PRESENT: Barnes, Brunotte, Leroux, Miron, Stolt man City Administrator, Bob Museus City Attorney, Charles Johnson City Engineer, Howard Kuusisto City Clerk, Mary Ann Creager Miron made motion, Brunotte seconded, to approve the minutes for the regular City Council meeting of May 18, 1992, as amended. All aye. Motion Carried. Leroux: made motion, Barnes seconded, to approve the minutes for the executive session of May 21, 1992, as submitted. All aye. Motion Carried. Miron made motion, Stolt man seconded, to approve the claims for June 1, 1992, in the amount of $24,655.04. All aye. Motion Carried. 3.2 BEER LICENSE Darrell P. Tavernier dba Lakeview Inn, at 4444 129th St. has requested a renewal of his 3.2 On -Sale Beer License and cigarette license. The applications are in compliance with City ordinance except that an affidavit verifying sales under $20,000 annually has not been received. Said affidavit waives the necessity for dram shop insurance. A current certificate of general liability insurance has been presented with the application. The City staff has recommended approval of both licenses upon receipt of the required affidavit of sales in accordance with City ordinance. Leroux: made motion, Miron seconded, to approve the 3.2 On -sale Beer license and cigarette license for Darrell Tavernier DBA Lakeview Inn, 4444 129th Street North. Approval is contingent on submission the affidavit of sales. All aye. Motion Carried. HENNA AVE. IMPROVEMENT HEARING Notice of the public hearing for the proposed paying Henna Avenue, between 170th and 180th Street, was published in the Forest Lake Times and in the Peach. Written notice of the hearing was sent to property: owners within the area proposed for assessment on May 201 1992. City Engineer, Howard Kuusisto, reviewed the proposed improvement, and the cost estimates. Discussion continued on methods of financing the project and assessing of benefiting property owners. The public hearing commenced, and property owners opposed to the project cited the following the reasons for denial: too costly because of road frontage owned, not "country" any more, small children on road, excessive speed, increase .i.n taxes, road not usually as bad as this summer, and road needs only to be graveled and maintained. City Council meeting of June 1, 1992 Page 2 Residents in favor of the project used the following rationale: damage t vehicles (washboard), dusty, inability of access to residences by emergency vehicles during spring -thaw, and inability of school buses to make pickups. The public hearing was closed, and discussion continued with regard to questions that need to be answered: current balance in CIF' Phase 2 bond issue, balance in seal coat fund, assessment of homes using private driveway off Henna Avenue, does road fit "highest" priority?,How much is road used and in what condition?, and classification of Henna compared to other roads needing paving. Council member Barnes also requested blown -up map of Henna Avenue, indicating property fronting on the road. Miron made motion, Barnes seconded, to table further discussion on this matter until the meeting of June 15, 1992, to allow time to provide information requested by the Council. All. aye. Motion Carried. AUDITOR'S REPORT Kenneth Malloy was present to report on his firm's findings in regard to the City's annual financial audit. Council members received copies of the audit report and management letter at the Council meeting of May 18th. Mr. Malloy stated that the City is in excellent financial condition. Mayor Stolt man acknowledged the work of past and present employees to create the healthy, financial situation of the City. Leroux made motion, M:i.ron seconded, to accept the 1991 audit report, as submitted by Malloy, Karnowski, and Radosevich. All aye. Motion Carried. RESOLUTION TO REI.' I E.W SPEF_.D 'FITS During 1989 and 1990, the City attempted to reduce the speed limits on certain roads, including Harrow Ave. A MNDOT study found that reducing the speed limit on Harrow Ave., between 157th St. and 165th St., to 45 MPH would be permissible, and the City placed 45 MPH speed limit signs on the street. The City was recently notified by MNDOT that in order to officially lower the speed limit on Harrow Ave., permission must be given by the Commissioner of Transportation, based on a request by the City. The proposed-esolution will provide MNDOT with the ability to officially grant the lower speed limit. No. have requested a subdivision of their property into four parcels for use as single family City Council meeting of June 1, 199' Pages _ housing, which is allowable under the current zoning classification of the parcel. The Planning Commission Field a public hearing on the preliminary plat on May 27, 1992 and recommended approval of the plat as presented. Administrator Museus stated that he had contacted Washington County regarding the driveways from the new lots, and they stated that they had no problem with the subdivision. The subdivision would place the existing house on Lot 2, and the existing metal shed on Lot 1. Councilman Miron stated that the subdivision would create a violation of the City's zoning ordinance by allowing an accessory building, with no principal building, without a Special Use Permit. The City could request a financial guarantee for a specific length of time to assure a building permit is obtained for Lot 1, or not allow sale of Lot 2 until a building permit is obtained for Lot 1. There was also discussion of drainage on Lot 4 as it affects the property owner to the east. Barnes made motion, Miron seconded, to approve the preliminary plat for subdivision of 5.6 acres into four lots, and waiver of the formal platting process, as requested by fon and Pauline Daubenspeck of 5687 140th Street. Approval is subject to the following special conditions: 1. Final grade on Lot 4 must divert drainage to the south, and avoid runoff onto the adjacent property to the east. 2. Lot 2 may not be sold until a building permit is issued for Lot 1. This is to avoid a violation of the City's zoning ordinance, which prohibits construction of an accessory building prior to construction of the principal building on any lot. 3. Payment of the park land dedication, in the amount of $525.00, must be made upon filing of the final plat. All aye. Motion Carried. SPEC I FAIL. USE PERM( ( ST I LL_l+1ATEF',: SCHOOL. DIST.) The Stillwater Public School District has requested a Special Use Permit to replace an existing 24' X 40' moveable classroom with a 28' X 72' moveable classroom on the site of the Withrow Elementary School. The Planning Commission considered the request on May 27, 1992 and recommended approval of the SUP. Barnes made motion, Stolt man seconded, to request of the Stillwater School District 40' moveable classroom with a 28' x 72' Withrow Elementary School. All aye. Motion Carried. VARIANCETO SETBAC K_.(SHERMAN ).. approve the Special Use Permit #834 to replace an existing 24' moveable classroom at. the On May 27, 1992, the Board of Zoning Adjustments considered the reque,:t. of William Sherman for a variance to the City's Shore.land Ordinance in order, to construct a swimming pool on his property without the required 200' shoreline setback:. The Board recommended approval of the variance. Lerc:um made motion, Miron seconded, to approve the variance request of William Sherman of 9130 125th Street to construct a swimming pool 155' from Long Lake (200' required) . All aye. City Council meeting of June 1, 199 Page 4 VARIANCE TO SE:THAQ (WF_NHOLZ ) The Board of Zoning Adjustments considered the request of Dale & Rayne Wenholz for a 10' variance to construct a pole barn within the required side yard setback in an agricultural district. The Board recommended approval of the setback. Leroux made motion, Barnes seconded, to approve the request of Dale and Rayne Wenholz of 6827 170th Street, to construct a 30' x 48' pole building 10' from his west property line (20' required). The proposed building is to be used for residential purposes only. All aye. Motion Carried. VAR I ANCE TO SETBACK (HARV I EUX ) Charles Harvieux requested a variance from the City's Shoreland Ordinance for construction of a new drain field within 200' of Long Lake. Upon consideration, the Board of Zoning Adjustments recommended approval of the request. Mi.ron made motion, Stolt man seconded, to approve the variance request of Charles Harvieux of 9171 130th Street, to construct a new drain field 100' from the shore land of Long Lake (200' required) . All aye. Motion Carried. C':IVERSIZE.D GARAGE. Thomas and Janis Raster have requested a variance to construct an oversized garage on their property located at 15227 Greene Ave. (zoned Agriculture). Stolt man made motion, Brunotte seconded, to approve the variance request of Thomas and Janis Raster of 15227 Greene Avenue, to construct a one -stall addition to an existing two -car garage, thereby creating an oversized garage. The proposed structure is to be used for residential purposes only. All aye. Motion Carried. Miron made motion, Leroux seconded. directing the City Admin:istrai or to review present City regulations regarding oversized garages and determine and "typical" size garage to be incorporated into City ordinance. All aye. Motion Carried. STREET MA I NTF_.hJANCE F OL I CY At she May 15, 1V92 City Council meeting, the City Administrator- was directed to draft a haul -road policy for the City. The Council received proposal for a street maintenance policy, which includes haul roads, as well as other sections pertinent to the operation and maintenance of the City's mads. The Council will review and discuss at a later- date. City Council meeting of ,June 1, 1992 F-13Uf•= GRANT TOWNSHIP REQUEST The Town of Grant has requested to purchase the patrol car which the City has replaced this year with a new car. Grant. Township is offering to pay the "average" price paid for similar vehicles at the June County auction. This sale would be advantageous to the City by avoiding the administrative details involved in the auction, be assured an average price for the vehicle, and it would be a good will gesture toward the Town of Grant. Given the condition of the vehicle (79,000 miles) and past auction expenses, the City can expect $3,000 - $4,000. LeroU:: made motion, Stolt man seconded, to approve the sale of the City's squad car to Grant Township for an "average" price to be determined from the sale of similar vehicles at the Washington County auction to be held in June, 1992. All aye. Motion Carried. RICE LAKE MEADOWS EXTENSION REQUEST On September 16, 1991, the City Council approved, with conditions, a preliminary plat for the Rice Lake Meadows Subdivision. One of the conditions was that the developers were to submit a ficial plat for Phase 1 within 120 days. James Merila, acting on behalf of the developers, is requesting an extension of the time limit due to delays in obtaining necessary approvals from the Army Corps of Engineers. Stolt.Zman made motion, Brunotte seconded, to approve the request of James Merila to extend the time limit for the Rice Lake Meadows subdivision until July 21, 1992. All aye. Motion Carried. PEL.OQU I N IND.- F'AF:k: ROAD MAINTENANCE David G. Kembar of Regal Plastics submitted a letter' requesting the City add gravel and perform dust control on the City streets in the Peloquin Industrial Park-. The City has not routinely provided dust control on any of its roads. Many roads are in need of gravel this year due to the unusual weather conditions this spring. Leroux made motion, Miron seconded, to table this request until the road-) priority list is made available. All. aye. Motion Carried. HAUL.. ROUTE At the May 18, 1992 Council meeting, the Council directed the City Engineer to review the roads used by River City Asphalt to haul material to the County Road 57 Improvement Project. The Council was concerned tkiat the hauling may have damaged the roads in gUestion. Howard k,UUsiSto waS present at the meeting to review his report on ha<<1 road conditions. Councilman Miron questioned whether the existing Mining Permits should be, amended to reflect the change in haul roads. City Attorney Johnson Suggested an Addendum be attached to the permits. City Council meeting of June 1., 1992 Paqe 6 Miron made motion, Stoltzman seconded, directing the City Attorney, Charles Johnson, to draft an Addendum for the Mining Permits held by Dear, Atkinson and River City Asphalt, reflecting the change in haul roads. COMPLAINT REPORT In response to a complaint by a concerned citizen, the City Council directed the Ordinance Violations Committee to review a possible ordinance Violation in the storage of junked vehicles at t4645 Fcrest Blvd. Stolt man made motion, Miron seconded, to table this matter until the City Council meeting of June 1.5, 1992. All aye. Motion Carried. MISCELLANEOUS Washington County will hold a public hearing on June 25, 1992, at 6:30 PM, to discuss their relinquishing ownership of County Road 54 to the City of Hugo. Administrator MUseUs will be in attendance at this meeting. Administrator MUseUs reported on the Mining Permit issue, stating that the request for expansion by River City Asphalt, and their existing permit, should be handled as separate issue. Dean Atk:inson's permit will also be expiring. Barnes made motion, Brunotte seconded, to schedule a public hearing for June 15, 1992, to consider- the requests of Dean Atkinson and River City Asphalt to renew their Mining Permits. All aye. Motion Carried. Attorney Johnson reported that progress is continuing on obtaininq a <=>ite selection for the proposed water tower. Miron made motion, Stolt man seconded, to adjourn at 10:420 PM.
