OF THE HUGO PLANNING COMMISSION
JANUARY 28, 1976
The special meeting was called to order by Chairman Spitzer at
8: OOPM. Members present were: Spitzer, Ehret, Peloquin, and Peltier.
Johnson arrived at 8:02PM and Rosenquist at 8:04PM. Also attending
were Irene Leroux representing the City Council.
Shepherd of the Fields Lutheran Church
Vern Peloquin appeared with a request for a special use permit for
a church and parking facilities for the Shepherd of the Fields Lutheran
Church which would be built on land now owned by Mr. Peloquin; the land
Is zoned Single Family Urban, and under cultivation at this time.
Mr. Lester Winter, heading a delegation from the church, presented
a preliminary sketch plan. Peloquin showed a survey but stated that
the surveyer erroneously excluded Lot 5 instead of including it, and a
new survey did not arrive in time for this meeting. Peloquin and Winter
said they were attending, later this same evening, a meeting with the
Rice Creek Watershed District seeking their approval. Planning Commission
requested a full presentation by Peloquin and Winter, including sketch
showing size of building, describing easements and an up to date survey
for the February 11th Planning Commission meeting.
Motion made by Ehret, seconded by Peltier, to hold a public hearinP
on Wednesday evening, February 25th at 8:OOPM regarding a special use
permit for Vern Peloquin, for a church and parking facilities for the
Shepherd of the Fields Lutheran Congregation on the Peloquin property.
Motion carried.
Resolution
Mrs. Irene Leroux brought up the fact that the special use permit
for the day care center operated by Mrs. June Smith was due for reviewal
on Septembbr 1, 1975, but that Mrs. Smith did not appear before the Plan-
niAg Commission with her request for a variance regarding the septic sys-
tem until the meeting on September 7, 1975. Mrs. Leroux also stated that
approval was given for twelve children at the center, which was to inc-
lude her own children, and Leroux believes she is now caring for twenty
children; and she feels she is operating in violation of her special use
permit. She said this is the same type problem that we have with the Gun
Club and wonders how this type of problem should be treated.
Motion made by Ehret, seconded by Johnson, to pass a resolution,
that it has been the policy of the Planning Commission, in the past, that
If a special use permit has expired, that within a thirty day period, it
had been been considered to be in a grace period, but in the future, if
not in compliance on the date of expiration, the Planning Commission will
not consider an application as an extension of an existing permit. It
shall be the duty of the Planning Commission Secretary to notify the
Commissibn thirty days prior to expiration of any special use permit.
Voting for: Spitzer, Johnson, Ehret, Peloquin, and Rosenquist. Peltier
abstained. Motion carried.
Motion made by Peltier, seconded by Ehret, to adjourn at 8:45PM.
Motion carried.
