PRESENT: Barnes, Brunotte, LeroUX, Miron, Stolt man City Administrator, Robert MUseU5 City Attorney, Greg Galler City Engineer, Howard KUUsisto City Clerk, Mary Ann Creager Leroux: made motion, Stolt man seconded, to approve the minutes for the City Council meeting of August ib, 1997., as amended. VOTING AYE: Brunotte, Leroux, Miron, Stolt man ABSTAINED: Barnes Motion Carried. LeroUx made motion, Brunotte seconded, to approve the claims for September 7, 1993, in the amount of $389,569.99. All aye. Motion Carried. SPECIAL USE PERMIT (SNELL) Egad and Audrey Snell, 14927 Forest Blvd.. applied for a SUP to exceed the permitted accessory storage allowed in the SFU district. The Planning Commission considered their request on Augusts, 1993, and recommended approval for construction of a 864 square foot accessory building, subject to special conditions. LeroUX made motion, Miron seconded, to approve the Special Use Permit request of Brad Snell, 14927 Forest Blvd., to exceed the permitted accessory storage allowed in the SFU district by construction of an 864 square foot accessory building. Approval is subject to the following special conditions: 1. The owner shall provide a cash deposit or letter of credit, in the amount of $1,000, to assure the removal of the existing 1'2' x 14' building. The 12' :: 14' building must be removed within 60days of completion of the new garage. 3. The proposed building shall be used for residential purposes only. All aye. Motion Carried. SPECIAL USE PERMIT (HAL. UPSKY_ Grover Storm and Lloyd Chalupsky applied for a SUP to construct a garage on part of the SW 1/4 of the SE 1/4, Section 7, T.31N, R21W, Washington County, without a home on the parcel. The ChalUps6:.ys are purchasing the property from Mr. Storm on a contract for deed, and are living on an adjacent parcel. City Code, Chapter .32"i_)-5, SUbd. H(1), states that no accessory building or use shall be constructed or developed on a lot prior to construction of a principal building to which it is accessory, except by SUP. The ChalUpskys have an ownership interest in both parcels, and have indicated their intent to maintain such ownership in the future. The City Council meeting of September 7, 1993 Page 2 PC considered this request at their meeting of August 25, 1993, and recommended approval of the SUP to construct a storage building on the lot adjacent to the Chalupsky residence at E3010 - 1•30th Street, subject to special conditions. Miron made motion, Brunotte seconded, to approve the Special Use Permit request of Grover Storm and Lloyd Chalupsky to construct a storage building on that part of the SW 1/4 of the SE 1/4, Section 27, T31N, R21W, Washington County, MN., adjacent to the Chalupsky residence at E3010 13oth Street. Approval is subject to the following special conditions: 1. The SUP shall terminate at any time the parcels currently owned by the Chalupsky's are sold or transferred separately. 2. The Chalupskys represent and warrant to reimburse the -City for all fees and expenses involved in enforcement of City Ordinances on their property subject to the SUP. All aye. Motion Carried. VARIANCE (GAMBONI) Martin Gamboni applied for a variance to construct an addition on the front of his house located at 14715 Forest Blvd. Mr. Gamboni wishes to add a 4' addition to the front of his house, bringing the home within 11' of Trunk Highway 61. Mr. Gamboni's home is located in a Cb district, which requires a front yard setback: of 10'. Chapter 320-5, Subd. D(5) of the Hugo City Code, states that where adjoining structures existing at the time of adoption of this ordinance have a different setback: from that required, the front setback of a new structure shall conform to prevailing setback in the immediate vicinity. In this case, Mr. Gamboni's addition will be forward of the setbacks of adjacent property. The Board of Zoning Adjustments considered this request at their meeting of August 25, 199•_x, and recommended approval. Stolt man made motion, Leroux: seconded, to approve the variance request of Martin Gamboni, 14715 Forest Blvd., to construct a 12' addition to the front of his house, 11' from Trun4:. Highway 61. VOTING AYE: Brunotte, Leroux:, Miron, Stolt man VOTING NAY: Barnes Motion Carried. Councilwoman Barnes stated her reasons for voting against the motion: alternate sites available for the addition, house was already closest to the road along highway, and possible problems should the highway be widened. SPECIAL USE PERMIT (STOLTZMAN) On August 16, 1993, the Hugo City Council tabled action on this matter until the meeting of September 7, 1993. The City Attorney provided possible amendments to the SUP for Council consideration. The Citi/ received a letter from Mr. Stolt man's attorney requesting the tabling of this matter. VOTING AYE: Barnes, Brunotte, Leroux, Miron ABSTAINED: Stolt man Motion Carried. BRAUN INTERTEC PRESENTATION Colby Verdigan, representing Braun Intertec, made a presentation to the City Council regarding the firm's determination of ground water levels and their relationship to first floor elevations in subdivisibns. DRAFT SURVEY (COMPREHENSIVE FLAN) Judy Marshik, representing Research QUik, reviewed with the Council, the draft -survey currently under review by the Comprehensive Flan Study Commissions and the Planning Commission. STORM WATER DRAINAGE ISSUES The City has received three complaints regarding the impact of property development on storm water flows. In order to adequately address these complaints, staff requested that the Council establish standards to be used in determining the validity of these complaints. The Council reviewed the City Administrator's recommendation for such standards. This matter will be discussed further at the Council workshop set for September 25, 1993. FIRE RELIEF BENEFIT CHANGE The Council considered a request from the Hugo Firemen Relief Association to increase retirement benefits for qualifying members of the Hugo Volunteer FD from $600.00 per year of service to per year of service, effective January 1, 1994. Ron Otkin, the City's Finance Director, reviewed this request, as well as the current financial statements of the Fire Department, and believes that the Relief Association has sufficient assets to provide this increase in benefits without additional funding from the City. Staff recommended approval of the benefit change. LeroUX made motion, Miron seconded, to approve the request from the Hugo Firemen Relief Association to increase the retirement benefits for qualifying members from $600.00 per year of service to per year of service, effective January 1, 1994. A11 aye. Motion Carried. FIRE FIGHTER APPLICATION Jim Wisner, Fire Chief, recommended the appointment of Richard P. Inott as a fire fighter in the Hugo Volunteer FD. City Council meeting of September 7, 1993 Page 4 Miron made motion, Brunotte seconded, to accept the recommendation of the Hugo Fire Chief and appoint Richard P. Inott as a fire fighter on the Hugo Volunteer Fire Department, effective 09/07/93. All aye. Motion Carried. After this meeting, the Council learned that the Fire Chief had NOT made a recommendation on this appointment, and will again be addressed by the Council after such recommendation is made. SPECIAL BUDGET MEETING Staff requested the Council conduct a special meeting of the evening of September 13, 1993 to review the City's general fund budget and tax levy for 1994. Stoltzman made motion, Leroux; seconded, to recess tonight's meeting until September 13, 1993, 8:00 PM, Hugo City Hall, to review the City's general fund budget and tax levy for 1994. All aye. COUNCIL WORKSHOP As previously discussed, the City Administrator organized a Council workshop for Saturday, September 25, 1993, to review Council organization and the City's role and responsibility in surface water management. 199•? GRAVEL PROJECT The City received two bids for this year's gravel project, the low bidder being Valley Paving at $4.86 per ton. The other bid was received from Dresel Contracting of Forest Lake, MN. Miron made motion, Leroux; seconded, to accept the low bid and award the 1993 gravel project bid to Valley Paving at $4.86 per ton. All aye. Motion Carried. MISCELLANEOUS After review of the drainage complaint registered by Dean Atkinson, an on-site inspection was made of the area by the City's engineering firm and developer, Jim Merila. The City Administrator summarized their findings, stating that the Birch Tree Ponds development is NOT increasing water flow onto Mr. Atkinson's property, the outflow of water has improved, and no further consideration need be given to Mr. Atkinson's complaint. Leroux made motion, Barnes seconded, to accept the recommendation of the City Engineer regarding the Dean Atkinson drainage complaint, and request that his recommendation be submitted in writing for review by the Council at the meeting of 09/20/93. Page 5 The City received a letter from. a resident regarding the need for a controlled intersection at Highway 61 and County Road 8 (145th Street). This matter is to be placed on the agenda for the meeting of 9/20/9:.
