PRESENT: Brunotte, Leroux, Miron, Stoltzman City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Howard kuusisto City Clerk, Mary Ann Creager ABSENT: Debra Barnes Miron made motion, Leroux seconded, to approve the minutes for the City Council meeting of August 2, 1993, as submitted. All aye. Motion Carried. Miron made motion, Brunotte seconded, to approve the minutes for the special Council meeting of August 9, 1993, as submitted. All aye. Motion Carried. Leroux made motion, Miron seconded, to approve the claims for August 16, 1993, in the amount of $56,537.95. All aye. Motion Carried. NSP FRANCHISES On July 19, 1993, the City Council considered a request from NSP for franchises to serve natural gas and electricity to residents of the City of Hugo. At that time, the City Council directed a public hearing be scheduled to consider public input on the awarding of these franchises to NSP. Mayor Stoltzman called to public hearing to order, and there were no oral or written comments regarding these ordinances. Leroux made motion, Miron seconded, to adopt ORDINANCE 93-263, AN ORDINANCE GRANTING TO NSP, A MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS PERMISSION TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN IN THE CITY OF HUGO, MINNESOTA, AN ELECTRIC DISTRIBUTION SYSTEM AND TRANSMISSION LINES, INCLUDING NECESSARY POLES, POLE LINES, FIXTURES AND APPURTENANCES, FOR THE FURNISHING OF ELECTRIC ENERGY TO THE CITY AND ITS INHABITANTS. AND OTHERS, AND TO USE THE PUBLIC WAYS AND PUBLIC GROUNDS OF SAID CITY FOR SUCH PURPOSES. VOTING AYE: Brunotte, Leroux, Miron, Stoltzman Motion Carried. Leroux made motion, Stoltzman seconded, to adopt ORDINANCE 93-264, AN ORDINANCE GRANTING TO NSP, A MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS PERMISSION TO ERECT A GAS DISTRIBUTION SYSTEM FOR THE PURPOSE OF INSTALLING, ENLARGING, OPERATING, REPAIRING AND MAINTAINING IT THE CITY OF HUGO, MINNESOTA, THE NECESSARY GAS PIPES, MAINS, AND APPURTENANCES FOR THE TRANSMISSION OR DISTRIBUTION OF GAS TO SAID CITY AND ITS INHABITANTS AND OTHERS AND TRANSMITTING GAS INTO AND THROUGH SAID CITY AND TO USE THE PUBLIC WAYS AND PUBLIC GROUNDS OF SAID CITY FOR SUCH PURPOSE. City Council meeting of August 16, 1993 Page 2 COUNTRY PONDS DEVELOPMENT AGREEMENT On August 2, 1993, the City Council considered the Development Agreement between the City of Hugo and Arlington Properties for development of a subdivision known as Country Ponds. Public comment was received leaving concerns that there were requirements placed on Arlington Properties by the RCWD for improvement to a certain ditch draining the property. Staff contacted the watershed district to determine what requirements, if any, had been placed on Arlington Properties by the district. The RCWD informed the City that no special restrictions or conditions had been placed on the Country Ponds development. After further discussion, there was still a question as to whether Rice Creek granted the permit with the understanding that Hugo was going to be responsible for overseeing the ditch cleaning. Miron made motion, Stoltzman seconded, to table approval of the Development Agreement until the following issues are addressed: current ground water elevations and ditch -cleaning responsibility. All aye. Motion Carried. SUNSET LANE RIDGE (PRELIMINARY PLAT) Gary Vizenor, representing the developer, explained the latest proposal for platting, whereby only one lot would be substandard to the five acre requirement. There was discussion about the need for a drainage plan, and Mr. Vizenor stated that he understood such a plan would be required, and that work would be started as soon as they had preliminary plat approval. Leroux made motion, Miron seconded, to grant preliminary plat approval for the Sunset Lake Ridge subdivision, subject to development of an approved drainage plan. All aye. Motion Carried. O'MARA SETTLEMENT In 1991, the City constructed improvements to Harrow Avenue in front of 16337 Harrow Avenue as part of the City's CIP Phase 2 program. Bill O'Mara, the property owner, complained to the City that the improvements resulted in increased water retention on his property, enlarging a pond on the southwest corner of his lot. Staff requested that Mr. O'Mara provide the City a cost -estimate for filling the area to his satisfaction. Mr. O'Mara's estimate from A & B Construction is $2,225.00. Staff recommended reimbursing Mr. O'Mara to a maximum amount of $2,225.00 for correcting the drainage problems on his lot, subject to a release signed by Mr. O'Mara holding the City harmless for any future drainage problems on his property, and also, that Mr. O'Mara hold the City harmless from any results of the filling. Mayor Stoltzman asked for a sketch of the proposed work, but none was available. He also inquired where the excess water, would go (adjoining property?). Miron made motion, Leroux seconded, to table this matter to allow staff to review and submit a plan to the Council. All aye. Motion Carried. City Council meeting of August 16, 1993 Page 3 LETTER TO ADAM PISKUAR Mr. Adam Piskuar of the Minnesota Technical Institute System indicated a concern with conflicts surrounding the Hugo Volunteer Fire Department. He indicated it would be beneficial to have a letter from the City outlining the City's position in changes being made to the Fire Department, and the Minnesota Technical Institute's participation in the process. Staff prepared such a letter for Council approval. Miron made motion, Leroux seconded, authorizing City staff to send the letter to Mr. Piskuar, as drafted. All aye. Motion Carried. COUNCIL WORKSHOP PROPOSAL Eased on Council guidance of August 2, 1993, staff contacted Government Training Service about providing a workshop for the Council on the legal authority of Council members. They indicated their ability to provide such a workshop, which would be approximately four hours in duration. The City Administrator suggested the workshop be held on a Saturday, with the GTS workshop in the morning, and a water management workshop in the afternoon. Miron made motion, Leroux seconded, to schedule a workshop day for Saturday, September 25, 1993. All aye. Motion Carried. UPDATE (DRAINAGE DITCH, SE QUADRANT BA AND HIGHWAY 61) In preparing the legal descriptions for easements for City access to clean the drainage ditch located across the Arcand property in north west to Highway 61, the City Engineer has indicated the need to do initial design work prior to establishing easements in order to determine the extent of mitigation required during the project. The City Administrator has directed the engineer to proceed with the initial cleaning plan, as a matter of timeliness. The engineer indicated that easement descriptions should be available to the City by the end of August. UPDATE ( l._AM::E A I R ESTATES DRAINAGE REVIEW) Eased on Council guidance, the City Administrator contracted with TK*DA in order to perform a review of the drainage problems being experienced in Lake Air Estates and adjacent areas. This project will include collection of the necessary data, reviewing design and existing drainage system, conducting a field review of the existing system, and recommending an improvement program as well as potential methods of financing, and presenting reports as necessary to the City Council. Cost for this project is agreed not to exceed $3,800.00. The report should be available for the Council meeting of September 7, 1993. City Council meeting of August ib. 1993 Page 4 FIRE DEPARTMENT APPOINTMENT (MCMAHON) Leroux made motion, Miron seconded, to appoint Joseph McMahon to the Hugo Volunteer Fire Department, effective August ib, 1993. All aye. Motion Carried. MISCELLANEOUS NONPOINT POLLUTION ORDINANCE Miron made motion. Stoltzman seconded, directing staff to refer scheduling of a public hearing to amend existing City ordinances to include interim strategy to reduce nonpoint source pollution to the Hugo Planning Commission. All aye. Motion Carried. HUGO PLANNING COMMISSION VACANCY A Committee was appointed by the Council on June 7, 1993 to review candidates for the PC position recently vacated by Bill Mezzano, and recommended appointment of David Schumann to fill the vacancy. City resident, Carole LaBelle, addressed the Council stating her opposition to the recommendation. Miron made motion, Brunotte seconded, to appoint David Schumann to the Hugo Planning Commission for a term to expire 12/31/94. VOTING AYE: Brunotte, Leroux, Miron VOTING NAY: Stoltzman Motion Carried. WALLER DRAINAGE PROBLEM Ed Waller addressed the Council with possible solutions to his water problem. Miron made motion, Brunotte seconded, directing staff review Waller's recommendations If an on-site inspection is conducted, Mr. Waller and Councilman Leroux are to be notified. All aye. Motion Carried. Pauline Daubenspeck and Warren Arcand apologized to the City Council for statements made at a previous Council meeting.
