PRESENT: Barnes, Brunotte, Leroux:, Miron, Stoltzman City Attorney, Greg Galler City Engineer, Howard h;uusisto City Clerk., Mary Ann Creager Leroux: made motion, Barnes seconded, to approve the minutes for the City Council meeting of September 7, 1993, after the following wording is inserted after the appointment of Richard Inott to the FD: The Council learned that the Fire Chief had NOT made a recommendation on this appointment, and will again be addressed by the Council after such recommendation is made. All aye. Motion Carried. Miron made motion, Brunotte seconded, to approve the minutes for the budget meeting of September 13, 1993, as submitted. All aye. Motion Carried. Miron made motion, Stoltzman seconded, to approve the claims for September 200 1993, in the amount of $41,948.51. All aye. Motion Carried. VARIANCE REQUEST (FIRKUS) Jeff Firk:us of 13975 Homestead Avenue North requested a variance to construct a 30' x: 40' pole building between his home and Homestead Avenue. Present zoning classification of this property is RR2. Hugo City Code, Chapter 320-5, Subd. H(4) states that no detached garage or other accessory building shall be located nearer to the front lot line than the principal building on this lot. Miron made motion. Leroux: seconded, to approve the variance request of Jeff Firk:us, 13975 Homestead Avenue, to construct a 30' x; 40' pole building between his home and Homestead Avenue. The proposed building shall be used for residential purposes only. All aye. Motion Carried. WASHINGTON COUNTY COMP PLAN REVIEW PRESENTATION Merritt Clapp -Smith of Washington County's Planning staff appeared before the Council to present a summary of Washington County's process in reviewing its Comprehensive Plan. She encouraged community participation in the process. She asked that they be kept informed of Hugo's progress in updating our Comprehensive Plan. Washington Count/ Commissioner Dennis Hegberg informed the Council that Metro Council would be addressing possible revisions in its MUSA, which could be consequential to Hugo. DEVELOPMENT AGREEMENT (COUNTRY PONDS) Previously, the Council had expressed concerns regarding first -floor elevations for the project. On September 7, 1993, a representative from City Council meeting of September 2C.), 1993 Rage 2 Braun Intertec presented the Council background on how ground water elevations are determined. Larry Olson, representing Arlington Properties, explained to the Council how the developer intends to implement the City standard with the information they have received from Braun. There was continued discussion on the necessity of cleaning the ditch. Miron made motion, Barnes seconded, to approve the Development Agreement between the City of Hugo and Arlington Properties, for the subdivision known as COUNTRY PONDS, and direct City staff to work with the developers in an attempt to have them clean the ditch to the extent previously offered. All aye. Motion Carried. Leroux made motion, Stoltzman seconded, directing City staff to develop a policy that addresses the following: 1. No Building Permit to be issued until the surface drainage and erosion -control measures for each phase in a development are in place. I') Spot checks of surface elevations for construction to be conducted by the City Engineer. All aye. Motion Carried. SPECIAL USE PERMIT (STOLTZMAN) Mayor Stoltzman removed himself from his position on the Council. Lee Ann Bocwinski, attorney for Mr. Stoltzman, addressed the Council regarding the City Attorney's response to their proposal. After a long discussion to resolve points in the Agreement, the following motion was made: Miran made motion, Barnes seconded, to table this matter until the meeting of October 4, 1993, allowing time for the attorneys to discuss conditions of the Settlement Agreement. All aye. Motion Carried. PUBLIC SAFETY SIREN In 1989, the City reviewed expansion of its public safety warning system; specifically, the addition of four additional sirens located throughout the heavier populated areas of the community. At that time, a cost estimate, prepared by Federal Warning Systems, indicated the total cost for the system expansion would be $53,864.00. Wilson Tool indicated to the City a concern that the single -existing siren located in Hugo does not adequately serve their place of business, and has requested the addition of a siren in their vicinity. Currently, the City has $16,320 set aside for the siren -development programa and City staff recommended the addition of a siren on the new water tower being constructed at the intersection of 130th Street and Falcon Avenue. This siren would serve residents from 120th Street to 140th Street, and from Elmcrest Avenue to Goodview Avenue, encompassing the Bald Eagle Industrial Parti;, Lake Air Estates, Bald Eagle City Council meeting of September 20, 1993 Page L Estates, Oak Shore Park„ and rural residents within the area. The siren would be in compliance with the City's 1989 plan. Stoltzman made motion, Barnes seconded, to advertise for bids to install a public warning system on the new water tower located in the Bald Eagle Industrial Park. All aye. Motion Carried. LeroUX made motion, Miron seconded, directing City staff to research a policy on obtaining funds from developers or Federal grants to fund an Early Warning System and report to the City Council. All aye. Motion Carried. ENGINEER'S REPORT (130TH STREET) On August 2, 199.3, the City Council reviewed a report from the City Engineer regarding the condition of 130th Street, from Goodview Avenue to Highway 61. The engineer recommended that crack filler be applied to the road this year. Miron made motion, LeroUX seconded, authorizing City staff to proceed with application of crack filler on 130th Street as funding or weather permits, based on the engineer's recommendation. All aye. Motion Carried. ENGINEER'S REPORT (STREET SIGNAGE) During the last 18 months, residents have expressed concerns regarding street signage at various points in the City. These concerns were provided to the engineering firm doing the Hazardous Elimination Grant Program, and some of the signs were taken care of as part of that Program. Certain signs either were not eligible for the'Program or did not meet the requirements established for that type of signage at that location. The requests not approved as a part of the Program were forwarded to the City Engineer, and the engineer has recommended that the following signs be installed: 1. A Yield sign installed on Homestead Avenue at 157th Street. 2. A Stop sign on Exhall Avenue at 126th Street. 3. Speed signs on Europa Avenue between 125th Street and 126th Street. 4. No Parking along Sunset Lake between Washington County 7 and Homestead Avenue. 5. Dead End sign on Foxhill Avenue at 147th Street. Miron made motion, Brunotte seconded, to adopt RESOLUTION 9.3-12, RESOLUTION AUTHORIZING ESTABLISHMENT OF CERTAIN SIGNS IN THE CITY OF HUGO. All aye. Motion Carried. Cit/ Council meeting of September 20, 1993 Page 4 Barnes made motion, Leroux seconded, directing the Cit/ Administrator report to the Council status of brush cutting in the Cit/ of Hugo. All aye. Motion Carried. ENGINEER'S REPORT (DRAINAGE 8A AND 61) At the Council meeting of September 7, 1993, a resident indicated a concern for water ponding in the south east quadrant of County Road BA and Highway 61. The City Engineer submitted a report indicating his findings. If the Council feels this is an item of concern, it may be addressed during the reconstruction of County Road BA during 1994. Leroux: made motion, Stoltzman seconded, to accept the Engineer's report on drainage in the south east quadrant of C.R. BA and Highway 61. All aye. Motion Carried. ENGINEER'S REPORT (WALLER DRAINAGE) The Council received a report from the City Engineer regarding the alleged drainage problems on the Waller property being caused by the Evergreen Hills subdivision. The City Engineer's findings indicates that the development has increased the water runoff across the Waller property to some extent. The City Attorney stated that it is likely that the City has no legal liability in this matter. In addition, any controls the Cit/ may install to reduce the amount of flow across the Waller's property would be expensive, and given the limited increase of water runoff, would have very minor effects on the Waller's property. For these reasons, the staff recommended that the Waller's request to have the City divert runoff from Evergreen Hills property be denied. There was another lengthy discussion regarding the history of drainage in the Evergreen Hills/Waller vicinity. Stoltzman made motion to obtain a cost estimate for berming and extraction of dirt north east of the existing holding pond. Motion died for lace; of a second. Barnes made motion, Miron seconded, authorizing the City Administrator to contract with TKDA to loot: at evidence and offer options/solutions to the Council. VOTING AYE: Barnes and Brunotte VOTING NAY: Leroux, Miron, Stoltzman Motion Failed. Leroux; made motion, Miron seconded, directing the City Administrator to review the historical data gathered by the Waller family, review the USGS maps to determine if there was easterly drainage prior to development, and determine if the City has easements to make the project practical. VOTING AYE: Leroux, Miron, Stoltzman VOTING NAY: Barnes and Brunotte Motion Carried. ENGINEER'S REPORT (O'MARA DRAINAGE) William O'Mara, 16.337 Harrow Avenue North, expressed concerns to the City regarding the ponding of water on his property. Mr. O'Mara contends that the City's improvement to the street and drainage ways has increased the ponding of water on his property. The City Engineer's report indicated that the water elevation for this pond is controlled by the culvert crossing O'Mara's driveway, and that this culvert was not disturbed during the street improvement project. Some additional water may be ponding on O'Mara's property due to the filling of the ditch to the Borth of Mr. O'Mara's driveway, but that the ditch -grade was controlled by two factors - the existing utilities in the road right-of-way, and Mr. O'Mara's request to maintain a grade on the ditch that would allow for easy access for mowing. Lowering of this grade may provide some minor benefit to Mr. O'Mara, but the ditch elevation is limited by the culvert crossing Harrow Avenue to the north. In addition,. the culvert under Mr. O'Mara's driveway may be blocked by sediment. As this sediment may have been deposited during the construction project, it will be cleaned by the City in the near future. The Council considered the impact of lowering the ditch profile against the benefit that Mr. O'Mara would receive in reduced ponding. Leroux: made motion, Miron seconded, authorizing the City to clean and open O'Mara's driveway culvert, and reshape the ditch north of said driveway. All aye. Motion Carried. RECREATIONAL. FIRE ORDINANCE (HEARING DATE) During a recent enforcement case, a Washington County judge determined that all recreational fires in the City of Hugo are illegal under current City ordinance. The City has, for a number of years, allowed recreational fires. In order to maintain this practice, changes to City ordinances 110-18 and 110-20 have been recommended by the City Attorney. Miron made motion, Stoltzman seconded, that the proposed changes to City ordinances relating to recreational fires be forwarded to the Planning Commission for a hearing date on October 27, 1993. All aye. Motion Carried. BUILDING DEPARTMENT INTERN Stoltzman made motion, Barnes seconded, to extend Vern Bartlette's internship until October 29, 1993. All aye. Motion Carried.
