PRESENT: Barnes, Brunotte, Leroux, Miron, Stolt man City Attorney, Charles Johnson City Engineer, Howard KUUsisto City Clerk, Mary Ann Creager Leroux: made motion, Stolt man seconded, to approve the minutes for the Board of Review meeting held on April 20, 1992, as submitted. All aye. Motion Carried. Miron made motion, Brunotte seconded, to approve the minutes for the regular City Council meeting of April 20, 1992, as amended. All aye. Motion Carried. Leroux; made motion, Barnes seconded, to approve the claims for May 4, 1992 in the amount of $22,211.29 All aye. Motion Carried. AMENDED MINING PERMIT (D. ATKINSON) Mr. Atkinson has requested that the City allow him to use Irish Avenue, south from 147th Street to County Road 8A, as a haul road for his mining operation. Mr. Atkinson has stated that he has had problems with Valley Paving with respect to the combined use of the south gate along Irish Avenue. City Engineer, Howard Kuusisto, reported on the condition of the road in question, stating that Irish Avenue was in need of gravel. The haul route to the north to 152nd Street, is in much worse condition. Larry Hanson, property owner along Irish Avenue, stated that the haul -road issue was discussed at the time Mr. Atkinson was seeking a mining permit, which explains the Agreement signed by Andrew Goiffon and Rich Carron. He requested that the haul roads remain as presently used. Dean Atkinson and representatives from Valley Paving were present, and a lengthy discussion ensued regarding allegations claimed by both pit operators, as well as possible solutions to the problem. Leroux; made motion, Brunotte seconded, that the City of Hugo designate that part of Irish Avenue south from 147th Street to County Road 8A as a haul road. Leroux made motion, Miron seconded, to amend the previous nrot..ioi-I to include the temporary closing of the northern Haul r-r_�ad ( Irish to 1.52nd to Jeffrey) until needed improvements are made to the gravtal portion of the roads. Mayor Stoltzman directed the representatives from Valley Paving to contact Howard KUUsisto if/when they desire to use the northern haul route. Dean Atkinson is to meet with Mr. KUUSisto regarding the newly -opened section of Irish Avenue to discuss needed improvements. SITE FLAN AP'P'ROVAL (D.T. PROPERTIES) Mr. Jim Dimmerman was present to discuss his proposal to construct a 6,000 square foot building on property located on the north east corner of Highway 61 and 170th Street, consisting of approximately 8.9 acres. The building is to be constructed for investment purposes only, and at this time, there is no renter or proposed use of the building available. Because there is information needed relative to the proposed use of the building (parking, drainage, setbaci;s, etc), the Council would be unable to take action on the request. Councilman Miron requested that Mr. Dimmerman meet with the new city administrator to administratively deal with the requirements for site plan approval in -the RB district. Miron made motion, Leroux: seconded, to as Mr. Jim Dimmerman requests Council application. All aye. Motion Carried. REQUEST TO MOVE IN HOUSE (E. SHULTZ) table this request until such time consideration for his site plan Stoltzman made motion, Miron seconded, to table this matter until City Council meeting of August 1992. All aye. Motion Carried. RESOLUTION RECEIVING REPORT AND CALLING A PUBLIC HEARING FOR HENNA AVENUE___ PROJECT #4-6-92 Stoltzman made :notion, BrunoL'te seconded, to adopt RESOLUTION 19-'2-9 RESOLUT; ON RECEIVING REPORT AND CALLING FOR A PUBLIC HEARING FOR HENNA AVENUE FROM 170TH STREET, NORTH TO 180TH STREET, P.I. PROS: c -:'T #4-6=92 . VOTING AYE: Barnes, Brunotte, LeroUX, Miron, Staltzman Motion Carried. LETTER FROM DIANE KIRCHOFFNER The City Council received a letter from Diane Kirchoffner- regarding dumping along City streets and information on long-range plans for recycling. Mayor Stoltzman explained present policy for cleariirig Up City Council meeting of May 4, 1992 Page _ road -side debris, and that trash haulers are expected to provide a recycling service for their customers in the City. Other ways to deal with these issues were discussed, as follows: "adopt" a City road program, notice in next Newsletter requesting residents to attempt to ta4e care of the area near their residences, and citizen volunteers. Mrs. Kirchoffner will work with the city administrator regarding this matter. REPORT ON PLANNING COMMISSION VACANCY (BARNES) Councilmember Barnes stated that she will be conducting informal interviews with PC candidates along with PC chairman Theodora Peltier and the city administrator. A report will be made at the Council meeting of May 18, 1992. CITY ATTORNEY The City has received a proposal from Robert Lydon regarding the acquisition of right-of-way for the County Road J project. Mr. Johnson felt it would be wise for the City to have one person coordinate the project. Barnes made motion, Stolt man seconded, authorizing Robert Lydon to proceed with the obtaining of property or right-of-way, and slope and construction easements, up to the point of condemnation, for the County Road J project, in an amount not to exceed $2,600.00. All aye. Motion Carried. FENCE LAW The Ordinance Violations Committee met recently regarding a fence dispute between property owners Joel Hursh and Tom Jesinsk:i. Attorney Johnson provided the Council with Minnesota Statute #344, entitled "Partition Fences" for their review. The Councilman (Leroux:) from the ward where the disputed fence is located serves as the fence viewer for the City. GRAVEL PIT EXPANSION City Attorney Johnson reviewed action taE::en by the Planning Commission at their meeting of April 22, 1992 to deny the request of River City Asphalt to expand their mining operation. Mr. Johnson stated that he was concerned with the reasons given for the denial, and the fact that a Commissioner had signed a petition against the expansion prior- to the Planning Commission holding a public hearing. Mr. Johnson stated tn-.-,t the vote of that Commissioner for denial did not change the outcome. Mr. Johnson felt it appropriate that the City Council refer the matter to UFie Planning Commission for further consideration. Miron made motion, Barnes seconded, that the City Council refer- the Ri'ver' City Asphalt request for expansion of the mining operation bac4:: to the Planning Commission enabling them to further clarify their reasons for - denial. City Attorney Charles Johnson is to be in attendance at tliis meeting. All aye. Motion Carried. City Council meeting of May 4, 199 Page 4 Attorney Johnson reported that the well -site program is moving along quickly, and he will report on this matter at a later date. As previously reported, the City will need to be represented in Conciliation Court on May 14 with regard to a claim against the City because of an impassable road. Starnes made motion, Leroux seconded, that Mayor Stoltzman be authorized to represent the City in Conciliation Court on May 14, after conferring with the City's attorney regarding this matter. Leroux, Stoltzman CITY ENGINEER'S REPORT Mayor Stoltzman and Engineer F:uusisto inspected the drainage problems as reported by Robert Waller. Mr. Kuusisto's inspection report is on file at City Hall. There was discussion about blocking water at the culvert located at the north end of the lake. k::uusisto stated that if the City elevates the water in the lake along Homestead Avenue, it could jeopardize septic systems adjacent to the water. If any plates are used to regulate the elevation of the lake, the RCWD will have to be notified, and he emphasized that this would not solve Mr. Waller's problem of water in his fields. Mi.ron made motion, Barnes Fuusisto, to continue his RCWD and Washington County drainage problem. All aye. Motion Carried. CITY CLERK seconded, directing City Engineer, Howard work on this drainage matter by contacting the ASCS in an attempt to find a solution to the Leroux made motion, Stoltzman seconded, the week end of June 5, 6, and 7, 1992 park be reserved for Lions's Club use. The City Clerk: stated that the Rice Lake Park building is located in Ward 7., and would be better able to serve two polling places. No decision was made because further discussion will be needed to address handicap accessibility. MAYOR'S REPORT Condition of the City's gravel roads was discussed, and the need to place gravel on them. Washington County Public Works, Charles Shalander, and City Council meeting of May 4, 199 Paye 5 the Mayor will prioritize the City's roads from "worst" to "best" to determine a sequence for improvements. The Finance Director will report to the Council the City's financial picture for monies available for road improvements. Councilmember Barnes emphasized the need for the City to have someone available for inspection purposes to make sure bad spots in the road are remedied at the time improvements are made. Mayor Stolt man informed the Council of a joint meeting between the Planning Commissions for Hugo and Grant Township to discuss the proposed Barr/Harley subdivision in Grant Township. The meeting is scheduled for Thursday, May 14, 1992 at 7:00 PM, Withrow School. The Mayor addressed the following letters received by the City 1. Letter from Jim Brimeyer regarding the interview process used for hiring of the city administrator. t. The City received an unsigned letter of complaint from a resident. City policy is to not address any unsigned letters of complaint. 3. A letter was received from Randall Barnes regarding City streets. This letter was referred to City Engineer, Howard Kuusisto. 4. A signed letter of complaint regarding a business on Forest Blvd. Miron made motion, Leroux seconded, to refer the above referened complaint (#4) to the Ordinance Violations Committee. All aye. Motion Carried. C. A letter from John Bannigan requesting an opportunity to address the City Council at the time of Council review of the request of Fiver City Asphalt to expand their mining operation. b. The City received numerous letters from residents regarding the request for mining permit expansion. They are to be made a part of the record. Councilman Brunotte will contact MNDOT regarding a ditch along the west side of Highway 61. The ditch is built up so that water is unable to drain. David Schumann addressed the Council requesting the City review his application for site plan approval and issue him a building permit for the building constructed without a permit and a 1,100 square foot expansion. City Attorney Charles Johnson recommended the City contact attorney Jeff Carson regarding this request. Barnes made motion, Lercu:: seconded, that the City Council request to have a legal representation made from our prosecuting attorneys, relative to current litigation, with City administrator8ob Museus present, as soon as possible.
