7'ublic Hearing - LaCasse
The public hearin for the purpose of considering the application
of Tom and Arthur haCasse for rezoning of a 37 acre --parcel from Con-
servancv to Agricultural, was opened at 7:37 P.M. by Chairman Spitzer.
Present were Spitzer, Rosenquist, Peloquin and Peltier. Also
attending was Bill Schwab, „ashington County Planner. The official
notice of the public heari�z was read by Chairman Spitzer.
h1r. Thomas LaCasse explained he has built a new home for hipself
on the 37 acre parcel, now wishes to have the entire 37 acres rezoned
from Conservancy to 2'.-ricultural, so that his home would occupy a fifteen_
acre parcel, anti his father would still have two building sites left.
He explained that the land to the north and to the east of the property
is zoned agricultural. Peloquin stated that tile land in question is high
and dry.
Greg Cardinal, 5756* N. 1"5th Street, stated that everyone that owns
forty acres should have the right to subdivide his land. He said he feels
that whether a Baan owns 5 acres or 200 acres, he'should be entitled to
divide it.
Spitzer said the `.lashington County Flood Plain ;-Tap indicates that -there
is a flood hazard on a couple hundred feet of the above mentioned property.
Schwab asked is there are any soils information available on the property.
Spitzer said no. Peltier said LaCasse ;ants to buy fifteen acres from his
father, and he only needs ten for an agricultural zoning, and asked what
he intended to do with the remai:n.ing five. LaCasse said he hasn't sure -
'.�e might sell the other .five to Howard I'lelinc for pasture.
There were no other comments and the hearing was closed at 7:55 P.P".

Pan Spitzer mentioned that at the _last meeting Tir. Junblut and
Tulevcloper Roy Stanley appeared with a s',etch pl a-, and the following
changes ..,,ere recommended by the Planning Commission:
1) division of hot ;'r'10, a lot which does hot meet the City's
minimus. lot size requirement, between the two adjacent prop-
erties.
2) Appropriate handling of the entrance to the north -south street
or. th ; south end of the proposed project.
3) ;Tiwening of the north street to 60 feet.
Spitzer also mentioned the parkland dedication requirement, -stating
that although the City usually takes a dim view of accepting parkland,
and usually instead grants a ronetary consideration, in this particular
case, Spitzer has discussed the matter with the City Council, and it is
the general consensus of the Council that it would be more advantageous
to the City to accept lend, and more specifically hot f16, which would
become a City ozaned lake access, and all expenses for upgrading of such
access would become the burde-^ of the City.
Spitzer mentioned the matter of the nearness of the Sanitary Sewer.
Jungblut explained he thought Spitzer was going; to check with the City
engineer regarding the necessity of applying for the extension of the
sewer to the Jungblut property. JunEblut's request is for on-site sewage
systems. Jung' e_cplained no pert tests have been done yet. Jungblut
asked if a variance could be granted for gravel streets. Spitzer ex-
plai,ied that the City Ordinance calls for blacktopped streets u:iless the
lots in question are .four acres or larger. Jungblut asked if the streets
have to be built before any lots are sold - Spitzer said no, a bond could
be posted instead. r 32' finished road surface would be required, with
a si_rt-.* soot right of way. Jun blut said donating Lot #16 to the City,
plus the blacktop requirement would make the costs excessive. Spitzer
said the blacktopping would definitely be required, parkland dedication
of Lot --','l" would most likely be required but the matter - of division of
Lot 'lo could be argued. Developer Stanley and JunTblut would like to
study the matter to see if still economically feasible wit. these require -
..encs.
Totion made by Peltier, seconded by Peloquin, to table the matter of
the Jungblut preliminary plat approval .for the proposed development on the
northeast end of Bald Eagle Lake indefinitely. All aye. 1 -lotion carried.

Schwab presented written recommendations -stated that since Htry. 61

access directly from highway to a parking area for customers tirithin his
property. Recommends improving the cu -:,,b cut already provided as a drive-
way accessto a parking lct , whish could be located at the east end of his
property. He also feels there should be a restricted zone of not less than
twelve feet bac':: from the sidewalk. Schwab reminded Burdick that before
any lighting; or additional advertising signs that do not exist now, could
be installed, he would be required to submit to the Planning Commission

Spitzer asked if Schwas, is aHare of the fact that if he has to
restrict parkin; of cars twelve feet from the sidei-ralk, he won't be
able to have any parkin;; in the front of the building. Schwab said he
is aware of this. Car]_ Dale pointed out that Inugo's Ordi_nancc calls
for a ten foot clear area to be maintained. Burdick had requested to
leave a 12 i-lch clear area from the sidewalk and maintained losing this
display area ;could harm his business considerably. Schwab pointed out
that if cars were par'.,:.�d. parallel instea� of perpendicular ''le wouldn't
lose the ;:Irking area entirely. Burdick requested leniency since his
buildi:n� is already there, and pointed to other businesses in the City
which do :sot have the required ten foot clearance, thought that the
ordinance should be amended. It was pointed out to Burdick that these
violations pertained to buildings x.rhich were in existence prior to
adoption of the Ordinance.
Rosenquist made motion, seconded by Ileloquin, to recon nd to tie
City Council, approval of the Special Use Permit for Dennis Burdick
to operate a used car lot at 14529 sorest Boulveard subject to the
followin!:r conditions: .
1) That the site plan as submitted be af,hered to with the-Pro—
posed eleven foot entrance being constructed on the South side of the
existin changeable messa._ e si7An.
25 That the par':-Iin;�; area as displayed on the plan on which cars
for sale are to be parl.ed is to be blacktopped eighty feet back fror,

Key Tschida has requested rezonipg of the north end of the
old Georce Jungblut farm in Section 30. There are 51 acres in-
cluded in the request 'I'llich is from conserva icy to agricultural.
Spitzer reported that it is in a flood hazard area - will go over
the area with Tschida prior to the ne_.t meeting.

Vera; Peloquin has .requested rezoning frog. Conservancy to _g-
ricultural of the forty acre parcel w1hich his horse and buildi- gs are
on. The l.a- d is bounded by AG to the forth, RB and Industrial to
the east. T -Te cites higher land values as one of the reasons he is
requesting the zoning change. Ile is also requesti3v, rezoning of
another parcel of twenty acres from SF_ to t'1G since the la -,td will
:not support one acre building sites.
14. Francis Pcltier
Theodora Peltier, 13094 _Goodview Ave zue North, are

Hugo :J�leinentary School to hear the rezoning requests that were presented
at the Special City Council Heeting of December 30, 1974. The meeting
will be closed to all other business. Secretary to contact all appli—
cants and ask thea to provide the names of property owners within 300
feet. Carl Dale, City Planner is asked to make a presentation that
evening. All aye. Motion carried.
