The meeting was called to order by Mayor Stoltzman at 7:(--)(:) PM.

LeroUX made motion, Barnes seconded, to approve the minutes for the
regular City Council meeting of October 18, 1993, as submitted.

Miron made motion, Barnes seconded, to approve the claims for November 1,
1997., in the amount of $152,012.36.
All. aye. Motion Carried.
PETITION FOR IMPROVEMENTS (FI ONA AVENUE)_
At the City Council meeting of October 18, 199', the City Council received
a petition from residents abutting Fiona Avenue for improvement of the
street by the installation of bituminous pavement, pursuant to Minnesota
Statutes, Chapter 49. During the meeting, residents of the street,
stated that they were not interested in the project. Daniel Fallen and
David Cooler requested that their names be removed from the petition.
Staff reviewed City records that indicate the Harlee Anderson's property
does not abut Fiona Avenue, but rather the street lies totally on the
property of residents to the west. Recomputing of the valid signatures,
after subtracting the Anderson's, Fallen's, and Cooper's front footage,
show approximately 25 of the front -footage owners on Fiona Avenue have
signed the petition, less than the 35% required by Statute in order for
the City to order the project by a "?:/5's vote. Residents of Fiona Avenue
were present, and addressed the Council stating why they were against the
project. Harlee Anderson stated that he did not expect the residents to
pay for both sides of the road, and expected that he would pay for his
portion.
Miron made motion, LerOUx seconded, to deny the petition requesting the
bituminous surfacing of Fiona Avenue, north of 120th Street and south of
125th Street.

STOP SIGN REQUEST (-126TH SIREE.1)
At the City Council meeting of October 18. 199.71. the Cit;' Council
considered a request from Mr. Robert Hanson, of 4920 126th Street, for the
installation of a STOP sign on 126th Street at Exhall. Avenue. At that
meeting, the Council ordered a review of the County records regarding
traffic incidences on the road. The City Administrator prepared a
background report for Council consideration, with his recommendation for
denial of the request. It was determined by the Council to install
playground/children signs, and ask that the '13heriff's Office vigorously
enforce speed limits in that area.

Stolt man made motion, Miron seconded, that the City Council review this
matter in six months for further consideration.

ORDINANCE REVISION (OPEN BURNING)
The Hugo Planning Commission conducted a public hearing on October 27,
1993, to consider revision of the City's ordinance regarding open burning,
and recommended adoption of the ordinance, as presented. The proposed
revision adopts State Statute with additional limitations on burning
during the winter months and barrel burning. The Council felt that they
would like more time to make a determination on burning during winter
months and barrel burning.
LeroUX made motion, Miron seconded, to adopt ORDINANCE 93-2186, AN
ORDINANCE REPEALING CHAPTER 110-16 THROUGH 110-31 OF THE HUGO CITY CODE
ENTITLED "FIRE PROTECTION AND PREVENTION", AS THEY HAVE BEEN PREEMPTED AND
REPLACED BY MINNESOTA STATUTES, CHAPTER 88, ET SEQ.

ORDINANCE REVISION ( FPARl:'LAND DEDICATION)..
The Hugo Planning Commission conducted a public hearing on October 27,
1993, to consider revision of the City's ordinance by revising the City's
regulations by raising the parkland dedication fee from $175.00 to
per lot, and allowing certain large lots to be exempted from the
requirement. The Planning Commission recommended adoption of the
ordinance with the addition prohibiting wetlands being used for parkland
dedication.
Miron made motion, LeroU>; seconded, to adopt ORDINANCE 9'-287, AN
ORDINANCE AMENDING CHAPTER 90-13, SUPD. B(.?) OF THE HUGO CITY CODE
ENTITLED "SUBDIVISIONS" BY INCREASING THE PARK LAND DEDICATION FEE FROM
$175.00 TO $500.00 PER LOT.

COMPREHENSIVE PLAN AMENDMENT (RESOLUTION)
In response to mandates made by the State of Minnesota and the
Metropolitan Council, the Hugo Planning Commission conducted a public
hearing regarding amending the City's Comprehensive Plan, which would
commit the City to adopting the National Urban Runoff Program Standards,
or their equivalent, for design of new storm water ponds, and the MPCA's
urban best management practices, titled, "Protecting Water Quality in
Urban Areas". The PC recommended adoption.
Miron made motion, Barnes seconded, to adopt RESOLUTION 9 -15, A
RESOLUTION ADOPTING THE NATIONAL URBAN RUNOFF PROGRAM STANDARDS.

November 15, 1993, at 7:05 PM, to consider adoption of a proposed
ordinance that would allow the Anoka Electric Cooperative to serve
residents of the City of Hugo with electrical power.

1994 FOREST LAKE YOUTH SERVICE BUREAU CONTRACT
The Forest Lake Youth Service Bureau provided the City with a Contract for
Services for 1994, in an amount not to exceed $2,8(_)O.i)(:). The Contract
represents no change from previous contracts, and funding of this item is
currently in the 1994 budget. The staff recommended approval of the
Contract.
Stoltzman made motion, Miron seconded, to approve the 1994 Purchase of
Service Agreement, between the City of Hugo and the Forest Lake Youth
Service Bureau, and authorize the Mayor and City Clerk to sign said
Contract on behalf of the City of Hugo.

PROPOSED AGREEMENT (STOLTZMAN)_
On May 18, 1993, Laura K'. Stoltzman and Walter L. Stoltzman applied for a
Special Use Permit to continue operation of auto repair business located
at 8221 157th Street North. On the advice of the City Attorney, an
Agreement was drafted to settle differences between the applicant and the
City. At the City Council meeting of October 18, 1993, the City Council
considered the Agreement, tabling action until November 1st, to allow the
City Attorney to make amendments regarding permitted employees. The City
received a letter from Mr. Stoltzman withdrawing his application for a
SUP.
Miron made motion, Barnes seconded, delegating Councilman LerouX to serve
as a liaison between the City Council and the Stoltzman family, in an
attempt to resolve differences in the Agreement.

ASSESSMENT OF DELINQUENT UTILITY PILLS (RESOLUTION)
Pursuant to Minnesota law, the Firiance Director prepared a resolution
declaring certain utility bills in arrears, and assessing the amount of
the past -due utility bills to the benefited property.
Stoltzman made motion, Miron seconded, to adopt RESOLUTION 93-16,
RESOLUTION DECLARING UNPAID UTILITY PILLS BE PLACED ON THE TAX ROLLS.

MWCC EASEMENT
The Metropolitan Waste Control Commission requested that the City sign an
Agreement regarding the City's use of their easement, South of 14�►th
Street, to the new water tower. The staff recommended approval of the
Agreement.
Stoltzman made motion, LeroUX seconded, to approve the easement to allow
the City of Hugo to encroach onto MWCC sanitary sewer easements, and
authorize the Mayor and City Administrator to sign said easement on behalf
of the City of Hugo.

TRAFFIC SIGNAL (COUNTY ROAD 8 AND HIGHWAY 61)
The City has been informed by Washington County that MNDOT intends to
install a temporary traffic signal at the intersection of C.R. 8 and
Highway 61, at no cost to the City. This action is being taken due to the
recent determination by MNDOT that this intersection warrants a traffic
signal, as well as in preparation for work to be conducted on 'bE in 1994,
which will divert traffic onto Highway 61. Though the traffic signal is
identified as temporary, the Washington County Public Works Department has
informed the City that it is not unusual for such a temporary signal to be
left in place for a number of years, prior to being replaced by a
permanent system. Presently, staff is seeking clarification regarding the
type of signal to be installed, as well as other improvements scheduled
for the intersection. No formal action was required by the Council.
CIVIL DEFENSE WARNING SYSTEM
The Council considered a memorandum from the City Administrator regarding
improvements to the City's civil defense warning system. The
Administrator recommended consideration of a long-term program as part of
the City's capital expenditure program.
Miron made motion, Stoltzman seconded, to table this matter for discussion
at the Council workshop of November 29, 1993, at 7:30 PM, regarding
capital improvements for budgeting purposes.

COUNTY ROAD 8A IMPROVEMENTS REPORT
Mr. Tim ChalUpnik, of TKDA, submitted a report to the City regarding the
current status of the proposed improvements for County Road 8A. The
County will hold an informal, public information meeting on the evening of
November 8th, 7:00 PM, Hugo City Hall, to receive public comment on the
project.
Miron made motion, Barnes seconded, recess tonight's meeting until Monday,
November 8, 1993, at 7:00 PM.
