PRESENT: Barnes, Brunotte, LeroUX, Miron, Stolt man City Administrator, Bob MUseUS City Clerk, Mary Ann Creager Miron made motion, Stolt man seconded, to approve the minutes for the City Council meeting of May 4, 1992, as submitted. All aye. Motion Carried. Barnes made motion, Miron seconded, to approve the claims for May 18, 1992 in the amount of $82,057.36. All aye. Motion Carried. CHARITABLE GAMBLING LICENSE (HUGO LIONS CLUB) The Hugo Lions Club has requested a one -day, off-site gambling license to sell pull tabs at the Hugo City Park during Good Neighbor Days, June 6, 1992. Approval requires motion to approve application and waive the 30 -day waiting period. Leroux, made motion, Brunotte seconded, that the City of Hugo has no objection to the issuance of a One -Day, Off -Site Lawful. Gambling License to the Hugo Lions Club during Good Neighbor Days, held in the Hugo City Park on June 6, 1992, and waiver of the 7.0 -day waiting period. All aye. Motion Carried. AGREEMENT FOR LEGAL_ SERVICES (COUNTY ROAD J IMPROVEMENTS) The City of Hugo entered into a Joint Powers Agreement with the Town of White Dear in December, 1988, for the purpose of improving County Road J (120th Street). Paragraph D of the Agreement requires each municipality to acquire the necessary right-of-way easements within their guidelines for project construction. As the majority of the required easements are located in White Hear Township, and in order to gain efficiency through avoiding duplication of effort, an Addendum to the Agreement has been developed to have the Town of White Hear provide the leqal services required to obtain the easements within the City of Hugo. Total cost for such legal work is estimated to be $3,000 - $4,000, although these ci�sts could be substantially higher if eminent domain proceedings are required. Ler•oUX made motion, Miron seconded, to approve the AddendUM to Joint Powers Agreement dated December 30, 1988, between the Town of White r�eai and the City of Hugo, after the changes r•ec^mmended by Hugo's Cxty, Attorney, Charles Johnson, have been made. The Mayor- .is author•i-ed to sign said Addendum on behalf of the City of*Hugo. All aye. Motion Carried. CONTRACT WITH WASHINGTON COUNTY FOR R(JADhJr''�rJ(:;F: The City's Road Maintenance Contract with Washi.ngtori C0Unty expirps JUrrE_ +��, 1992. A new contract is proposed for a one-year per ic;d, front Ji..rl . ]., City Council meeting of May 18, 1992 Page 2 1992 - June 20, 1993. No substantial changes are proposed for the new contract, and charges remain basically the same for 1992-93, with the provision that labor rates may increase due to future negotiations in Washington County. Cot.tncilman Leroux: questioned whether the City was "satisfied" with the County's performance, and if not, address these concerns at contract -renewal time. It was his opinion that the service provided to the City was not efficient, in particular, summer blading. He also felt that the City should develop a maintenance and improvement plan for roads. The Mayor- is working with the County to prioritize problem areae that need upgrading, depending on available finances. Councilmember Barnes suggested that the City Engineer provide an estimate as to what it would take to do a "wall:: through" of City's roads. Miron made motion, Leroux; seconded, to approve the Road Maintenance Agreement between the City of Hugo and Washington County from July 1, 1992 to June 20, 1992, and authorize the Mayor to sign said Agreement on behalf of the City of Hugo. COMPUTER PURCHASE FOR FINANCE DEPARTMENT Ron Otkin, Finance Director, has requested authorization to purchase a new computer due to a need for more speed and data -storage capacity to serve the growth needs of the City's finance department. Leroux; made motion, Barnes seconded, to approve the purchase of a persona computer for the Finance Department at a cost of $2,329.00. All aye. Motion Carried. FIRE DEPARTMENT RESIGNATIONS Three volunteer fire fighters have submitted resignations from the fire department. Barnes made motion, Brunotte seconded, to accept the resignations of Don Wilke, Ardean Bratlund, and Larry Johnson from the Hugo Fire Department, effective May 18, 1992. All a,,Ee. Motion Carried. City ordinance prohibits cons' -ruction of detached garages between the principal building and the road serving the property. Resolution 98-11 allowss the zoning administrator tO icy{sue variance= for - the setback requirements, subject to Council ratification. SCHUMANN LETTER This matter is in litigation, and a legal opinion has been requested as to how to handle the permit since the City is in litigation with Mr. Schumann over the use of the building. EXECUTIVE SESSION Miron made motion, Brunotte seconded, to schedule an executive session of the Hugo City Council for Thursday, May 21, 1992, at 7:00 PM, to discuss with the City's attorney, Mr. Jeff Carson, the ongoing litigation with Mr. Schumann. All aye. Motion Carried. 9.2 KRUEGER LETTER Stanford and Sandra Krueger have submitted a complaint on the operation of a ZAP game site located in Section 33, south of 132nd Street. The Krueger's maintain that the facility is in violation of its Special Use Permit due to the lack:: of proof -of -liability insurance, absence of signing, lack of building permits, and generally is a detriment to the community. Although just receiving a copy of Krueger's letter at tonight's meeting, Anthony Caron, representing ZAP Games, attempted to address the listed allegations. LeroUX made motion, Barnes seconded, to refer this matter to the Planning Commission to hold a public hearing to consider the allegations made by Stanford and Sandra Krueger that ZAP Games is in violation of their Special Use Permit. REQUEST TO RESERVE CITY PARK Miron made motion, Stoltzman seconded, to approve the request of Melanie LaCasse to reserve the City's park pavilion on Sunday, May 24, 1992, subject to specified conditions. All aye. Motion Carried. PLANNING COMMISSION VACANCY On May 13, 1992, Debra Barnes, Theodora Peltier, and Robert MusEUS interviewed candidates for the vacant Planning Commission position. Stoltzman made motion, Miron seconded, to accept the recommendation of COUnci.lmember Barnes, and appoint Mr. Tin) Agness to the Hugo Planning Commission, to fill the unexpired term of Chuck: Henry to expire 12/71/93. All aye. Motion Carried. City Council meeting of May 15, 1'?9 F"=age 4 Miron made motion, Leroux; seconded, that the City Council share the responsibility of Planning Commission liaison on an alphabetical, rotating, monthly basis. Notice of PC meetings to be sent to the scheduled Councilman. All aye. Motion Carried. MISCELLANEOUS The Fire Chief submitted a letter with verbiage to be used to obtain bids for the sale of the 1956 Jeep grass rig. The notice will be published in the League of Cities publication. Bids will be opened on June 30, 1992 at 12: 00 noon. Councilman LeroUx; reviewed his report of findings regarding the HUrsh/Jesinski fence dispute. Mayor- Stolt man submitted to the Council a list of possible items to be used in the City's next newsletter. Because a number of the topics Have not been fully discussed, the Council thought a work:: session to discuss City "priorities" was in order. Barnes made motion, Miron seconded, that the City Council schedule a work: session for June 9, 1992, at 7:00 PM, to review 1991 priorities, and possible deletions/additions to the priority list. All aye. Motion Carried. The Council received copies of the 1991 audit and the management letter. The City's auditor will be present at the Council meeting of June 1, 1992 to make his formal report. GRAVEL PIT HAUL ROADS A lengthy discussion continued on the use of haul roads as it relates to the disagreement between Dean Atkinson and River City Asphalt. Approval had been given to FICA to use the northern haul route based on needed improvements being made to the roads. RCA submitted a list of improvements they made to the roads, however, there was no written confirmation from the City Engineer's office that these improvements had been done, as stated.
