MAY 20, 1976
The meeting was called to order by Chairman Dan Spitzer at 8:08 P.M.
Present were Spitzer, Peloquin, Rosenquist and Peltier. Absent were Ehret
and Johnson.
Motion made by Peloquin, seconded by Peltier, to approve the minutes
of the April 28, 1976 meeting as sent out. Motion carried.
Motion made by Peltier, seconded by Peloquin, to approve the minutes
of the May 12, 1976 meeting as sent out. I -lotion carried.
White Bear Rod and Gun Club
On Hay 6, 1976, the White Bear Rod and Gun Club filed application
for a Special Use Permit to consider condition #2 of the present Special
Use Permit - clarification of actual planting of trees which was not clar-
ified in original permit.
At the meeting of May 12, 1976, Mr. Jerry Perron requested the Plann-
ing Commission to include in the minutes of the meeting, the fact that the
public nearing would be held for condition #2 only. Acting Chairman Pel-
oquin instructed secretary to obtain clarification from City Attorney
regarding this matter.
Spitzer read letter from Charles Johnson, Hugo City attorney, dated
189 1971 relating to a clarification of the terms for review of the
Special Use Permit Application for the Jhite Bear Rod & Gun Club. Johnson
referred to his reviewal of the minutes of the Hugo City Council meeting
of April 19, 1976, and also the minutes of Ii

Dean Johnson - Variance
Dean Johnson, 5839 147th Street North, appeared on May 12, 1976 be-
fore the Planning Commission with application for variance to build garage
two feet from property line. Verbal permission has been granted from John
Sadowski, adjacent property owner. Property presently zoned Single Family
Urban - tabled at last meeting for lack of quorum.
Spitzer explained the building code requirement for side yard set -back
in SFU zoning is 10' - said one (f the reasons is for fire protection - city
has been extremely reluctant to grant variances of this type - realizes he
has a particular problem; the loss of a very large tree, and this could be
considered a geographic constraint - but the possible fire hazard must be
considered first. Spitzer said it may be necessary to obtain a deed rest-
riction from the neighbor that he wont build anything any closer than 17'
from his property line in order to prevent a fire hazard. Applicant was
instructed to obtain a layout, with dimensions, of the existing buildings
on the west side of his property and bring his neighbor, or his agent, to
the next meeting. Matter tabled until meeting of June 9th, secretary in-
structed to put Mr. Johnson on the agenda that evening and applicant to
fairnish the above requested information.
lilliam. O'Mara
William O'P.Zara, 18234 Elmcrest Avenue North, Forest Lake, appeared
regarding five acre tract he owns la miles east of Hwy 61 off of 165th
Street. Property has no road frontage; is serviced by an easement only.
Brought in Certificate of Survey dated October 12, 1970, contract for
Deed dated August 4, 1972 showing him as the purchaser as of that date,
and proof of a perpetual, non-exclusive easement over the West 66 feet of
the property.
Secretary directed to write letter to City Attorney sending copies
of the above mentioned items stating that we have a request from Mr. 01114ara
to clarify the status of Tract C as shown with regard to access over the
private driveway shown as a 66' easement. Clarification to be received
no later than June 7, 1976.
Platter tabled until the meeting of June 9th by direction of the Chair.
Dennis Burdick - Used Car Lot
Spitzer read letter from Charles Johnson, City Attorney, dated May 18,
1976 regarding the Motor Sales question at 14529 Forest Boulevard. Prop-
erty presently zoned CB, which does not permit a Motor Vehicle Sales Oper-
ation either by permitted use or by Special Use Permit.
Planning Commission has three alternatives:
1) Rezone to either industrial or RB and couple the rezoning with an
application for Special Use Permit

2) Chane ordinance to permit retail sales of automobiles in CB,
coupled with application for Special Use Permit.
3) Recommend denial of any use of the property for sale of auto—
mobiles.
He also referred to the question as to the continued operation of the
body shop on the premises. Applicant alleges that body shop has been in
continuous operation thus subject to continuation as a valid non—conform
ing use. Attorney not certain as to facts at this time, but if Planning
Commission determines that it has, it would appear that there would be a
valid non—conforming use to the level that has been established. The
use could not be intensified without conforming to the zoning ordinance.
Spitzer asked for a sense of the Planning Commission to determine
whether they should formulate and recommend an amendment to the ordinance
or should recommend that Burdick should make application for a rezoning.
Motion made by Peltier, seconded by Rosenquist that the Planning
Commiscion recommend to the City Council that they amend the ordinance.
Voting for: Spitzer, Rosenquist and Peltier. Peloquin voted no. Motion
carried.
Motion made by Rosenquist, seconded by Peltier, to amend Chapter 320
of the Hugo City Code entitled Zoning in Sec. 320-4, Subdivision K. reg—
ulations for Concentrated Business District, Sub—paragraph 3, titled
40pecial Uses", add Retail Motor Vehicle Sales and Service.
Voting for: Spitzer, Rosenquist and Peltier. Peloquin abstained.
P•lotion carried.
Secretary directed to publish the notice of public hearing on the
proposed amendment to the ordinance for 7:00 P.M. on June 9, 1976.
Peltier made motion, seconded by Rosenquist to accept application
of Dennis Burdick, 14529 Forest Boulevard, for a Special Use Permit to
to operate a retail motor vehicle sales and service, contingent on the
approval of the ordinance amendment and set a public hearing for 8:00 P.M.
on June 9, 1976.
Voting fcr: Spitzer, Rosenquist, Peloquin and Peltier. Motion carried.
Art Glamos Re: Peloquin Industrial Park
Motion made by Peltier, seconded by Peloquin to put Meir. Glamos on the
agenda. All aye. Motion carried.
Discussion regarding four acre parcel Mr. Glamos may purchase in
Peloquin Industrial Park and status of road in that area. 11Ir. Glamos
manufactures custom wire products.

New Chair Cushion
Motion made by Rosenquist, seconded by Spitzer, to recommend to the
City Council that they purchase one chair cushion for the exclusive use
of the dis—staff member of the Planning Commission. All Aye. Mrs. Peltier
abstained. Motion carried.
Motion made by Peltier, seconded by Rosenquist, to adjourn the meeting
at 10:59 P.M.
