of Mr. Bernier, in return for
release of all claims in this matter. The Relief Association has reviewed
and approved the Settlement. Staff recommends approval by the Council.
