Attending were Spitzer, Peloquin, Peltier, Rosenquist, Greger, Ehret, Gillen, and Bill Schwab, Washington County Planning Commissioner. Motion made by Ehret, seconded by Greger, to approve the minutes of the October 27 , 1976 meeting after the following change was made: Page 2 — Applicant for Special Use Permit for Little Lamb's Preschool is actually Shepherd of the Fields Church, not June Smith. Bald eagle Sportsman Club Attorney Peters called and stated that material was not ready for the meeting. Would tentatively like matter delayed until December 8th meeting. Chairman Spitzer suggested that they defer any action until after the first of the year. White Bear Rod and Club Ehret made motion, seconded by Rosenquist, to consider the supplement to set agenda regarding Mr. Perron's request. All aye. Mr. Perron quoted Section 21 of the Special Use Permit in regards to a variance in the case of undue hardship. After the Special UsP Permit was reinstated, Mr. Perron wanted to bring up the matter now before anyone else did. Mr. Perron then quoted Section 13 (corrected to read Section 9) in regards to the standards of the Pollution Control Agency. Mr. Perron stated that the club would conform to the results of a study being conducted by Mr. Perez. Spitzer stated that Mr. Perron would like a change from the 40 decibels as stated in Section 9, but has not submitted any new number. Mr.. Perron stated that he was not sure how he could come up with a figure. Peltier submitted two letters for consideration from International Acoustical Testing Laboratories, dated December 41 1973 and February 8, 1974, regarding reports on sound level survey conducted at the proposed site of the White Bear Rod and gun Club. Chairman Spitzer read said letters, and asked they be made part of our current file. Gillen stated that variance request should read modification of Section 89 not deletion. Chairman Spitzer itemized what information Mr. Perron would need before a variance could be considered: 1 — on what hardship basis is Mr. Perron asking for a variance, 2 — make a specific request in terms of peak amplitude at property .line, 3 — how peak amplitude will be measured with expert testimony supporting methods, and 4 — that noise levels should be compared in neighborhood in conjunction with other noises occurring at various times of the year. After data has been compiled, Mr. Perron should file an application for variance to the Special Use Permit, and submit to the Planning Commission for review. A Public Hearing will then be in order. Secretary instructed to submit a (See insert for correction added to the above) Hugo Planning Commission November 10, 1976 Page 2 of letter to Mr. Perron in regards to what will be needed before applying for variance. Recessed 8:50 P.M. Reconvened 9:02 P.M. Mr. Schwab presented revised map as to be presented to City Council for consideration at their meeting of November 15, 1976. Mr. Schwab stated that Mr. Carl Dale suggested that the Conservancy zoning as now on record be reevaluated because of new soil maps and aerial views. Motion made by Peltier, seconded by Ehret, to submit the revised map and all data to the City Council for their action. VOTING FOR: Spitzer, Ehret, Peloquin, Peltier, Rosenquist, Greger, and Gillen Motion Carried Motion made by Rosenquist, seconded by Ehret, requesting authority from the City Council to reevaluate the boundaries of the Conservancy districts in city zoning, and to provide an amended report no later than November, 1977. VOTING FOR: Spitzer, Ehret, Peloquin, Peltier, Rosenquist, Greger, and Gillen Motion Carried Motion made by Rosenquist, seconded by Ehret, to close the agenda of December 8", 1976 to all other business, and take care of orga- nizational concerns.of the Planning Commission. All aye. Greger made motion, seconded by Peloquin, to amend the motion, de- leting the words "closed to all other business". All aye. Notion made by Peltier, seconded by Greger, to adjourn at 9:36 P.M. Mary rnCreager, Secretary Planning Commission PLANNING COMMISSION NOVET-3ER 10, 1976 The following to be added. to the official minutes of the Planning Commission meeting of November 10, 1976, under the heading uJHITE BEAR ROD AND GUN CLUB, after the sentence "Mr. Perron stated that the club would conform to the results of a study being conducted by Mr. Perez": Mike Gillen had spoken to Mr. Perez, and Mr. Perez stated that land south of the gun club was not suitable for home sites. Mr. Gillen asked Mr. Perron what the club proposed to do. Mr. Perron stated he did not think matter was relavent at this time.
