The meeting was called to order by Mayor Stolt man at 7:00 PM.
PRESENT: Barnes, Brunotte, Jesinski, Miron, Stolt man

Miron made motion, Jesinski seconded, to approve the minutes for the City
Council meeting of March 2, 1992, as submitted.
All aye. Motion Carried.
Barnes made motion, Miron seconded, to approve the claims for March 16,
1992, in the amount of $105,523.24.
All aye. Motion Carried.
CHARITABLE GAMBLING LICENSE
Miron made motion, Brunotte seconded, that the City Council does hereby
resolve that they have no objection to the issuance of a Premise Permit,
pursuant to M.S. 349.213, Subd. 2, for the property described as 14777
Forest Blvd., Hugo, MN., as submitted by the Hugo Lions Club, for the
purpose of conducting lawful gambling, and waiver of the 60 -day waiting
period.
All aye. Motion Carried.
LIQUOR LICENSE
Brunotte made motion, Jesinski seconded, to approve the application of the
Hugo Lions Club for an on -sale 3.2 beer license to sell alcoholic
beverages for various functions at the Hugo City Hall Park: during the 1992
calendar year.
All aye. Motion Carried.
RESOLUTION ABATING SPECIAL ASSESSMENT
As per Council direction, the City staff prepared the necessary resolution
to abate the special assessment for the property described as Outlot A,
Block 2, Evergreen Hill 2nd Addition. This abatement is consistent with
the Non -Development Agreement entered in�:o by the City and Mr. Jim
LeMoine, on February 3, 1.992. The total amount of the assessment is
$742.56 collectible in 1992, The balance of the $4,577.20 assessment will
be removed from the City's assessment roll. This assessment; is being
removed based on the determination that the property is riot buildable or
usable for development purposes.
Miron made motion, Barnes seconded, to adopt RESOLUTION .1992-7, RESOLUTION
ABATING SPECIAL ASSESSMENT.

AWARD OF BIDS (MITIGATION FONDS)
As a condition of DNR approval of our p=hase 2 CIP, the City is required tc
construct a mitigation wildlife pond in the area of Rice Lake park. This
location and pond design has been approved by the DNR, and is required to
fulfill the conditions of our permit. The estimated cost of this project
was $18,000. The Council received a copy of the bid tabulation reflecting
the bids received. The 16 bids received range from $10,870 to $36,913.
The City engineer reviewed the bid documents, and informed the Council
that k::eller Excavating requested that their bid not be accepted as they
cannot meet the bid estimate. The City Engineer recommended that the City
Council accept the next lowest bid, Forest Lake Contracting at $13,238.
Barnes made motion, Stolt man seconded, to accept the bid of Forest Lake
Contracting, in the amount of $13,238, for the construction of a
mitigation pond in the area of Rice Lao.e Park.

WATER: SYSTEM IMPROVEMENTS (ADDENDUM)
As per Council request, the City engineer prepared an addendum to our
Water System Report reflecting the questions raised by the City Council at
the February 18, 1992 hearing. The City engineer was present to review
this addendum in detail with the City Council.
VARIANCE - OVERSIZED GARAGE (MCGUIR.E)
On behalf of Eugene McGuire, Waland Builders of Scandia, MN., has made
application to the City of Hugo for a variance to construct an oversized
garage at 6795 170th Street. The property is five acres in size, and is
located in an agricultural zoning district. The attached garage in
question is to be 768 square feet in size (720 Maximum allowed). The
request in question is consistent with the Council's policy regarding
oversized garages in agriculture zoning districts.
Jesinsk:i made motion, Stolt man seconded, to approve the variance request
of Eugene McGuire, 6795 170th Street, for the construction of a 768 square
foot attached garage (720 sq ft allowed). The proposed garage is to be
used for residential purposes only.
All aye. MoLion Carried.
FLOOD PLAIN ORDINANCE
Earlier this year, the City Council was provided with draft copies of a
proposed Flood Plain Ordinance to update our current ordinance. The
ordinance, as drafted by the City staff, complies substantially with the
model -ordinance provided by the DNR, and has been modified to meet the
City's concerns. The City engineer was present to review this ordinance
with the Council, and secure your input before a final draft is prepared.
Mr. KUusisto noted the suggested changes, and will make the necessary
modifications on the original draft.

MISCELLANEOUS
Mayor Stoltzman reported on the following correspondence received by the
City:
1. Letter from the Brown's Creek Watershed Management Organization
(BCWMO) regarding the administration of the new State Wetland
Conservation Act. Because of the current change in administration,
the City will take no action indicating our intent to not administer
the new law.
2. Letter from the Washington County Public Works Dept., updating the
City on the Hazard Elimination Safety Program.
3. Letter from Anoka Electric Cooperative regarding the implementation of
new construction charges for street lights.
4. Letter from Mardell Law Office regarding an increase in their criminal
billing rate effective April 1, 1992.
5. Letter from Government Training Services regarding a seminar to be
held April 10, 1992, in St. Cloud, MN. Any one interested in
attending should notify the Clerk so that the appropriate reservations
and fee can be handled.
b. Letter from Kenco regarding the effective date of the newly
implemented WAC and FEC charges. They are requesting an effective
date of August 31, 1992 to allow them time to adjust to the new fees.
This request was referred to the City Engineer.
7. Letter from NSP notifying the City Council of a get together on April
29, 1992 at 10:00 AM, Ruberto's Restaurant, and an afternoon tour of
King power plant located in Oak: Park Heights.
B. Letter from Washington Community Services regarding the summer youth
programs available.
9. Letter to Council Miron regarding the lack of a "leash law" in the
City of Hugo. It was noted that the concerned resident could possibly
charge the offending party under the Nuisance Ordinance.
ROAD PETITION
Mr. Pat Hebert, resident on Henna Avenue, presented the City with a
petition for road improvements to Henna Avenue between 170th Street and
180th Street.
Miron made motion, Brunotte seconded, to refer the road improvement
petition to the City staff for review and completeness and to commence
with Chapter 429 proceedings.
All aye. Motion Carried.
ADMINISTRATOR HEALTH INSURANCE
Barnes made motion, Stoltzman seconded, that the City of Hugo continue the
health/dental insurance, currently provided to the City Administrator, F:.en
Huber, for the month of April, 1992, in lieu of consulting services. Mr.
Brunotte stated that he voted against renewing the City Administrator's
contract earlier, and he couldn't support this proposal now. Mr. Miron
stated that he agreed with Mr. Brunotte.

COUNCILMAN RESIGNATION
Councilman Tom Jesinski, Ward 2, submitted his resignation as Councilman,
effective March 17, 1992.
Stolt man made motion, Brunotte seconded, to accept the resignation of Tom
Jesins4:i, representative of Ward 2, effective March 17, 1992.

Stolt man made motion, Barnes seconded, to publish a notice of Councilman,
Ward 2, vacancy requesting any one interested in serving the term to
expire 12:131/92 to notify Hugo City Hall prior to April 10, 1992.
Interviews will be held after this date.
All aye. Motion Carried.
Miron made motion, Brunotte seconded, appointing Debra Barnes as the City
Council's representative on the Board of Zoning Adjustments for the
balance of 1992.
All aye. Motion Carried.
Brunotte made motion, Jesins4:i seconded, to adjourn at 8:45 PM.
