HomeMy WebLinkAbout1976.11.24 PC MinutesMINUTES OF THE PROCEEDINGS O THE HUGO PL: hTNING COPCTISSION - NOVETfBER 24, 1976 Public Hearing - Little Lamb's Preschool (Special Use -'ermit) The public hearing was called to order by Chairman Spitzer at 7:08 P.M. Attending were Spitzer, Ehret, Peltier, Rosenquist, and Greger. Peloquin arrived at 7:18 P.:.'. , and Gillen arrived at 8:04 P.M. Chairman Spitzer read the official notice of the public hearing. A revised playground plan was presented to the commission. The Fire Chief has not as yet received information from the state in regards to the code. Tom Crever, Building Inspector, submitted a written report which was read aloud by Chairman Spitzer. He stated that th-e facility does meet State 3uilding code requirements for a "Group C Division 3 Day Care Facility. However., an approved fire alarm shall have to provided if the occupant load exceeds 29 persons. Crever was contacted, and he stated words were vertabim to State Building Code. Vrs. June Smith felt the code read that you could have 29 children, and any number of teachers and volunteers. ^rnest Hem el, 8024 147th Street, ruco - church member stated he was in favor of. preschool. Spitzer stated that Special Use Permit read not more than 30 children at any one time. Mrs. Smith stated that there was usually one child absent every stay. Mr. aim Olson, Hugo Fire Chief, was present to hear as to how Little Lamb's Preschool will comply with state fire code. Mr. Olson will check state code to make sure fire codes are met. Letter from adjoining property owner (Mr. & 14rs. Gallon) was read, recordi::� ; them as in favor of subdivision. The report of City Engineer, Howard Kuusisto, was read aloud. Greger - Outlot C - After developing, what are you going to do for access? Jungblut - LeaVe in natural state. Rosenquist - du not agree with opening Outlot C. Would like to make walking access. Do not want boat access there. 'hret - I agree with Mr. Rosenquist. Concerned with safety factor in regards to children. !caring closed at 7:45 P.M. Planning COIIlriliSsion November 24, 1976 Page 2 4"eetina The meeting was called to order at 7:58 P.M. by Chairman Spitzer. Present were: Spitzer, Rhret, Peltier, Peloquin, Rosenquist, and Greger. Absent: Gillen Addition to minutes of meeting; of November 10, 1976 — The fact that r."r. Gillen had spoken to Mr. Perez, and Mr. Perez stated that land south of the gun club was not suitable for home sites. T•1r. Gillen asked r'r. Perron what the club proposed to to. Mr. Perron stated he did not think matter was relavent at the time. Spitzer suggested language be recorded on page 1 after the sentence "Mr. Perron stated that the club would conform to the results of a study being conducted by Air. Perez." Peltier — approval of minutes of (page 1) should read October 27, 1976. Ehret — name should be added to members present. Motion made by Peloquin, seconded by Rosenquist, to approve the minutes of November 10, 1976 meeting, after the above corrections are made. Peltier — minutes on rezoning of Francis Peltier (September 22, 1976) pa -0e 9 should read that portion of 20 acres (lying north of 130th Street) be granted. Motion made by Peltier, seconded by Ehret, that correction be made to the minutes of the September 22, 1976, meeting. Little Lamb's Preschool 1'hret — Concerned with clarification of the 29 children. June Smith — would go with 26 children and 3 teachers. Spitzer — In either event, commission would have to go along with :3uilding Inspector's interpretation. Spitzer — I think we should recommend approval of the Special Use Permit provided maximum number of children at any time will not exceed 26 students and 3 instructors unless state building codes do in fact permit greater attendance without the installation of an approved fire alarm. Also, approval be contingent upon approval of fire chief and his assessment of fire codes. T-otion made by Ehret, seconded by Peltier, to recommend approval of the Special Use Permit for Little Lamb's Preschool subject to the following: 1. Maximum number of children at any time will not exceed 26 students and 3 instructors unless state bulding codes do in fact permit greater attendance without the in - 0. stallation of an approved fire alarm. 2. Contingent upon approval of fire chief and his assessment of fire codes are met. VOTING FOR: Spitzer, 'Ehret, Peltier, Peloq-ain, Rosenquist, Greger, and Gillen. Motion Carried. Planning Commission November 24, 1976 Page 3 George Jungblut — Subdivision Motion made by Peloquin, seconded by Rosenquist, to recommend approval of the preliminary plat to the City Council subject to the following: 1. That Outlots C and J shall be left in unimproved state until Outlots H and I are developed, at which time Outlot J shall be improved L. appropriate road standards, and Outlot C shall be so improved as to provide only walking access to the lake. 2. Surface drainage direction and structures should be shown. 3. Building set—back lines should be indicated. 4. A drainage section will be necessary between the proposed block 1 and 2 and Outlots H and I. It is suggested that a neighborhood plan would be developed. This plan should show building locations, surface drainage ways, and direction of flow on the plat and Ethan Avenue. Motion made by Ehret, seconded by Rosenquist, to attempt to further stipulate that park land dedication should be appropriate amount of money based on market value which assessed amount shall be determined prior to the approval. of the final plat. Motion made by Gillen, seconded by Ehret, to amend the motion by in— serting the words, drain fields, to Item 4. VOTING FOR: Spitzer, Ehret, Peltier, Rosenquist, and Gillen AGAINST: Peloquin rBSTAINED: Greger Motion Carried Voting on motion with addition of the words, drain fields, to Item 4. VOTING FOR: Spitzer, Ehret, Peltier, Rosenquist, Greger, and Gillen ABSTAINED: Peloquin Motion Carried Ron Baker — Purchase of Lakeview Inn (Special Use Permit Mir. Baker would like to purchase the Lakeview Inn on 3ald Eagle Lake. Business at one time consisted of a tavern and boat rental. He would like to know if it was grandfather in, and if he could repair motors. Spitzer stated that if business was grandfathered in, business may not be intensified. Mr. Baker would like to tear down most of the buildings, leaving main building and add onto the back. Mr. Baker plans to operate Planning Commission November 24, 1976 Page 4 a boat rental business, and sell bait supplies. Peloquin - Do you intend to discontinue the bar business? Baker - I an not interested in the tavern business. Maybe I will sell pop and candy. Tavern license will expire in 1977. Rosenquist - Will there be sales of boats and motors`: Barer - Used merchandise. I will deal only in marine business. The land is now zoned SFE, and has 120' on the lake.
