PRESENT: Barnes, Brunotte, LeroUX, Miron, Stoltzman City Attorney's Office, Kevin Shoeberg City Administrator, Robert MUseus City Clerk., Mary Ann Creager Miron made motion, Brunotte seconded, to approve the minutes for the Council workshop of Septembers, 1993, as submitted. VOTING AYE: Barnes, Brunotte, Leroux, Mir -on ABSTAINED: Stoltzman Motion Carried. Miron made motion, Barnes seconded, to approve the minutes for the regular City Council meeting of October 4, 1993, as submitted. All aye. Motion Carried. Leroux made motion, Brunotte seconded, to approve the claims for October 18, 1993, in the amount of $470,773.56. All aye. Motion Carried. MINOR SUBDIVISION ( h::ARNSTEDT ) Mr. M::eith Peterson, :861 Olympic Trail, Lindstrom, MN, requested a minor subdivision for his property located at 6788 132nd Street North, on behalf of Linda and David Karnstedt, purchasers of the property. The property is zoned agriculture, and the request is to subdivide a 20 -acre parcel into two 10 -acre parcels. The property in question was part of a minor subdivision in 1992, where Mr. Peterson subdi.vi.ded 40 acres into two 10 -acre parcels, and one 20 acre. In addition, a building permit was issued, and a 5,184 pole building was constructed on the 0 -acre parcel, based on State law. The building on the 10 -acre parcel will be larger than 3,600 square foot accessory building generally allowed on a 10 -acre parcel. The Planning Commission considered Peterson's request on October 13, 1993, and recommended approval of the subdivision with a Special Use Permit for the existing pole building. VARIANCE REQUEST (GONDEK) James and Diane Gondek, 12180 Fiona Avenue, requested a variance to construct a 36' x 56' garage 18' forward of the front line of the residence. Because the resulting building will be more than 100' from the public road, the variance request was brought directly to the Council. City Council meeting of October 18, 1993 Page 2 Miron made motion, Leroux; seconded, to approve the variance request of James Gondek, 12160 Fiona Avenue, to construct a 36' x 56' garage closer to the road than the principal building. Approval. is granted because of the large setback and the seclusion of the site. All aye. Motion Carried. REZONING (BARDOUR) Mr. Jeffrey Barbour, 13670 Isleton Avenue North, submitted an application to rezone 115 acres located in the S 1/2 of the NW 1/4, and the N 1/2 of the SW 1/4 in Section 26, T7.1, R21W, from Agriculture to RR2. The purpose of the rezoning is to allow for the development of 22 single family homes on the site. The current dog kennel in operation on the property would cease to exist upon development of the property. The Planning Commission conducted a public hearing on this matter on October 13, 1993, and submitted the rezoning to the Council without recommendation due to a 2 - . split vote. Dan Dolan, developer of the property, explained the PUD concept for this property, and his intention to preserve all wetlands. LeroUX made motion. Barnes seconded, to adopt ORDINANCE 93-285, AN ORDINANCE AMENDING CHAPTER =20 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. VOTING AYE: Barnes, Brunotte, Leroux:, Miron, Stoltzman Motion Carried. AGREEMENT (STOLTZMAN) At the Council meeting of October 4, 1993, the City Council directed the City Attorney to make certain revisions to the Agreement for Walter Stoltzman, specifically, establishing the termination clause for the Agreement. Acting Mayor Miron presided over the discussion, which included a lengthy discussion about Walter Stoltzman's ability to employ people in his business. Barnes made motion, LeroUX seconded, to table this matter until the meeting of 11/1/9: to allow for change in language relating the employees at the Stoltzman business. All aye. Motion Carried. 126TH STREET STOP SIGN Mr. Robert Hanson, 4920 126th Street, requested that a stop sign he installed on 126th Street at Exhall Avenue. Mr. Hanson expressed concern about the increase in traffic on that road, the speed of the automobiles, and the potential for an accident for the many children livinq alonq this street. This issue was reviewed by Georqe M. Stuempfig, traffic engineer with Maier, Stewart R_. Associates, as part of the Hazard Elimination Contract, as well as Howard KUUSiSt.o, the City's engineer. In both instances, the recommendation was to not install a stop sign at this location. Mr. Hanson addressed the Council, stating that numerous citations have been issued for speeding. City Council meeting of October 18, 1993 Page _ Stoltzman made motion, Miron seconded, to table this request to allow staff time to obtain,a report from the Sheriff's office regarding the number of -citations issued in the area in question. If no report is available, staff is to request the deputy patrol the area to substantiate the claim of excessive speeding. All aye. Motion Carried. HAZARD ELIMINATION SAFETY PROGRAM SIGN INVENTORY The Council reviewed the inventory of signs to be replaced as part of the Hazard Elimination Program, with 90 of the cost to be funded by a federal grant. Miron made motion, Leroux; seconded, to approve the inventory of signs to be replaced as part of the Hazard Elimination Program. All aye. Motion Carried. FIREMAN'S RELIEF ASSOCIATION APPOINTMENT Based on a request from the Hugo Fireman's Relief Association, staff recommended the appointment of Ron Otkin, the City's Finance Director, as an ex -officio member of the Hugo Fireman's Relief Association, replacing City Clerk., Mary Ann Creager. Because Mr. Otkin is more closely involved with the finances of the Association, his membership on the Board would be more practical. Stoltzman made motion, Barnes seconded, to appoint the City's Finance Director, Ron Otkin, as an ex -officio member of the Hugo Fireman's Relief Association, replacing City Clerk., Mary Ann Creager. All aye. Motion Carried. RICE CREEK: WATERSHED DISTRICT ADVISORY COMMITTEE APPOINTMENT The RCWD requested that the City Council appoint an individual to serve on the Rice Creek Watershed Advisory Committee as part of its process in amending its water resource management plan. Given the many surface water -related issues the City is currently involved with, a member of the community serving on this Board would be of benefit to the community. Staff felt that appointment of a Council member, or the City Administrator, would be appropriate. Miron made motion, Brunotte seconded, to appoint Council member, Debra Barnes, to serve on the Rice Creek Watershed Advisory Committee. All aye. Motion Carried. NOVEMBER COUNCIL WORKSHOPS Staff requested that the Council establish two workshops during the month of November, the first, review draft -water management plan prepared by the City Engineer, and the second, to discuss capital improvement planning as part of the budgetary process. Page 4 Miron made motion, Leroux: seconded, to schedule a Council workshop for November 29, 1993, at 7:3(_) PM, to discuss capital improvement planning as part of the budgetary process. All aye. Motion Carried. A tentative date of November 8, 1993, to discuss the County Road 8A improvement project, will be finalized at a later date. PETITION FOR ROAD IMPROVEMENT (FIONA AVENUE) The City received a petition under Chapter 429 for the improvement of Fiona Avenue between 125th Street and 120th Street. Staff recommended the Council establish a public hearing for the improvements on 11/15/9=. A number of residents on Fiona Avenue were present challenging the petition, and stating that they were not interested in any road improvement. Stolt man made motion, Barnes seconded, directing the staff to review the submitted petition to determine if the declared footage is accurate. All aye. Motion Carried. MISCELLANEOUS The City received two letters from James Brevig regarding truck traffic on County Road 8A. It was suggested that copies of the letter be forwarded to Valley Paving. Richard Inott, applicant for the Hugo Fire Department, inquired as to the status of his application. He was informed that his application is still pending.
