PINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION MAY 269 1976 PUBLIC HEARING - L4MCTTE The public hearing regarding a petition for a temporary mobile home ppermit, requested by Mr. and Mrs. William F. LaMotte, was opened at 7:40 P.M. Present were Spitzer, Ehret, Peloquin and Peltier. Motion made by Peltier, seconded by Ehret to dispense with the reading of the official notice of publication, since there is no busi- ness before the chair since the request has been withdrawn by the appli- cant. All voted aye. Motion carried. Motion made by Ehret, seconded by Peloquin, to adjourn the hearing at 7:43 P.M. All voted aye. Motion cprried. MEETING The meeting was called to order by Chairman Dan Spitzer at 8:03P.M. Present were Spitzer, Peloquin, Ehret and Peltier. Absent were Rosen- quist and Johnson. Votion made by Peltier, seconded by Peloquin, to approve the min- utes of the May 20, 1976 meeting after changing ah to an on the second to the last line on page two, and on the second line regarding Vernon DeZiel - Land Division on page one, change west side to southeast side of Oneka Lake. All voted aye. Motion carried. MINING PERMIT - BARTON Spitzer read letter from Barton; they are still looking for buyer for all or most of existing stockpile - no further production is anti- cipated - haul routes cannot be determined until customer is obtained will try to route trucks on approved route; would appreciate a means for a quick approval of alternate routes if they are required - restor- ation will be accomplished as per agreement with Mr. Goiffon when stock- pile has been removed. Spitzer read portion of letter from City Engineer stptind that the the area has been inspected - site in general has several 1-�rge areas of erosion with steep banked gullies. according to previous inspection, reference has been made to the slopes and at this inspection, the low area south of stockpile is ponding water. According to February 4, 1975 letter, 147th Street westerly to Homestead Avenue, south to County 8A would be the haul route. Any other haul route would be only by per- mission of the Council. Spitzer read the conditions that were attached to Mining Permit #6, dated September 18, 1975; noted that Barton is not asking for anything additional; City Engineer says the restoration is not complete. Motion made by Peloquin, seconded by Peltier, to recommend to the City Council that the tuning Permit #6, dated September 18, 1976, issued. to Barton Contracting Company of Osseo, Minnesota, be renewed iinta t, until June 30, 1977 provided that the necessary bond and cert ifica�e of • Hugo Planning Commission Page 2 of 4 May 269 1976 Insurance is renewed through that date. The renewal of this permit shall require an additional inspection fee to be made by the appli- cant. Voting for: Spitzer, Ehret, Peloquin and Peltier. Motion carried. BUR -LAA MINING PERMIT Spitzer read the conditions outlined in Mining Permit Renewal #2, dated May 5, 1975, issued to the partnership of Richard Bury and Palmer Peterson, 6401 Industrial Drive, Box 338, Hopkins, Minnesota, for the period of one year. Spitzer noted that through Council action the per- mit has been extended from May 5, 1976 through June 30, 1976 and the bone has been posted through that date. Spitzer read notice from City Engineer that the area has been inspected - stockpile is still at site, which is relatively clean - appears no further operations have been in pro7ress since previous inspection. Motion made by 13hret, seconded by Peloquin, to recommend to the City Council that the Bur -Lar, Inc. Mining Permit be renewed until June 30, 1977 with all the same conditions as outlined in Renewal #2, dated May 5, 1975, subject to the continuation of the bond and pay- ment of the appropriate fees. Voting for: Spitzer, Ehret, Peloquin, and Feltier. Motion carried. FISHER MINING 'PERMIT Spitzer read the conditions attached to Renewal #3, dated June 16, 1975, City File #1972 -102 -SUP. Stated City Engineer has inspected the Fisher pit and there has been no change in the mining operation from the previous inspection. Condition of pit appears to be satisfactory. Motion made by Peloquin, seconded by Peltier, to recommend to the City Council that the Mining Permit for Fisher Construction Company, Inc., of Rosemount, Minnesota, dated June 16, 1975, be renewed until June 30, 1977, subject to the continuation of the performance bond and certificate of insurance and payment of appropriate fees. Voting for: Spitzer, _Ehret, Peloquin and Peltier. Motion cArried. INDYKIEWICZ PERMIT Spitzer noted that according to the city records, Indykiewicz bond expired on February 23, 1976. Applicant told to furnish city with proof of bond extension. Spitzer read conditions as stated in Permit Renewal #4, undated, City File #1972 -110 -MP. Permit limited to the removal of sand and black dirt only. City Engineer notes that area has been inspected and does not conform to mining ordinance nor the permit with regard to drainage of excavated area. Site appears to be disorganized. Excavations in some Hugo planning Commission page 3 of 4 May 26, 1976 areas are ponding water and material to be used for grading the gen- eral area for seeding purposes is difficult to define - owner -operator should appear before the Planning Commission with more definite pro- gram than is being conducted - based on engineering investigation, approval should not be given - suggesting that annual inspection fee deposit should be increased to a total of not less than ;200.00. Indykiewicz says he finished everything he said he would do last year and they have begun taking out the peat and are filling in with sand. It does look a little rough, he said, but it is a problem taking out the peat and getting the sand. They are working on the northeast portion of the property, he said. Concerning the drainage, Spitzer asked if there is any ponding? Indykiewicz said the ditch has been lowered and there is barely any water there now - are planning on putt- ing in three or four feet of fill so that eventually they wont need a ditch. Motion made by Ehret, seconded by Peltier, to recommend to the City Council that the Indykiewicz Mining permit, File No. 1972 -110 -MP, be renewed until June 30, 1977, subject to all the conditions included in Permit Renewal #4 and that the inspection fee be increased to '200 and that the bond and insurance be extended through June 30, 1977, with proof of such being filed with the city; the City Engineer is hereby requested to furnish the City with a letter of clarification regarding the area of ponding prior to the City Council's action on the renewal. Voting for: Spitzer, Ehret, Peloquin and Peltier. Motion carried. LAVALLE EXCAVATING Spitzer read conditions contained in Mining Permit Renewal #2, dated March 21, 1975. City Engineer inspected gravel pit - little change in topography since previous inspection. It nppears that some new excavation is in progress. Upon completion of the removal of materials from the present excavated area, proper slopes would be provided and general clean-up would be completed. Spitzer noted that our records indicate Chet his insurance expired on April 14, 1976. Told to file proof of updated bonding and insurance through June 30, 1977, with the City. Motion made by Ehret, seconded by Peloquin, to recommend to the City Council that the LaValle Mining permit u2 be extended until June 30, 1977 subject to all the conditions therein, also subject to the ex- tension of the bond and insurance to expire no earlier than June 30, 1977. Voting for: Spitzer, Ehret, Peloquin and Peltier. Motion carried. Meeting Recessed 9:00 F.M. - Reconvened 9:07 P.M. RICHARD SCHUH Spitzer read conditions attached to Schuh's mining permit issued April 5, 1976. Noted that file does not contain proof of insurance. Schuh asked to provide city with the same. City Engineer noted that Schuh pit was examined - hauling is being done on Irish from the pit southerly to County 8A. T:aul area south of pit has been excavated and graded. Calcium Chloride has been applied for dust. No comments will be made by engineer at this time and will depend upon the continuing haul operations. Peloquin asked if the City of Hugo will be using_ all of the stock- pile. Schuh said no. Peltier asked about water control - said Council- Hugo Planning Commission Page 4 of 4 May 26, 1976 man Schletty has received complaints. Schuh said they weren't aware of them. They have kept the area watered, he said. Purther stated he will lower driveway and put gravel back - there has been a pole in the way up until now. Motion made by Peloquin, seconded by Peltier, to recommend to the City Council that the Mining Permit granted to Richard Schuh on April 5, 1976, be extended until June 30, 1977 subject to the conditions con- tained therein, subject to the filing of a Certificate of Insurance to expire no earlier than June ?0, 1977, and subject to the correction of the driveway permitting access to the Brown propefty, also known as the old '3risson School. At the time of review, the expiration date of the bond should be changed to June 70, 1977. Voting for: Spitzer, --hret, Peloquin and Peltier. Motion carried. ORDINANCE AMIENDMENT Motion made by Peloquin, seconded by Peltier, to recommend to the City Council that they amend Chapter 240 of the City Code, Chapter 240-4, titled "Vacancies',, by adding the following sentence: "The seat of any Planning Commission member who fails to attend four consequtive regular meetings of the Planning Commission, unless excused by the Planning Commission Chairman, shall automatically be deemed vacant."
