PRESENT: Barnes, Brunotte, Leroux, Miron, Stoltzman City Administrator, Bob Museus City Attorney, Charles Johnson City Clerk:, Mary Ann Creager Miron made motion, Brunotte seconded, to approve the minutes for the City Council meeting of June 1, 19929 as amended. All aye. Motion Carried. Leroux made motion, Barnes seconded, to approve the claims for June 15, 1992, in the amount of $40,845.25. All aye. Motion Carried. CHARITABLE GAMBLING LICENSE The Church of Saint John the Baptist has requested a renewal of their Charitable Gambling Permit. No problems have been identified with their gambling operation. Recommend approval by motion. Miron made motion, Stoltzman seconded, that. the City Council does hereby resolve that they have no objections to issuance of a Gambling License, pursuant to M.S. 349.213, Subd. 2, for the Church of St. John the Baptist, 14+83 Forest Blvd. on August 23, 1992, for the purpose of conducting lawful gambling, and waiver of the 60 --day waiting period. All aye. Motion Carried. MINING APPLICATIONS (RIVE- C I TY.y ASPHAL T / DEAN AT M:: I NSON ) The Council requested a hearing be established for River City Asphalt's application for a mining permit for their property currently being mined under a SUP. Following the last Council meeting, Dean Atkinson also submitted an application for a renewal of his mining permit under a SUP. Given the close proximity of the two operations, both applications were included in the public notice for the hearing. Due to the fact that they are separate applications, it: would be appropriate to consider each application as a separate item, subject to their own public comments and Council findings. Both existing permits expire July 1, 1992. DEAN ATKINSON The Council reviewed Mr. Atkinson's existing permit to update it., where necessary. The public: hearing was opened, and no c._omments were made, f::::,r or against. Barnes made motion, Leroux seconded, to approve the rene"a1 of the !'lining Permit for Dean Atkinson until Jul.; 1., 1.990, subject to special conditions, as on file in the City. All aye. Motion Carried. City Council meeting of ,lune 15. 1992 Paoe Miron made motion, BrUnotte seconded, Authorizing the Citi Administrator to determine if the $2,000 deposit made by Dean Atkinson to cover the cost of City inspections should be returned to him. All aye. Motion Carried. RIVER CITY ASPHALT Richard Carron, representing River City Asphalt, addressed the Council about his operation. The public hearing was then called to order, and a number of residents addressed the Council with the followinq objections: noise, smell, and traffic because of the asphalt plant, no longer an appropriate use in, basically, a residential area, and 'loss of property value. Ed Waller spoke on behalf of the operation, stating that the gravel -pit operation has been there a long time, and they should be allowed to deplete the property of the resoc.trce. Darrel Hansen, property owner of the pit, hoped that the City would allow mining of the land, and then the property could be subdivided. Allen Barnard, attorney for RCA, addressed the Council stating that they should be allowed to continue their mining operation, as in the past, because it has been A long-time operation, and a substantial amount of money has been spent for the operation. The public hearing was closed, and members of the Council felt that a rock crusher and asphalt plant was not allowed in the agriculture zoning district. The Council then reviewed RCA's existino M.inina Permit to bring it up-to-date with the major change being the deletion of the rock: crusher and asphalt plant from the Mining Permit. Because of a "hang-up" on certain language, the administrator offered to make changes in the permit and present it to the Council for their review. Leroux made motion, Miron seconded, to rescind the motion approving renewal of the Mining Permit for Dean Atkinson to allow for further consideration, as it relates to stockpiling. All aye. All aye. Motion Carried. HENNA AVENUE IMPROVEMENTS The Council tabled a decision on the proposed Henna A,.el")Ue i.rr-sprovements following the public hearing conducted on jUne 1, 199`x. And requested additional information from the Cit.:, `qtr--tff. . The C'r_,Unc-.i. 1. ' s decision at this time is to determine. if the project. .is fi.nanc.ial.l, fFas&ible, And if City Council meeting of June 15, 1992 Page - the project will provide Sufficient benefit to warrant its cost. It. is, of course, impractical to make a decision without considering the project's financing, though a decision on the assessments would be premature at this time under M.S. 429 (Uniform Special Assessment Code). The Council again discussed financing of the project, funding for a seal coat project, possible means of assessing, and priority of Henna Avenue. Councilman Miron suggested the City proceed with road -base improvements at this time. Barnes made motion, Brunotte seconded, to adopt RESOLUTION 199'-11, RESOLUTION ORDERING THE IMPROVEMENT OF HENNA AVENUE, PROJECT #4-6-92. VOTING AYE: Barnes, BrUnotte, Lerouxt, Miron, Stoltzman Motion Carried. Barnes made motion, Stoltzman seconded, that the City Administrator report to the City Council on the methods of the financing and assessing the Henna Avenue project at the meeting of July b. 1992. PLANNING COMMISSION FINDINGS FOR AMENDED SUP (RIVER' C l "I' ..r. r'it iF= HAL 1" 1 The City's Planning Commission has recommended that the amended Special Use Permit, as requested by Richard A. Carron and Darrel 8. Hansen, be denied based on findings made at their special meeting of dune 10, 1992. Representatives from River City Asphalt, and the City residents opposed to the SUP, met on June 9th to discuss possible options which would satisfy both parties. He has requested NO PARKING signs along the south side of i.46th street and the east side of Finley Avenue to alleviate this problem. He has talked to abutting property owners, who stated that they have no objection to the request. Fast practice of the City Council has been not to conduct a hearing on parking signs, though a hearing woUld allow possible other public interest in the issue to be heard. Given the legitimate concern of the city to have clear lanes for fire vehicles to protect the public's safety, and the lack of objection from neighboring property owners, a hearing is probably not called for. Miron made motion, LeroUX seconded, directing the City staff to place NO PARKING BETWEEN SIGNS along a south portion of 146th Street, and NO PARKING signs along the east side of Finley Avenue, as requested by the Hugo Fire Chief. VARIANCE FOR OVERSIZED GARAGE (BRIDGES) Dave Bridges, 7424 Xerxes Ave. North has requested a variance to construct an oversized oarage at his residence located at 13455 Elmcrest Avenue. Given the house and oarage are both new construction, the large --lot size (7.2 acres), and that the garage as proposed meets all other requirements of the City's Zoning Ordinance, staff recommends af:;proval of the application. Miron made motion, BrUnotte seconded, to approve the variance request. of Dave Bridoes to construct an oversized attached oarage at his residence located at 1455 Elmcrest Avenue. The proposed garage is to be Used for residential purposes only. Al aye. Motion Carried. COMPLAINT ON 14645 FOREST BLVD The Council's Ordinance Violation Committee will make a recommendation on the complaint filed on junk. cars bei.nq stored at 14645 Forest Blvd. Councilman Brunotte inspected the site and found debris and numerous unlicensed vehicles. City Council meeting of June 1.5. 1992 PaQe 5 Leroux; made motion, Miron seconded, that the City of Hugo appoint Dave Truax: to serve as Hugo's representative on the Br'own's Creek Watershed Management Organization, for a term to expire July, 1994. All aye. Motion Carried. FINAL SUBDIVISION APPROVAL (DAUBENSPECK:) The City received the final plat for Ron and Pauline Daubenspeck to subdivide 5.6 acres into four lots known as DAUBENSPECF:: ESTATES. The required changes to the plat were made, as required by the City and the City Engineer. Miron made motion, Leroux: seconded, to approve the final plat for Ron and Pauline Daubenspeck to subdivide 5.6 acres into four lots known as DAUBENSPECK ESTATES. Approval is subject to the following: 1. Payment of $525.00 for park land dedication. 2. Lot 2 may not be sold until a building permit is issued for Lot I. All aye. Motion Carried. MISCELLANEOUS Miron made motion. Stolt man seconded, to schedule a special meeting of the Hugo City Council on Wednesday, June 17, 1992, at 7:30 PM, for -the purpose of conducting a work session for further discussion of Cit; priorities. All aye. Motion Carried. Attorney Charles Johnson reviewed the response from Mr. Robert Lydon regarding the changes in the Joint Powers Agreement between the City of Hugo and White Bear Township, relative to the County Road "J" Project. Barnes made motion, Stolt man seconded, to approve the Special Agreement between the City of Hugo and White Bear Township, and authorize the Mayor to sign said Agreement on behalf of the City. Approval is subject t.o the City of Hugo being notified if attorney'.s fees exceed $3,200. All aye. Motion Carried. Stoltzman made motion. Brunotte seconded, to adjourn at PM.. All aye.
